his lawyer would like the Commission to interview SK.

SK was a State Department security officer in the Philippines in 1994 when he received
telephone warnings of a plot to kill President Clinton. He and his lawyer attempt to
connect these warnings with Ramzi Yousef and the Bojinka plot, and his lawyer suggests
that the information received by SK was not taken seriously enough.

SK is apparently being investigated by the State Dept. IG over a fatal shooting in


Ecaudor, and this may account for some of his motivation in contacting us.

After talking to Doug, Chris, Steve, and Lorrry, I wrote the attached letter thanking SK's

Lorry sees no benefit to Team 2 in investigating the alleged intelligence failure. Doug
and I would be willing to interview him for an hour just so he could have his say, but the

It was good to see you last evening.

I would like to follow-up briefly, in the event that my synopsis may be of some service to your critical
mission on the 9-1 1 commission.

Special Agent Samuel Peter Karmilowicz, my client, served the State Department at various posts
including Manila.

It was the intelligence that Agent Karmilowicz obtained in 1994 that may have saved the President of
the United States from planned assassination attempts by Muslim terrorists.

On August 26, 1998, the Department of Justice indicted Osama bin Laden on various charges; reliable
sources at the time confirmed a 1994 plot to assassinate President Clinton in Manila in the Philippines;
according to US Justice Department sources, the Manila plot failed because beefed-up security kept the
would-be assassins from getting close enough to Clinton's motorcade on November 2, 1994.

The source of the information that Sam received was an unidentified caller with a distinct middle eastern
accent. He told Agent Karmilowicz in September 1994 that "a terrorist team of three Iranians and three
Iraqis had been training in Pakistan for one month for the purpose of assassinating US President Clinton
during the President's visit to the Philippines [in November 1994]... [and] the operation was being
financed by an individual known as Tareq Javed Rana." I can supply you with an unclassified copy of this
reported threat

Commissioner Ben-Veniste was approached by the lawyer for a former State Department Security Officer named
Sam Karmilowicz (SK) a couple of months ago, and the Commissioner mentioned it to me today. SK would like to
be interviewed by us in connection with an alleged plot to assassinate President Clinton in the Philippines in
1994. SK had also approached Team 1 directly last November, and we had tentatively decided to interview him
for an hour, subject to front office approval.

SK was a State Department security officer in the Philippines in 1994 when he received telephone warnings of a
plot to kill President Clinton. It's not clear that the tip he received has anything to do with Ramzi Yousef and the
Bojinka plot, but he attempts to make the connection and we feel it would not hurt to interview him for an hour. I
should note that SK is apparently being investigated by the State Dept. IG over a fatal shooting in Ecuador, and
this may account for some of his motivation in contacting us.

Agent Karmilowicz thereafter established monitoring equipment that did collect information before, during
and after President Clinton's visit to Manila.

As for the source of information connecting bin Laden to this attempt, Ramzi Yousef, the convicted leader
of the February 1993 World Trade Center bombing that killed six people and injured about 1000, and Wali
Khan Amin Shah, a top aide to bin Laden, confirmed before the federal grand jury, according to reliable
Justice Department sources, that bin Laden had in fact ordered President Clinton's assassination.

Agent Karmilowicz believed that the information received in 1994 was reliable, and, as indicated,
established a monitoring system that, it is believed, provided much useful intelligence.

By contrast, the CIA and the Secret Service, on or about September 20, 1994, in the weeks before the
President's trip, met with Agent Karmilowicz and denigrated the credibility of the informant who prompted
Agent Karmilowicz to act in defense of the President; they told Agent Karmilowicz that his undisclosed
informant was just trying to discredit an ordinary and well regarded businessman so that the Philippine
Police would harass him.

In truth and fact, this "ordinary businessman" was Pakistan businessman Tariq Javed Rana, and it has since
been established that Rana was an intimate of Ramzi Yousef, the self-confessed mastermind of the World
Trade Center bombing in 1993, the first terrorist effort to topple the Twin Towers; Rana was indicted in
Manila on or about April 3, 1995 for large scale investment fraud; allegedly found in Rana's apartment by
the Philippine police were chemical residues associated with making explosives.

You asked how this information might be relevant to the 9-11 commission. In truth and fact, I cannot
presume to appreciate the full scope of your mission but it strikes me as relevant that intelligence was
obtained relevant to the 1993 bombing, and to an assassination attempt of President Clinton that was
discounted at the time, though later confirmed in a subsequent grand jury investigation. Obviously, a lead
may not lead to information. Equally obvious, a lead that is not followed will most certainly yield nothing.

Plainly some of the information, despite conversations had with Agent Karmilowicz, seemingly
intended to denigrate the information, were passed on to the President's security detail, and taken seriously,
but other elements of our intelligence network were, shall we say, more blase.

S We obtained an affidavit from Agent Karmilowicz of what State Department


personnel told him about the control of the investigation and apparent efforts to
withhold exculpatory information from him, most especially the investigative
order from State in the US that this Quito investigator, Dana. Alva, should destroy
the notes of interview had with Mi. Gonzalez.
S Finally, we asked a retired DEA agent, Michael S. Gray, who served as a
supervisor from 1979 until 1996, who reviewed thousands of investigative
reports, to review this ROI and to critique its apparent shortcomings.

DISCUSSION
I. Agent Karmilowicz - a profile of service to State and to the nation.

Agent Karmilowicz has served this nation with distinction on State Department
security details assigned to the former Secretary of State and as a Security Officer for the
Embassies in Manila, Beirut, and Quito; indeed, while Agent Karmilowicz was assigned
to Manila, the intelligence he obtained in 1994 saved the President of the United States
from planned assassination attempts by Muslim terrorists.

An unidentified caller with a distinct middle eastern accent told Agent


Karmilowicz in September 1994 that "a terrorist team of three Iranians and three Iraqis
had been training in Pakistan for one month for the purpose of assassinating US President
Clinton during the President's visit to the Philippines [in November 1994]... [and] the

Agent Karmilowicz never heard from that informant again but these calls
prompted Agent Karmilowicz to establish a monitoring and recording device at the
Embassy, based on the Intelligence he had received (as described above), that collected
information before, during and after the President's visit to the Philippines, and that was,
on information and belief, helpful in evaluating the threats to the President.

II. Agent Karmilowicz - a. praiseworthy record

Ambassador Larry Palmer, formerly assigned to Quito, Ecuador, while Agent


Karmilowicz served as A/RSO, describes Agent Karmilowicz's State Department service
as "exemplary" and states, "without reservation, that he [Agent Karmilowicz] is
deserving of every consideration..."

Ambassador Palmer describes Agent Karmilowicz as a "conscientious, even-


tempered, dedicated and considerate officer." In all the time that the Ambassador has
known Agent Karmilowicz, including those on the firing range at a gun club in Ecuador,
he has "never once ... known [Sam] to lose his temper, raise his voice, become or act in
an irrational manner or to use his position to aggressively threaten anyone at post"

Director David Hale, Office of Israel and Palestinian Affairs, who knows Agent
Karmilowicz because he served with him in such proximity that there was "no margin for
hiding one's qualities and character," described Agent Karmilowicz as "an outstanding
Diplomatic Security officer, a credit to the Bureau of Diplomatic Security and the
Foreign Service", citing Sam's "strength of character, common sense, calm demeanor
under stress, and excellent split-second judgment."

Director Hale says that Agent Karmilowicz, in the delicate and dangerous
circumstances of Beirut, "was a positive and reassuring presence on our compound and
he was a role model for the local bodyguards and A/RSO colleagues alike."

III. The incident - as it truly occurred - before "the DOS railroad began."

The purpose of this paper is to show that based on


information and belief ARSO Samuel Karmilowicz, while
stationed at the U.S. Embassy Manila the Philippines in 1994,
collected critical threat information that led to the disruptions of
the assassination plots against President Clinton and Pope John
Paul II in the Philippines and that Mr. Karmilowicz's actions later
contributed to the arrest of Ramzi Yousef, one of the world's most
wanted men and the 1993 WTC bomber.

Secondly, recent statements by known al Qaeda terrorists


have revealed that Khalid Sheik Mohammed, one of the chief
architects of the 9-11 terrorist attacks in the U.S., was in the
Philippines at the same time that Ramzi Yousef s apartment caught
fire. It therefore is not unreasonable to postulate that had U.S.

Karmilowicz's information more seriously that perhaps Khalid and
other terrorists conspirators may have been identified and arrested
in the Philippines in 1994 before final plans and preparations could
be made to execute subsequent terrorist attacks in the U.S. and
elsewhere.

Background: Immediately following the February 1993


World Trade Center bombing, Ramzi Yousef fled the U.S. on a
Pakistani passport he obtained from the Consulate of Pakistan in
New York.

1) September 13, 1994, Philippine press report that a wealthy


Pakistani businessman named Tariq Javed Rana is suspected of
manufacturing illegal narcotics with the aid of Indian partners.
Raz Bashnir Tarar, a second secretary of the Pakistan Embassy
in Manila responds by issuing press statements denying the
allegations, saying the allegations could not possibly be true
since Pakistanis and Indians were archenemies and that they
would never do business with each other. He further added that
Rana was a close relative of several high-ranking Pakistani
government officials, including members of parliament.
Shortly after he gave these press statements, Tarar is recalled to
Pakistan for unknown reasons.

2) September 18, 1994, ARSO Karmilowicz receives the first of


two anonymous telephone calls from a person who claims that a
plot is underway to assassinate President Clinton during his
official visit to the Philippines in November. The caller names
Tariq Rana as one of the leaders of the plot.

3) September 18th and 19th, 1994, representatives of intelligence


and law enforcement agencies within the U.S. Embassy and
government of the Philippines, including the FBI, Secret
Service, CIA, and the Philippine National Bureau of

investigations to determine if the threat is real.

4) 9/20/904, Tom Collins the U.S. Secret Service agent-in-charge


and intelligence officers at the U.S. Embassy investigated
Tariq Rana and told ARSO Karmilowicz afterwards that they
didn't think he was involved in an assassination plot, saying the
intent of the calls must have been to ruin Rana's reputation and
to draw police suspicion towards him. Collins further added
that the Philippine Central Bank also received an anonymous
call within the same time frame from a person who claimed
they had information about a large counterfeit currency
shipment to the Philippines. Collins suspected that this caller
was the same person that spoke to Mr. Karmilowicz on
September 13th.

5) In response to these telephone threats U.S. Embassy Manila


installs a tape recorder. The recorder remains in place through
the Pope's visit. The Embassy records a total of seven calls in
this time period. [Note: In the right margin of cable, SecState
2137, there is has a handwritten message from DCM Raymond
Burghardt to RSO Walter Sargent is the DCM wrote: "Walt, all
the calls were against the President, weren't they?"

6) 2-3 weeks before President Clinton arrives in Manila, an


American supervisor at the Manila World War II cemetery
advises ARSO karmilowicz that he can't account for 1000 Ibs.
of ammonium-nitrate fertilizer in his inventory. By then it was
common knowledge within the Filipino community that
President Clinton had intended to visit the cemetery and
therefore, a loss of this quantity of fertilizer was a very serious
security concern in that the type of fertilizer reported missing
was suitable in making a bomb, the same type of bomb that was
later used against the federal building in Oklahoma City.
ARSO Karmilowicz conducted an investigation and concluded

that the fertilizer disappeared due to small-scale pilferage by


groundskeepers and improperly set dispersal rates on the
mechanical fertilizer spreaders used at the cemetery.

7) November 12-13, 1994, President Clinton visits the Philippines.


His entourage includes the Secretary of State, the CINPAC, and
other high level U.S. government officials. No apparent
assassination attempt takes place during the visit.

8) January 6,1995, a week before the Pope arrives to Manila, a


mysterious fire erupts in an apartment complex a few blocks
away from the U.S. Embassy Chancery. The building is within
sight of the Pope's intended motorcade route. Immediately
following the fire, several witnesses' report seeing an Arab
looking man fleeing from the apartment. Philippine police later
search the apartment and find bomb making materials, several
laptop computers, airline schedules, and priest clothes.
Philippine Police later arrest Abdul Murad, one of the
occupants of the apartment, when he returns to assess the
damage of the fire. Recent publications now report that the
Philippine police deliberately set fire to the apartment as a
pretext to search it, in the belief they didn't have time to obtain
a search warrant.

9) The person who fled the Manila apartment fire is afterwards


identified as Ramzi Yousef, the primary suspect in the 1993
WTC bombing. Two months later, Pakistani police and U.S.
government agents arrest Yousef in Islamabad, Pakistan.

10) April 3, 1995, Philippine police arrest 6 Arab terrorist


suspects and conduct a manhunt for 25 more. Earlier in the
week, Philippine police arrest Tariq Rana on bribery charges.
One of the articles reported that there was a fire a Rana's
Manila home in December 1994. Chemical residues found in
the Rana home match those found in the Yousef fire. The U.S.

reported to Washington that none of the information in these
articles, including the information about Rana, posed a threat to
Americans in the Philippines or elsewhere. Rana's current

Commissioner Ben-Veniste was approached by the lawyer for a former State Department Security Officer
named Sam Karmilowicz (SK) a couple of months ago, and the Commissioner mentioned it to me today.
SK would like to be interviewed by us in connection with an alleged plot to assassinate President Clinton in
the Philippines in 1994. SK had also approached Team 1 directly last November, and we had tentatively
decided to interview him for an hour, subject to front office approval.

SK was a State Department security officer in the Philippines in 1 994 when he received telephone
warnings of a plot to kill President Clinton. It's not clear that the tip he received has anything to do with
Ramzi Yousef and the Bojinka plot, but he attempts to make the connection and we feel it would not hurt to
interview him for an hour. I should note that SK is apparently being investigated by the State Dept. IG over
a fatal shooting in Ecuador, and this may account for some of his motivation in contacting us.

So this is an fyi re: Commissioner interest, as well as a request for approval to go ahead with the interview.
