Enclosed is a Short Form Compliance Order with Administrative Penalty ("Compliance Order") issued to
Enka Partners of Asheville, LLC for certain violations of the North Carolina Solid Waste Management Act,
N.C.G.S. Chapter 130A, Article 9 (the "Act"), and the North Carolina Hazardous Waste Management
Rules, 15A NCAC 13A (the "Rules"). The Compliance Order describes the violations at your facility.
As a result of the violations of the Act and the Rules, pursuant to N.C.G.S. 130A-22(a), an administrative
penalty of $5,000.00 is imposed in the Compliance Order. Enka Partners of Asheville, LLC may contest
this Compliance Order by filing a written petition for a contested case hearing in accordance with N.C.G.S.
150B-23(a) and 1508-23.2. See the section entitled "Notice of Rights to a Contested Case" in the attached
Compliance Order. In addition, Enka Partners of Asheville, LLC is assessed $2,126.37 for
investigative and inspection cost associated with the assessment of the civil penalty pursuant to
N.C.G.S. 130A-22U). These investigation and inspection cost assessments are due within 60 days
and are not contestable in the "Notice of Rights to a Contested Case" provision. Enka Partners of
Asheville, LLC is required to pay $1,680.00 for operating as a storage facility for state fiscal year 2010-2011.
Please be advised that the Department of Environment and Natural Resources has implemented a
department-wide policy to release all penalties assessed against facilities to the media. Therefore, the
name of your company and the penalty amount that has been assessed against the facility may be
released to the media.
If no contested case petition is filed, the administrative penalty must be paid by Enka Partners of
Asheville, LLC within 60 days of receipt of the Compliance Order by certified check or money
order, payable to the Division of Waste Management, and mailed to:

PRELIMINARY STATEMENT
This Compliance Order with Administrative Penalty ("Compliance Order") is issued by the North
Carolina Department of Environment and Natural Resources, Division of Waste Management
under the North Carolina Solid Waste Management Act, N.C.G.S. Chapter 130A, Article 9 (the
"Act"), and the North Carolina Hazardous Waste Management Rules, 15A NCAC 13A (the
"Rules"). Based upon information received by the Division of Waste Management, the Division
of Waste Management has determined that Enka Partners of Asheville, LLC violated certain
requirements of the Act and Rules as set forth in this Compliance Order.
STATEMENT OF FACTS AND LAW
1. The North Carolina Department of Environment and Natural Resources ("the
Department") is required to enforce the Act and the Rules, which govern the
management of hazardous waste. This authority, including the authority to assess and
recover administrative penalties in accordance with N.C. G.S. 130A-22, has been
delegated to the Director of the Division of Waste Management ("the Division"). The
Director has issued a sub-delegation of this authority, including the authority to assess
and recover administrative penalties for violations of the Act and Rules, to the Chief of
the Hazardous Waste Section, Elizabeth W. Cannon.
2. The United States Environmental Protection Agency has authorized North Carolina to
operate the State Hazardous Waste Program in accordance with the Act and the Rules, in
lieu of the federal Resource Conservation and Recovery Act ("RCRA") program.
3. Enka Partners of Asheville, LLC site is located at 31 Sand Hill Road, Enka, Buncombe
County, North Carolina.
4. On March 9, 2010, Roberta Proctor, Western Environmental Chemist, with the Division
was contacted by Chris Singleton of Singleton Environmental about treatment and the
removal of approximately 500,000 gallons of liquid from four (4) tanks suspected of
holding high pH liquids.
5. On March 10, 2010, Spring Allen, Environmental Senior Specialist and Brent Burch
Western Compliance Supervisor, both with the Division, conducted a Focus Compliance

Inspection-Complaint (FCI-CMP) at Enka Partners of Asheville, LLC site to evaluate
compliance with the North Carolina Hazardous Waste Management Rules. Tracy Wahl a
Brownfield's project manager with the Division was also present during the inspection.
6. While inspecting the Enka Partners of Asheville, LLC site four (4) areas of concern were
reviewed. The first area of concern was a tank area where four (4) 150,000 gallon tanks
were found. The second area of concern was a waste pile that was created from solids
removed from a dismantled tank that was place on a concrete floor and covered with
plastic. The third area of concern was where standing water may have been impacted
from runoff of the waste pile. The fourth area of concern was the Flammable Solvents
Building.
7. On March 11, 2010, Spring Allen, Environmental Senior Specialist and Roberta Proctor,
Western Environmental Chemist, both with the Division conducted an investigation to
further assess the four (4) areas of concern.
8. On March 24, 2010, an Immediate Action Notice of Violation was issued to Enka Partners
of Asheville, LLC for failing to determine if waste was hazardous waste and failed to
comply with section 15A NCAC 13A .0109.
9. Enka Partners of Asheville, LLC generated hazardous waste as defined in N.C.G.S.
130A-290(a)(8) and 15A NCAC 13A .0106. The hazardous waste generated by Enka
Partners of Asheville, LLC is identified by EPA Hazardous Waste Identification Numbers
D002 and D008.
10. Enka Partners of Asheville, LLC is not currently listed with the Division as a generator of
hazardous waste.
11. As a result of the March 10, 2010 FCI-CMP, the Division has determined that Enka
Partners of Asheville, LLC violated the following Rules:
a. 40 CFR 262.11:
i. Pursuant to 40 CFR 262.11, adopted by reference at 15A NCAC 13A
.01 07(a), a person who generates a solid waste, as defined in 40 CFR
261.2, must determine if that waste is a hazardous waste using the method
described in Section 262.11.
ii. Enka Partners of Asheville, LLC violated 40 CFR 262.11, in that it failed to
conduct a proper waste determination on 51,160 lbs. of D008 hazardous
waste and 3,011 gallons of D002/D008 hazardous waste. Also found on
site and determined to be non-hazardous was 304.19 tons from the
stockpile area and 200,449 gallons and 27.81 tons from Tank 2 and 3.
b. 40 CFR 270.1 O(a):
i. Pursuant to 40 CFR 270.1 O(a), adopted by reference at 15A NCAC 13A
.0113(b), any person who is required to have a permit shall complete,

sign and submit an application to the Hazardous Waste Section which
meets the requirements of 270.10 and 270.70 through 270.73. 40 CFR
270.1(c), adopted by reference in 15A NCAC 13A .0113(a), provides, in
pertinent part, that "RCRA requires a permit for the 'treatment,' 'storage,'
and 'disposal' of any 'hazardous waste' as identified or listed in 40 CFR
part 261."
ii. Enka Partners of Asheville, LLC violated 40 CFR 270.10(a), in that it was
required to have a RCRA permit to store hazardous waste containers in
its hazardous waste storage areas, and failed to complete and submit an
application for a RCRA permit to the Hazardous Waste Section as
described in Section 270.10 and Sections 270.70 through 270.73,
adopted by reference at 15A NCAC 13A. 0113(b) and U).
c. 15A NCAC 13A .01 09(a):
i. Pursuant to 15A NCAC 13A .01 09(a), any person who treats, stores or
disposes of hazardous waste shall comply with the requirements set forth
in this Section. The treatment, storage or disposal of hazardous waste is
prohibited except as provided in this Section.
ii. Enka Partners of Asheville, LLC violated 15A NCAC 13A .0109(a), in that
seven thousand eight hundred fifty (7,850) pounds of hazardous waste
was stored without complying with the requirements of 15A NCAC 13A
.01 09. At the time of the November 9, 2009 CEI hazardous waste had
been accumulated longer than the 90 days allowed under 40 CFR
262.34(f), adopted by reference at 15A NCAC 13A .0107(c).
ADMINISTRATIVE PENALTY
N.C.G.S. 130A-22(a) authorizes an administrative penalty of up to $32,500.00 per day for each
violation of the hazardous waste provisions of the Act, Rules or any order issued pursuant to the
hazardous waste provisions of the Act. N.C.G.S. 130A-22(d) sets forth the factors to be
considered in determining the administrative penalty which include the degree and extent of the
harm caused by the violation and the cost of rectifying the damage.
15A NCAC 138 .0702 sets forth specific criteria to be considered in addressing the statutory
assessment factors which include the type of violation, type of waste involved, duration of the
violation, cause of the violation, potential effect on public health and the environment,
effectiveness of response measures taken by the violator, damage to private property and the
history of non-compliance.
After careful consideration of each factor above, penalties are assessed as follows against Enka
Partners of Asheville, LLC, for the violations set out in this Compliance Order: for the violation set
forth in paragraph 11. a. $2,500.00 and for the violations set forth in paragraph 11. b. and c.,

$2,500.00. Accordingly, a total penalty is imposed in the amount of $5,000.00.
CONDITIONS FOR CONTINUED OPERATION
Based upon the foregoing, Enka Partners of Asheville, LLC is hereby ordered to take the following
actions:
1. Within sixty (60) days submit the amount of the administrative penalty, by certified check
or money order, and payable to the Division of Waste Management. The payment should
be mailed to:

2. Enka Partners of Asheville, LLC shall immediately correct all violations as stated in this
Compliance Order.
3. Within sixty (60) days submit $2,126.37 for investigative and inspection cost associated
with the assessment of the civil penalty by certified check or money order, and payable to
the Division of Waste Management. The payment should be mailed to:

4. In addition to the above, Enka Partners of Asheville, LLC is subject to the provisions of GS
130A-294.1 (k) which requires that a person who operates as a storage, treatment or
disposal facility shall pay an annual activity fee of one thousand six hundred eighty dollars
($1 ,680.00) for each activity. Enka Partners of Asheville, LLC is required to pay $1,680.00
for operating as a storage facility for state fiscal year 2010-2011. This fee must be paid
within sixty (60) days of receipt of this Compliance Order (an invoice is attached).
POTENTIAL CONSEQUENCES OF FAILURE TO COMPLY
Enka Partners of Asheville, LLC is hereby advised that, pursuant to N.C.G.S. 130A-22, each
day of continued violation of any requirement of the Act or the Rules constitutes a separate
violation for which an additional penalty of up to $32,500.00 per day may be imposed. If the
violation continues Enka Partners of Asheville, LLC may also be subject to further enforcement,
including injunctive action, to prohibit any further generation of hazardous waste and such
further relief as may be necessary to achieve compliance with the Act and Rules.

NOTICE OF RIGHT TO FILE A CONTESTED CASE PETITION
Enka Partners of Asheville, LLC has the right to file a contested case petition regarding a matter
of law, material fact, requirement, or the penalty set forth in this Compliance Order as allowed
by N.C.G.S. 1508-23. Any petition for a contested case hearing must be filed with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714, along with the
appropriate filing fee set by the Office of Administrative Hearings in accordance with N.C.G.S.
1508-23.2, within 30 days of receipt of the Compliance Order. A copy of the petition for a
contested case hearing must also be served on the Division by sending a copy of the petition

If a petition for contested case is not timely filed with the Office of Administrative Hearings and
served on the Department, payment of the administrative penalty becomes due within 60 days
after receipt of the Compliance Order. If a contested case petition is timely filed and served,
payment of the administrative penalty is due within 60 days of receipt of a written copy of the
final agency decision. If payment is not received as required, the Secretary of the Department
of Environment and Natural Resources shall request the Attorney General to commence a civil
action in Superior Court to recover the amount of the administrative penalty .

Human Health Effect: lead is extremely toxic; it affects the central nervous
system at very low levels, causing neurobehavioral deficits in children. It also
causes developmental delays, impaired hearing acuity and effects on the
blood and reproductive system. Corrosive materials are capable of burning
human tissue on contact. Human health effect can include eyes, skin,
Gastrointestinal and Respiratory System. Inhalation of high concentrations
of these chemicals may cause coughing, pain, inflammation, and edema of
the upper respiratory tract;
Effect on the Environment: corrosive materials if spilled into the environment
may severely damage vegetation and may be lethal to fish and other aquatic
organisms;
