(tanod members) during their night duties. We bought the mountain bikes last November but these were stolen inside our barangay hall on December 16 last year, Sevilla. According to him, he proposed for the barangay to buy the CCTV during their barangay assembly which immediately generated positive response from the barangay residents. e CCTV really helps in our campaign against criminality not only here in our village but even those from other barangays because Luntad has become a sort of a short cut in going to other points in Palo, Sevilla said.(JOEY A. PALO, Leyte Trading price of commercial rice has signi cantly increased in the region but the government sad the situation is still normal this o -harvest months. Records from the National Food Authority (NFA) show that prevailing price of well milled rice rose to P40.33 per kilogram as of August 31, up than the P37.48 price in July and P35.60 in June this year. NFA regional information o cer Mary Agnes Militante said theres nothing to worry about since July to September is considered lean months, hence, there are less rice stocks in commercial warehouses. Militante said average retail price of well-milled rice has been consistently increasing in the past three months. Regular milled rice is cheaper at P36.83 per kilogram based on NFA regular price monitoring report but it has been increasing from P32.33 recorded in June. Stocks of rice in NFA warehouses is substantial but our sales is still calibrated since the price of regular milled rice is still below the P40 per kilogram, Militante said. As of August 31, there are 390,962 bags of NFA rice. It will last for 68 days based on the 5,721 average daily sales. NFA sales rice at P27 per kilogram. But for Ma. Eliza Pita, a rice retailer in a public market in Tanauan, Leyte, recent price adjustments is

In June we can store up to 100 bags of rice but now traders would only allow us to procure 20 to 30 bags in every purchase, Pita said adding that an average buying price per sack is already P2,100 from only P1,200 to P1,500 early this year. Pita believed traders are hoarding staple food to create a scenario of arti cial shortage but NFA denied theres such practice since they have been regularly inspecting commercial rice warehouses. Prevailing prices in Tanauan public market of both regular milled and well milled rice ranged from P39 to P50 per kilogram. e impact recent of staple food price increase is more severe among poor families, where cost of buying rice eats up to 50% of their daily income. Joven Caonas, a 28-yearold pedicab driver from Barangay Baras of this town said that between May and June, price was still normal at P32 to P35 per kilogram. he very conventional notion is that money is the root of all evil. That may be true but taking a very hard look at it, it is the implement by which money is earned and generated that ought to be blamed for the greed that is bred in the hearts of the likes of Napoles. It is taxation that is the real culprit but money seems to be taking all the blame. Taxation, to be sure, is a power that belongs to a state. Like the police power and the power of eminent domain, taxation is inherent in every state, i.e. the power exists by the fact alone that a state exists. Hence, the power need not be expressly conferred to a state in its laws, not even the most fundamental. Whether or not there is express conferment of that power, a state may exercise the power of taxation. The principle behind the power is that it has the end of exacting contributions from a states citizens to be used for the betterment
of the state itself. For a particular exercise of that power to be valid, it need not be shown that those who contribute, technically termed as taxpayers, will actually receive something tangible in return from the government to whom the contribution is made. It is enough that they are bound to benet from any improvement in the services that the government offers brought about by their contributions. From all these hullabaloos on the pork barrel and how money paid out by the people as taxes have been dissipated for the benet of an undeserved few, it is not too ironic to realize that the power of taxation has sometime ago been referred to as the power to destroy. But the reason before for such unfair nomenclature has never been made clearer and more elaborate until the recent mishap on the pork barrel. It has indeed destroyed us a thousand and one ways.

This last discovery, however, will not yet conclude with the incarceration of Janet Lim Napoles whose being in detention has a remote, but indirect, relation to the piles of scam, for the scam remains to lead to other cans of worms in which JLN is seen by many as the lock and key to their final opening. That being the case, the govern-
ment must do everything to keep her alive and unharmed. There is no special treatment accorded to JLN, as some prefer to imagine. The nation must understand, JLN is herself the evidence and proof. From her, all other events leading to the scam and the resultant plunders of government funds will come out with final clarity. From her, all other personalities who profited from the scam

just encourage, legitimate volunteer complainants. It is not enough that only the lot of whistleblowers be attended to. There are many more among the Filipino citizens who have personal knowledge about those instances of corruption or events leading to corruption. The tuwid na daan can have more teeth, to be effective, efficacious and effectual, if it looks beyond just extending security or protection to the lives of whistleblowers and volunteer complainants as well as their immediate families. Further to that beyond, tuwid na daan must now also look forward to their future in the next five to six years. This period of time can mean that indeed the government is bent on institutionalizing its anti-corruption and freecorruption-Philippines campaigns. As of date, that is much absent, hence, many are still reluctant. Corruption begets deaths (not just one death) to preserve itself. Short of plunder case recitals, the crime of malversation (whether technically, or by direct action, or by indirect participation, including assumed negligence) may come earlier. Article 217 of the Revised Penal Code (Codigo Penal, as it was known since the Spanish regime in the Philippines) may provide they key to that. Article 217, as amended by Republic Act No. 1060 (approved on June 12, 1954), is found in Chapter Four - MALVERSATION OF PUBLIC FUNDS OR PROPERTY of the Revised Penal Code. It provides as follows: Article 217. Malversation of public funds or property; Presumption of malversation. - Any public officer who, by reason of the duties of his office, is accountable for public funds or property, shall appropriate the same or shall take or misappropriate or shall consent, through abandonment or negligence, shall permit any other person to take such public funds, or property, wholly or partially, or shall otherwise be guilty of the misappropriation or malversation of such funds or property, shall suffer: 1. The penalty of prision correccional in its medium and maximum periods, if the amount involved in the misappropriation or malversation does not exceed two hundred pesos. 2. The penalty of prision mayor in its minimum and medium periods, if the amount involved is more than two hundred pesos but does not exceed six thousand pesos. 3. Had they not made her do so, she would not be able to access to the taxpayers hard-earned money, try as she would. But they did, in exchange for a share of PDAF, which they could not just pocket directly as the funds have to be invested in projects that could benefit the people. The real culprits then are those corrupt lawmakers who, out of greediness, had partnered with her, knowing that it is she who could make their anomalous dreams come true. They just used Napoles, in a way the victim, and rained her with money that, in the process, will return to them, albeit sliced already of the part that belonged to her. The more greedy lawmakers flocked to her, the bigger money she got, and that explains her unthinkable hoard of wealth. On her part, Napoles was merely a recipient of what corrupt lawmakers were willing to give away if only to get the portion that they wanted. They came to her, in increasing number, having learned that, by in-
Everyone looks at her now as the most despicable person in the country. People hate her much that, given a chance, they would perhaps crush her into pieces. The least that they are itching to do with her is to punch her on the nose, pull her hair, or kick her in the belly. Thats how Janet Lim Napoles is presently regarded. But while most people single her out as the prime culprit in the alleged 10-billion-peso pork barrel scam, she could also be a victim for being the perfect person for the job. Yes, the problem with her is that, she possessed all the necessary qualifications that the real culprits were looking forshrewd, greedy, genius in cheating, business minded and, most of all, quick to return percentage
commissions from allotted pork barrel funds. Having had numerous lawmaker-investors in her bogus NGOs, however, she ended up the riches of them all. Those who thought they were smart enough to be able to use her turned out to be the outsmarted. That made Napoles the most wanted of allshe got the lions share of the pork. Imagine her having bank accounts totaling more than four hundred; and its just in the Philippines. Outside, in the United States in particular, she also has bank accounts. And who knows where else did she deposit her overflowing riches! We could not really blame her singlehandedly for having siphoned the peoples money into her bank accounts. Some people allowed her to do it.

MAASIN CITY A Maasinhon musical artist and song composer Cezka Mariz, now based in Brisbane, Australia, was discovered by American record producer Andrew Lane and was invited to record an album in America. Cezka Mariz Lapurga, 19, will soon make all Filipinos proud with an international career. Lane is the songwriter- producer of international artists like Irene Cara and Backstreet Boys. Lane is also the coproducer of Disney movies High School Musical, Disneymania, Hannah Montana, among others. Cezka and her parents are expected to leave for the United States this week to discuss her international music career. In our skype conversation, Lane told us that he loves the kind of music Cezka is into, said Edgar, the proud father of the budding singer.
