5101:2-12-18: Transportation Procedural Requirements (*) Code


This rule requires certain safety precautions be followed whenever children are transported or walked off the center's premises for either field trips or routine trips. This rule includes requirements for the vehicle driver, child restraint systems, and items to be taken on the trips, such as a first aid kit and information on the children. Written parental permission that contains specific information is required before a child may be taken off the center premises. Each child shall wear identification that includes the center's name, address, and telephone number except for routine trips to and from home or school. The rule also requires that a person trained in first aid, management of communicable disease and CPR be present at the field trip site. A person trained in first aid/management of communicable disease must be on the vehicle used for routine trips.

Findings/Corrections - Serious Risk


During the investigation, several staff were interviewed and it was determined that at the time children were transported by the center's minivan, more than one child was in a seatbelt. When children are transported by the center, the rule requires all children to be seated and restrained in a child restraint system, according to the requirements of Ohio law. In addition, adults and children shall use seatbelts in any vehicle manufactured with seatbelts. Provide training to staff and submit a written plan that ensures these safety guidelines will be met when children are transported.

On the day of the inspection, it was determined through investigation and interviews with staff that while transporting children, the driver failed to follow safety precautions, in that a child under the age of twelve years old rode in the front seat of the vehicle. The rule delegates the driver as the person responsible for the children's safety. Provide training for the driver and submit a written plan to ensure all children will be safely transported by the center.

In review of the center's records, it was determined that the form used to secure the written permission of the parent/guardian for a field or routine trip was missing the specific destination(s); dated signature of the parent or guardian; date of the field trip; approximate time during which children will be on the trip; a statement that children will be participating in activities near water that is more than two feet deep and is accessible to children; mode of transportation. The form used needs to include the child's name, specific destination(s), and the dated signature of the parent or guardian. There also needs to be written notification if water that is

more than two feet in depth will be accessible to children on the trip. Parents/guardians also need to be informed of the mode of transportation for all trips. Additionally for field trips, the date of the field trip and approximate time in which children will
be on the trip must be included. Please revise the permission form and send a copy to this office.
