INSTRUCTION TO CONTRACTOR

The contractor submitting the tender should read the schedule of quantities, additional conditions, additional specifications, particular specifications and other terms and conditions given in the NIT and drawing. The tenderer should also read the General Conditions of Contract for CPWD Works 2010 with upto date correction slips, which is available as Government of India Publications; however provisions included in the tender document shall prevail over the provisions contained in the standard form. The set of drawings and NIT shall be available with the Assistant Engineer (E), PWD Electrical Maintenance Division M-1511, DDUH, Hari Nagar, and New Delhi. The contractor should also visit the site of work and acquaint himself with the site conditions before tendering. The following conditions, which already form part of the tender conditions, are specially brought to his notice for compliance while filling the tender. They are requested to comply following instructions. Tenders with any condition including that of conditional rebates shall be rejected forthwith. The successful tenderer shall be required to submit a performance guarantee of 5% (Five percent) of the agreement amount within 15 days of issue of letter of acceptance. This period can be further extended by Engineer-in-Charge upto a maximum period of 7 days on the written request of the contractor. VAT / Sales Tax, Excise Duty, Work Contract Tax etc. as applicable shall be borne by the contractor himself. The contractor shall quote his rated considering all such taxes. However, the service tax will be reimbursing to the firm after submission of proof of deposit the same to the concerned department.

1.1 1.1.1 The work is estimated to Cost Rs. 251832/-. This estimate, however, is given merely as a rough guide. The authority competent to approve NIT for the combined cost and belonging to the major discipline will consolidate NITs for calling the tenders. He will also nominate Division, which will deal with all matters relating to the invitation of tenders.
Tenders can be available for downloading by the Manufacturer and Authorized dealers/ agencies of ION Exchange/CWC/Hydratec/Alphatec , provided they produce definite proof from the appropriate authority, which shall be to the satisfaction of the competent authority, of having satisfactorily completed similar works of magnitude specified.

The tenderer shall submit the offer with following documents : (i) Scanned copy of Earnest Money. However, Earnest Money in original is to be submitted in the office of Assistant Engineer (E), PWD EMD M-1511, DDUH, Hari Nagar New Delhi before the time and date of closing of the bid as mentioned in the para 5 below. (ii) Scanned copy of proof of having submitted the latest DVAT/CST returns etc. However attested copies to be submitted in the office of Assistant Engineer (E), PWD EMD M-1511, DDUH, Hari Nagar before the time and date of closing of the bid. (iii) Scanned copy of Authorization certificate duly attested, issued by the Manufacturer / Authorized Agencies before the time and date of closing of the bid.

Agreement shall be drawn with the successful tenderer on prescribed Form No. CPWD 8, which is available as a Govt. of India Publication. Tenderer shall quote his rates as per various terms and conditions of the said form, which will form part of the agreement. A tenderer shall be deemed to have full knowledge of the site whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and maintaining at his own cost all materials tools & plants, water, electricity, access facilities for workers and all other services required for executing the work unless otherwise specifically provided for in the contract documents. Submission of tender by a tenderer implies that he has read this notice and all other contract documents and has made himself aware of the scope and specifications of the work to be done and of conditions and rates at which stores, tools and plant etc. will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work. The competent authority on behalf of the President of India does not bind himself to accept the lowest or any other tender, and reserves to himself the authority to reject any or all of the tenders received without the assignment of any reason. All tenders, in which any of the prescribed conditions is not fulfilled or any condition including that of conditional rebate is put forth by the tenderer, shall be summarily rejected. The public enterprises who avails benefits of the purchase preference should be subjected to adequate penalties for cost overruns etc. Canvassing whether directly or indirectly, in connection with tenders is strictly prohibited and the tenders submitted by the contractors who resort to canvassing will be liable to rejection. The competent authority on behalf of the President of India reserves to himself the right to accepting the whole or any part of the tender and the tenderer shall be bound to perform the same at the rate quoted. The contractor shall not be permitted to tender for works in the CPWD Circle (responsible for award and execution of contracts) in which his near relative is posted as Divisional Accountant or as an officer in any capacity between the grades of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the names of persons who are working with him in any capacity or are subsequently employed by him and who are near relatives to any Gazetted officer in the Central Public Works Department or in the Ministry of Urban Development. Any breach of this condition by the contractor would render him liable to be removed from the approved list of contractors of this Department. No Engineer of gazetted rank or other Gazetted Officer employed in Engineering or Administrative duties in an Engineering Department of the Government of India is allowed to work as a contractor for a period of two years after his retirement from Govt. Service without pervious permission of the Govt. of India in writing. This contract is liable to be cancelled if either the contractor or any of his employees is found any time to be such a person who had not obtained the permission of the Govt. of India as aforesaid before submission of the tender or engagement in the contractors service. The tender for the work shall remain open for acceptance for a period of Ninety (90) days from the date of opening of tenders. If any tenderer withdraws his tender before the said period or issue of letter of acceptance, whichever is earlier or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Govt. shall without prejudice to any other right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. The Notice Inviting Tender shall form a part of the contract document. The successful Tenderer / Contractor, on acceptance of his tender by the Accepting Authority, shall within 15 days from the stipulated date of start of the work sign the contract consisting of: The Notice Inviting Tender, all the documents including additional conditions, specifications and drawings, if any, forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto. I/We have read and examined the notice inviting tender, schedule, A, B, C, D, E & F. SPECIFICATIONS AND SPECIAL CONDITIONS 1. All the materials, whatsoever, to be supplied and provided by the contractor should be of standard and approved quality. These should be got approved from the Engineer-in-Charge of his authorized representative before installation. No payment will be made for any unapproved or sub standard/ rejected materials used on the work. Rejected materials should be removed from the site of work within 48 hours failing which the same will be liable for removal by the department at the risk and cost of contractor without any liability. The electric work shall be done in closed co-ordination and in phase, strictly with civil works where ever these are in control of this office no claim for idle labour shall be entertained under this agreement. Any damage done to the building while executing the electric work should be make good to the satisfaction of the department. The chases, holds etc. cut in the walls and roofs should be filled within two days. All malba should be removed on the same day. In case of failure to do so it will be got done by the Engineer-in-Charge or his authorized representative at contractors risk and cost. All watch and ward of the materials installed at work will be responsibility of the contractors till their handling over to the department on completion of work. Merely recording of measurement and running payments made to contractor. There will be regular handing over/ taking over the installation. Any missing item shall have to be make good by the contractor. While quoting the rates, the contractor should clearly mentioned makes of the switchgears and fittings included in the tender. Supply items to be got checked for E-in-C in Advance, otherwise payment shall not be released. If any conditions is put by the contractor, which is not as per CPWD specifications/ terms and conditions of NIT, his tender is liable to be rejected. Contractor will have to abide by the instructions contained in CPWD Manual Volume-II (upto date) applicable to him. Malba shall be removed from the site daily and site kept neat and clean failing which the same is liable to be go removed by the department at the risk and cost of contractor. Nothing extra shall be payable on account of idle labour. The shut down of electrical supply shall be given strictly according to the consent of Engineer in charge. Output of Water quality as per BTS Standard. T.D.S of Treated water shall be less than 150 TDS. The firm shall be give One year guarantee of the plant of all accessories and any complaint shall be attend by the Contractor. All major or minor part shall be replaced free of cost. Company shall give quality report of Treated for free of one year. Make of the RO System is ION Exchange/CWC/Hydratech/Alphatech
