and ‘What’s Your Colortype?’ Quiz (Takes just about two minutes)

2. Post a pic of your fabulous new look and tell the world about it on your Twitter
Page. You can tweet however you wish, just mention your StyleType,
ColorType & include a photo.

Example:

I just took the See a New You Style Quiz and discovered I’m a ‘Chic Moon’.

3. Notify us with a DM or RT and we’ll enter you into the book giveaway contest,
and post your pic on our Twitter & Flickr pages.

Terms and Conditions – NO PURCHASE NECESSARY

1. NO PURCHASE NECESSARY to enter the “Life in Color” Twitter Book Giveaway


(“Giveaway”).

2. Acceptance of Giveaway Terms and Conditions. By entering the giveaway


you agree to be bound by these Terms and Conditions.

3. Method of entry. To enter the Giveaway, follow the directions for entry as
listed in the giveaway notification delivered at Twitter.com. All valid entries must
contain a photo submission. Photos may not include other people unless they have
permission from the person, and permission from a parent or legal guardian if other
person is a minor.

5. Post a picture of your fabulous new look and tell the world about it on
your Twitter Page. You can tweet however you wish, just mention your

6. Notify us with a Direct Message or Retweet and we’ll enter you into the
book giveaway contest, and post your picture on our Twitter and Flickr
pages.
4. Who can enter? The Giveaway is open to legal residents of the 50 United
States and the District of Columbia, age 18 or older at the time of entry who are
members of Twitter.com. You must provide a valid shipping address. Employees and
members of their immediate families and households of Bausch & Lomb
(“Sponsor”), its subsidiaries, affiliated companies, eye care practitioners and staff,
advertising and promotion agencies, electronic media firm, Brand Building
Communications (“Administrator”), and anyone involved in the production,
development or handling of this Sweepstakes are not eligible.

5. Prizes and approximate retail values (“ARV”): Fifteen (15) prizes – a copy
of the “Life in Color” book ($24.95 ARVeach). Total ARV of all prizes: $374.25. Odds
of winning depend upon the number of entries received.

6. Dates of giveaway: June 8, 2009 to June 22, 2009, there will be one (1) unique
giveaway held each day. The first Giveaway will be open beginning 12:00 p.m. (all
times are Eastern Time) on June 8, 2009, and the last giveaway ends at 9:00 p.m.
on June 22, 2009 (“Giveaway Period”). There will be one (1) prize given away each
day. Each day at 12:00 p.m., a call to action will be posted on Twitter
announcing that the twentieth (20th) person to enter the giveaway will win
the prize. Participants can submit only one entry per day.

7. Notification and response. Winners of each giveaway will be selected daily


starting on 06/08/09 by Administrator and will be notified via Twitter within twenty
four (24) hours. Each day, the twentieth (20th) person to submit an entry
will be selected as the winner. The winner must respond by sending a direct
message on Twitter within three (3) calendar days of the winner announcement and
provide a valid shipping address. If winner has not responded by that time, a new
winner will be selected. Limit of one prize per person.

8. Disqualification. We reserve the right to remove entries,which are believed to


be fraudulent or invalid. Disqualification may result from:

a. The failure of a potential winner to respond to Twitter notification within three


(3) calendar days after the announcement of winning the giveaway

c. The return of any communication or prize as undeliverable

d. Non-compliance with the directions for method of entry

e. Other non-compliance with the Terms and Conditions

9. Privacy. We respect your privacy and do not sell contact information to any
other company. Sponsor may use the winner’s name, prize information, and
state/country of residence for promotional purposes in any media without further
payment or consideration (except where prohibited).

10. Prize delivery. Please allow 2-3 weeks for your prize to arrive. If you haven’t
received your prize and it has been at least 14 business days since the winner was
announced, you can email bbcwom@brandbuildingnyc.com to let us know.

11. Lost or stolen prizes will not be replaced.

12. General Conditions. The following general conditions apply to our giveaways:

a. Void Where Prohibited. The giveaway is void where prohibited, taxed,


regulated, or where registration is required. All federal, state, and local laws and
regulations apply. We reserve the right to disqualify any participant (for present and
future entries) thought to be attempting to disrupt the giveaway.
b. Cancellation. We reserve the right to cancel, suspend or modify the
giveaway if fraud, virus or other technical problems or any other factors beyond our
control in any way interfere or corrupt the administration of the giveaway.

c. Prohibition of Automated Entries. Any use of automated or programmed


methods of effecting entries online is prohibited.

d. Viruses. We are not responsible for communications errors, viruses, worms,


or other contaminants that may affect or damage your computer system or data
while participating in the giveaway.

e. Release. Except where prohibited, by making an entry, participant releases


and holds harmless Twitter, Inc., Bausch & Lomb, Inc., Visual Therapy (VT-Luxe
Corporation), Chronicle Books, LLC, Brand Building Communications, LLC, any
parent company or subsidiaries, affiliates, and their shareholders, directors, officers,
employees and agents and the judges (the "Released Parties") from and against any
claim or cause of action arising out of participation in the giveaway, human or
technical errors, or receipt or use of any prize. In no event will the Twitter, Inc.,
Bausch & Lomb, Inc., Visual Therapy (VT-Luxe Corporation), Chronicle Books, LLC,
Brand Building Communications, LLC, any parent company or subsidiaries, affiliates,
and their shareholders, directors, officers, employees, representatives or agents, be
responsible or liable for any damages or losses of any kind, including direct,
indirect, incidental, consequential or punitive damages arising out of the giveaway.

f. Disclaimer of Sponsor Responsibility. Except where prohibited, by


making an entry, participant agrees that the Released Parties are not responsible
for: (a) any incorrect or inaccurate information, whether caused by the participant
or printing errors; (b) unauthorized human intervention in any part of the giveaway;
(c) technical or human error which may occur in the administration of the Giveaway
or the processing of Entries; or (d) any injury or damage to persons or property
which may be caused, directly or indirectly, in whole or in part, from the
participant’s participation in the giveaway or receipt, use or misuse of any prize.

g. Legal. Except where prohibited, by making an entry, participant agrees


that: (a) any and all disputes, claims and causes of action arising out of or
connected with the giveaway or any prize awarded, other than the administration of
the giveaway or the determination of winners, shall be resolved individually and
exclusively by the appropriate state or federal court located in Rochester, New York,
USA; (b) any and all claims, judgments and awards shall not include out-of-pocket
costs incurred, travel expenses, or attorneys’ fees; and (c) under no circumstances
will participant be permitted to obtain awards for, and participant hereby waives all
rights to claim, punitive, incidental and consequential damages and any other
damages, and any and all rights to have damages multiplied or otherwise increased.
All issues and questions concerning the construction, validity, interpretation and
enforceability of these Terms and Conditions, or the rights and obligations of
participant and sponsor in connection with the giveaway, shall be governed solely
by, and construed exclusively in accordance with, the laws of the USA, without
giving effect to any choice of law or conflict of law rules (whether of the USA or any
other jurisdiction), which would cause the application of the laws of any jurisdiction
other than the USA.

h. Except where prohibited, by submitting an entry, you hereby waive all rights
to royalties, exclusive or non-exclusive rights, titles, and interests, including but not
limited to exclusive copyright ownership of each entry.

By making an entry, you give us a right to republish your photograph on Twitter


and/or Flickr (Yahoo!, Inc.). If for any reason you wish your picture to be removed
from either of the sites, you can send us a request for removal of the photo. The
request should be emailed at: bbcwom@brandbuildingnyc.com. Twitter and Flickr
are not associated with the sponsorship or administration of this Giveaway.
