The respondent, a native and citizen of Venezuela, was ordered removed in absentia on June 17,
2009. On April 18, 2010, the respondent fled a motion to reopen proceedings, which the
Immigation Judge denied on April 28, 2010. The respondent fled a timely appeal of that decision.
The appeal will be sustained, proceedings will be reopened and the case will be remanded to the
Immigration Judge.
The record refects that the Notice to Appear (NT A) was mailed to the respondent by regular
mail on February 12, 2009, to the respondent's last kown address of record. On appeal, the
respondent in a swor afdavit, stated that he moved fom that address in May 2008, prior to the
issuce of the NT A. The respondent had an adjustent application befre the Departent of
Homeland Security, and attended his appointents. I view of these circumstances, the respondent
cannot be charged with receiving the NT A and we will allow him another opportunity to appear fr
a hearing. See, e.g. MatterofG-Y-R-, 23 I&N Dec. 181 (BIA2001); Matter of Anyelo,25 I&N Dec.
33 7 (BIA 2010) (holding that Matter of G-Y-R-, supra, is applicable to cases arising in the Eleventh
Circuit and distinguishing Dominguez V. US Att' Gen., 284 F.3d 1258 (I Ith Cir. 2002)).
ORDER: The proceedings are reopened and the record is remanded to the Immigration Judge
fr frther proceedings consistent with the fregoing opinion and entr of a new decision.
