SHE PAID FOR DEFENDANT
Petitioner, MARY BARKER, fled a motion on March 5, 2012 in the above-captioned
case of her son, Defendant Zachary Barker Coughlin, seeking a refnd of One Hundred and
Three Dollars ($103.00) she paid as part of his penalty for Criminal Contempt of Cou. The
cou held the defendant in contempt of cou for actions he took in the direct and immediate
presence of the cout during the trial of his traffc citation on Februay 27, 2012 in the above-
entitled matter. (See Order Finding Defendant in Contempt of Court ad Imposing Sanctions,
fled February 27,2012).
The defendant was ordered taen into custody to spend fve (5) days in jail. He asked
the court to permit him to pay a fine instead, saying he had law clients and cou matters to
attend to, ad the cou granted that request and said the contempt would be punished by
either fve days jail, beginning immediately, or payment of $ 500 fne immediately . .
The court's records indicate that the defendant attempted to post the $500 on a credit

cad but the compay refsed his card, therefore, he was tasported to the Regional
Detention Facility at 911 PaBoulevad to serve his 5-day sentence. Afer he had served
four (4) days in j ail, May Baker contacted the court clerk to see if she could pay One
Hundred Dollas ( $100. 00) on the defendant's behalf, as a fne, in lieu of his ff day in
incaceration on his contempt sentence. The court clerk inquired of this court ad the cour
approved that. Thereafer, Ms. Barker made te arrangements and paid the $100 toward the
fne, including a $3. 00 charge to pay by credit card. The jail was notifed that the defendat
could be released on this case, and was, in fact released on this case.
Jail records frther indicate that the defendant had been involved in a sepaate case in
Reno Justice Court prior to his traffc trial in this court. I the RJC matter, he appaently
posted a bond through Action Bail Bonds ad had been released fom custody. The records
show that the bonding company surrendered the bond. Therefore, immediately upon his
release in this case, Zachary Coughlin was re-booked and taken back into custody on the RJC
case. Any additional time he spen in custody, therefore, was on the RJC case, ad not the
tafc case in this court.
Therefore, the court fnds that the defendat satisfed his contempt sentence by serving
four ( 4 ) days in jail and his mother's payment of $100 i lieu of his ffh day of incarceration.
Petitioner is not entitled to a refnd.
The motion is DENIED.
