DatedLahore,the10thMarch,1993 NOTIFICATION No.1(66)RP/P&D/90.InexerciseofthepowersconferredbySection25oftheCholistan DevelopmentAuthorityAct,1976(XIVof1976),theGovernorofthePunjabispleasedto makethefollowingrulesnamely: THECHOLISTANDEVELOPMENTAUTHORITY(APPOINTMENTAND CONDITIONSOFSERVICE)RULES,1993 PART(GENERAL) 1. (a). TheserulesshallbecalledtheCHOLISTANDEVELOPMENT AUTHORITY(AppointmentandConditionsofService)rules,1993. Therulesshallcomeintoforceatonce. TheserulesshallapplytoalltheemployeesoftheCholistan DevelopmentAuthority,Bahawalpur.

(b). (c).

DEFINITION. IntheseRules,unlessthecontextotherwiserequiresthefollowingexpressions shallhavethemeaningherebyrespectivelyassignedtothem,thatistosay: a) AppointingAuthorityinrelationtoapostmeansthepersonauthorizedunder rule6tomakeappointmentonthatpost. b) AutonomousorSemiAutonomousOrganizationmeansanorganizationset upunderalawbytheGovernment. c) Committee means the Committee constituted for the recruitment and promotionoftheemployeestocertainposts. d) Groupmeansagroupofemployeesinthesamegradeperformingsimilar duties. e) Initial Recruitment means appointment made otherwise than by promotion/deputation,transferfromProvincialGovernmentortheGovernment ofPakistanandAutonomousorSemiAutonomousOrganization. f) PostmeansapostinconnectionwiththeaffairsofAuthority.

g) Schedulemeansthescheduleappendedtotheserules.
h) ServicemeanstheserviceoftheAuthority.

i) 3. (a).

TemporaryPostmeansapostcreatedforalimitedperiodoftime. ThereshallbeoneormorepromotionCommittees&Selection CommitteestobeconstitutedbytheChairmanforrecruitmentand promotionoftheemployeestodifferentposts. Each such Committee shall consist of at least three members, one of whomshallbeappointedastheChairmanofthatcommittee.

(b).

Whereanappointingauthoritydoesnotaccepttherecommendationsofa committee,itshallrecordreasonsthereforeandsubmitasummaryofthecasefor orderstotheChairmanoftheAuthority. (a). Appointment to posts shall be made by promotion, transfer or initial recruitmentorcontract,asspecifiedintheschedule. (b). Appointmentbypromotionortransfershallbemadeinaccordancewith PartIIoftheserules.

TheAuthoritiescompetenttomadeappointmenttovariouspostsshallbe

asspecifiedinColumn4oftheschedule. 7. Apersonappointedtoapost,otherthanatemporarypost,shallremainon

probationforaperiodoftwoyearsifappointedbyinitialrecruitmentandforaperiodof oneyear,ifappointedbypromotion,providedthattheAppointingAuthoritymayfurther extendtheperiodofprobationbutnotexceedingtwoyearsinall. EXPLANATION. (a) Servicespentondeputationtoacorrespondingorahigherpostshallbe

countedtowardstheperiodofprobation. (b) Noemployeeshallbeconfirmedagainstapostunlesshehassuccessfully

completedsuchtrainingandpassedsuchdepartmentalexaminationasmaybeprescribed bytheAuthorityfromtimetotime. (c) If no order is made by the day following the completion of the initial

probationaryperiod,theperiodofprobationshallbedeemedtohavebeenextended. (d) Subject to the provisions of clause (b) above a probationer who has

satisfactorilycompletedhisperiodofprobation,shallbeconfirmedwitheffectfromthe dateofhiscontinuousappointment.

Providedthatwheretheperiodofhisprobationhasbeenextendedunder the provision of clause (c) above the date of confirmation shall, subject to the other provisionsofthisrule,bethedateonwhichtheperiodofprobationwaslastextended. (e) Iftheworkorconductofanemployeeduringtheperiodofprobationhas

been unsatisfactory, the appointing Authority may, without notice, dispense with his services, if has been appointed by initial recruitment and if he has been appointed otherwisereverthimtohisformerpost. (f) 8. Thereshallbenoconfirmationagainstanytemporarypost. Theseniorityinterseoftheemployeesappointedtopostsinthesamegroupshall

bedetermined:

a) In the case of employees appointed by initial recruitment, in


accordance with the order of merit assigned by the Selection Committee: Provided that employees selected for appointment to the postinanearlierselectionshallrankseniortotheemployeesselected inthelatterselectionand b) Inthecaseofemployeesappointedotherwise,withreferencetothe dateoftheircontinuousappointmentinthepost: Providedthatifthedateofcontinuousappointmentinthe caseoftwoormoreemployeesappointedtothepostisthesamethe olderifnotjuniortotheyoungerinthenextbelowpostshallranksenior totheyoungeremployees. EXPLANATIONI If an employee junior in a lower post is promoted to a higher post by supersedinghisseniorandsubsequentlythelatterisalsopromoted,thepromoteefirst shallrankseniortotheonepromotedsubsequently. EXPLANATIONII Subjecttotheprovisionsofrule10,ajuniorappointedtoahigherpostshall bedeemedtohavesupersededhissenioronlyifboththejuniorandtheseniorwere consideredforthehigherpostandthejuniorwasappointedinpreferencetothesenior.

EXPLANATIONIII The seniority of employees appointed by initial recruitment to the post visavis those appointed otherwise shall be determined with reference to the date of continuous appointmenttothepostProvidedthatiftwodatesarethesame,theemployeesappointed byinitialrecruitment:Providedfurtherthatinterseseniorityofemployeesbelongingtothe samecategorywillnotbealtered EXPLANATIONIV Incaseagroupofemployeesisselectedinitialappointmentatonetime, theearliestdateonwhichanyoneofthegroupjoinstheservicewillbedeemedtobedate ofappointmentofallemployeesnthegroup.Similarlyincaseagroupofemployeesis appointedotherwiseatonetimeinthesameofficetheearliestdateonwhichanyofthe groupjoinstheservicewillbedeemedtobethedateofappointmentofallemployeesin thegroup.

PARTII APPOINTMENT BY PROMOTION, TRANSFER OR DEPUTATION 9. (a)

Appointmentsbypromotiontopostsinvariouspostsshallbemadeonthe

recommendationsoftheappropriatecommittee. (b) PromotionincludingPerformapromotionshallnotbeclaimedasamatter

orrightbyanyemployee. 10. (a) ApersonintheserviceoftheGovernmentoranautonomousorsemi

autonomous organization who possesses the minimum educational qualification, experienceorlengthofserviceprescribedforapostshallbeeligibleforappointmentto thesaidpostondeputation,inaccordancewiththepolicyprescribedbythatGovernment. (b) After declaration of the service of Cholistan Development Authority, as

pensionablebytheGovernment,anemployeeoftheAuthoritymaybesentondeputation toaGovernmentDepartmentoranAutonomousorSemiAutonomousOrganization,on suchtermsandconditionsasmaybedecidedbytheManagingDirectorinconsultation withtheborrowingOrganization.

Providedthatpensioncontributionshallinvariablybepaidbytheborrowing organization. (c) TheManagingDirectormaytransferanyemployeefromtheAuthorityto

anyofitsagenciesandviceversaagainstequivalentpostsandnodeputationpayor allowanceshallbeadmissibleinsuchcases. (d) Onlysuchemployeesaspossessthequalificationsandmeettheconditionslaid

down for the purpose of promotion to a post, shall be considered by the promotion committee, except where the Chairman is of the opinion that strict application of the conditionsprescribedneedsrelaxationinindividualcasesforreasonstoberecorded. PARTIII. INITIALAPPOINTMENT 11. (a) Initialappointmentstopostingrade16andaboveshallmadeonthebasis

ofexamination/testorinterviewbeholdbytheappropriatecommittee,afteradvertisement ofthevacanciesinnewspapers. (b) Initialappointmenttoallpostsingrade1to5shallbemadeonthebasisof

examination/test or interview to be held by the appropriate committee either after advertisement of the vacancies in Newspapers or after reference to the Employment Exchange. 12. (a) Acandidateforinitialappointmenttoapostmustpossesstheeducational

qualificationsandexperienceandmustbewithintheagelimitprescribedintheschedule providedthat: (i) In suitable cases for reasons to be recorded in writing, the

appointingauthoritymayrelaxtheupperagelimituptoamaximumof5yearsandthe Chairmanmayrelaxtheupperagelimitupto10years.However,theGovernmentmay relaxtheupperagelimitbeyond10years. (ii) Therestrictionregardingageshallnotapplytoacandidatewhois

anemployeeoftheAuthorityinsameothercapacityand (iii) Experience, where prescribed, would include equivalent

experience, in a profession or in the service of an Autonomous or SemiAutonomous OrganizationoraprivateOrganization.

(b)

(i)

Where recruitment is to be made on the basis of a written

examination, age shall be reckoned as on the first day of the month in which the examinationisproposedtobeheld. (ii) In other cases, as on the last date fixed for submission of

applicationforappointment. 13. No person shall be appointed to a post unless he is a domicile of Punjab.

PermissionfortheappointmentofapersonwhoisnotacitizenofPakistanwillbeneeded fromtheGovernment. 14. Acandidateforappointmentmustbeingoodmentalandbodilyhealthandfree

fromanyphysicaldefectlikelytohinderwiththedischargeofhisduties.Acandidatewho aftersuchmedicalexaminationastheAuthoritymayspecifyisfoundnottosatisfythese requirements,shallnotbeappointed. 15. (a) Noperson,notalreadyintheserviceoftheAuthorityshallbeappointedto

apostunlessheproducescertificatesofcharacterfromtworesponsiblepersonsnotbeing hisrelativeswhoarewellacquaintedwithhischaracterandantecedentsinadditiontoa certificate of character from the head of the academic institution last attended, where applicable. (b) Notwithstandinganythingcontainedinclause(a)anappointmentbyinitial

recruitment shall be subject to the verification of character and antecedents of the candidatetothesatisfactionoftheappointingauthority. 16. WheretheinterestoftheAuthoritysorequires,apersonmaybeappointedon

contract,foraperiodnotexceedingthreeyearsatatime,ontermsandconditionstobe specifiedinthecontractagainstaspecifiedpost.Allsuchappointmentsshallrequireprior approvaloftheChairmanoftheAuthority. PARTIV 17. Apermanentemployeemayresignfromservicebygivingaonemonthnoticeor

forfeitingonemonthpayinlieuthereof,providedthatifthenoticefallsshortofonemonth theemployeeshallhavetoforfeitpayfortheperiodfallingshortofonemonth. 18. Theserviceofanemployeerecruitedagainstatemporarypostmaybeterminated

on30daysnoticeoronpaymentofonemonthspayinlieuthereof.Incaseheresigns

fromservice,hewillhavetogiveonemonthsnoticeorforfeitonemonthspayinlieu thereof. 19. Intheeventofapostbeingabolishedorthepostsinagroupofthesamegrade

beingreducedinnumber,theservicesofthejuniormostemployeeinsuchagroupshall beterminatedaftergivingsuchemployeethirtydaysnoticeorpayinlieuthereof. 20. AnemployeeoftheAuthorityshallretirefromservice: a) Onsuchdateafterhehascompletedtwentyfiveyearsofservicequalifyingfor pensionorotherretirementbenefits,asthecompetentauthoritymay,inthe publicinterest,director

b) Wherenodirectionisgivenunderclause(a)onthecompletionofsixtyyearsof
hisage.

c) Subject to the approval by Finance Department/Competent Authority, the


employees of Cholistan Development Authority, shall be entitled to the followingpensionsRules1963undertheWestPakistanCivilServicePension Rules,1963asamended&benefitsextendedfromtimetotime: (i) CompensationPension. (ii) InvalidPension. (iii) SuperannuationPension. (iv) RetiringPension. (v) FamilyPension. (vi) ExtraOrdinary/DisabilityPension. PARTV 21. (a) Wherearighttopreferanappealorapplyforreviewinrespectofanyorder

relatingtothetermsandconditionsofserviceisgrantedtoanemployeebyanyofthe rules,suchappealorapplicationshallbemadeexceptasmayotherwisebeprescribed undertherelevantrules,withinsixtydaysofthecommunicationtohimofsuchorder. (b) Where no provision for appeal or review exists in respect of any order

undertheseRules,anemployeeaggrievedbyanysuchordermaymakearepresentation againstittotheauthoritynextabovetheauthoritywhichmadetheorderwithinsixtydays ofthecommunicationtohimofsuchorder.

PARTVI 22. (a) Whenapostisrequiredtobefilled,theappointingauthorityshallnotifythe

post in the manner it decides, calling meeting of the concerned Selection/Promotion Committee. (b) Aftertakingactionreferredtoin(a)above,ifitisconsiderednecessary,in

theinterestoftheAuthority,theappointingauthoritymayfillupthepostonadhocbasisfor aperiodnotexceedingsixmonths,pendingnominationofacandidatebytheSelection Committee,whicheverisearlier. Providedthattheadhocappointmentshallnotconferanyrightonapersonthusappointed inthematterofregularappointmenttothesamepostnortheadhocserviceshallcount towardsseniorityinthegrade. 23. TheGovernmentmayinindividualcasesofhardshiporwheretheinterestofpublic

sorequiresandforreasonstoberecordedinwriting,relaxanyprovisionoftheserules. 24. Themattersnotcoveredbytheseruleswillbedecidedinaccordancewiththe

provisionsofrulesandRegulationsmeantforCivilServants/GovernmentDepartments. 25. Thecasespreviouslyfinalizedshallbedeemedtohavebeendecidedunderthese

RulesorundertheRules&RegulationsapplicableincaseofCivilServants/Government Departments.
