Jessica Clark Photography Terms and Conditions of Services 1) Exclusive Photographer: Only the contracted photographer (Jessica Clark)

or any of the contracted photographers hired assistants shall photograph the session. No other cameras, including cell phones will be allowed to be used to take photos during the session. 2) Session Fee: The client(s) shall pay a non-refundable session fee at the time of booking.

3) Canceling/Re-scheduling: If the client(s) should need to re-schedule, the arrangements need to be made no later than 48 hours prior to the original booked date. The session fee will be applied to the next scheduled date if scheduled within 30 days. If the client(s) should want to cancel entirely, this will need to be done no later than 48 hours prior to the booked date in order to receive a credit. The credit will then be applied to a session scheduled for a later date. Any cancellations past 48 hours prior will not warrant a credit. Emergency situations will be considered at the discretion of the photographer. 4) Satisfaction Guarantee: If the client is unhappy with their images, they may request a second shoot at no additional fee. Once print orders have been placed, no refunds will be issued unless extraordinary circumstances occur. This will be dealt with on a case by case basis. 5) NOTICE OF COPYRIGHT and Reproduction: The photographer (Jessica Clark) shall own the copyright to all images that she produces. She is the only one that is legally authorized to reproduce in any way. In the event that the client(s) purchased digital images with printing rights, they are granted the right to print their images an unlimited number of times. All images placed on the web and social media will contain the watermarked logo of Jessica Clark Photography and cannot be legally altered in any way. The photographer (Jessica Clark) shall in all cases retain full copyright of the images. In no case is the client(s) permitted to sell, re-sell neither the digital images they have purchased, nor any prints made from said digital images. Images may not be altered in any way by client(s). Use of images taken by Jessica Clark Photography to promote any other photography business is prohibited. 6) Editing of Digital Files: Immediately following the photo session, the photographer will review all images and remove any that deem unprintable. Unprintable images include those which have flaws such as eyes closed, unwanted objects visible that cannot be removed, or other flaws which cannot be remedied. Photographer will then make the following adjustments as part of the editing process: exposure, color and tonality, white balance, shadow/highlight adjustment, brightening of eyes and softening of skin if needed, etc. Once editing has been completed client(s) will be able to review their images during a scheduled in-person viewing. Further enhancement may be done at the clients request and per the photographers discretion. Print orders will be completed by the high quality professional printing lab that the photographer utilizes. 7) Client Usage: The client is retaining prints for personal use and display only, and should not sell said prints nor authorize any reproduction thereof by parties other than the photographer (Jessica Clark). The client(s) is allowed to obtain a purchased print for a newspaper announcement, yearbook,

etc. as long as the publication is not for profit. 8) Limited Liability: If the photographer cannot perform this agreement due to an emergency, illness, or other causality, or other cause beyond the control of either party involved, then the sitting fee shall be returned to the client(s). If the photographer must cancel a session for any reason and is not able to reschedule, the session fee shall be returned to the client(s). The photographer shall not have any liability associated with this agreement, above the invoice price or the client(s) order. This limitation of liability also applies in the event that the photographic materials are damaged in processing, loss through malfunction, mail, or otherwise lost or damaged through no fault of the photographer. 9) Availability: Due constraints related to storage, the photographer cannot guarantee that digital photos will remain available beyond a period of one year following the shoot date. All online galleries available to the client(s) for purposes of downloading digital images will not be guaranteed to remain available upon a period of one month. One extension of a period of one month may be requested by the client(s) free of charge. Any request to extend the client(s) gallery past a total of two months may be done so at the discretion of the photographer and for a fee of $20. 10) Photographer: The photographer may substitute another photographer to take photos in the event of an illness or schedule conflicts. In the event of such a substitution, the photographer warrants that the substitute photographer shall be a competent professional. 11) Standard Price List: The charges in this agreement are based upon the photographers standard price list. The price list may be adjusted periodically and orders beyond 3 months following the shoot date shall be subject to the price list in effect at the time of the order. 12) Misc: This agreement incorporated understanding by both parties. Any modification of this agreement shall be made in writing and signed by both parties. A charge of $35 will be assessed for all returned checks. Physical signing as well as electronic signing of this agreement will prove that the client(s) is in complete agreement will all aspects of the entire contract presented by Jessica Clark Photography.
