x--------------------------------------------------------x OPPOSITION OPPOSITOR, through counsel, respectfully avers: 1. That, at the time of the execution of the said will testator was insane, or otherwise mentally incapable to make a will in accordance with Section 9 (b), Rule 76 of the Rules of Court. On October 25, 2003 to November 10, 2005, the alleged period of the execution of the will by the deceased Arvic M. Jimenez, he was admitted to Iloilo Mental Hospital in Barangay Rumbang , Municipality of Pototan, Province of Iloilo as per recommendation of Dr. Manny Malata, a psychiatrist at St. Pauls Hospital, after the deceased Jimenez was diagnosed to be suffering from schizophrenia and was subjected to a pre-frontal lobotomy on November 04, 2007. 2. That testator Arvic Jimenez, acted by mistake and he did not intend that the instrument he signed should be his will at the time of fixing his signature thereto in accordance with Section 9 (e), Rule 76 of the Rules of Court. In fact, during the confinement of the deceased at the Iloilo Mental Hospital during the aforementioned period, petitioner, Raiza Jimenez made the testator Arvic Jimenez sign a piece of paper supposedly containing his testamentary will when testator, in the state

of utter insanity, did not intend that the instrument he signed be his will at the time he affixed his signature on the said instrument. .

WHEREFORE, Oppositor Philippe Magno prays that the Extrajudicial Settlement of the Estate of deceased disallowed. Ravic M. Delgado be denied and be
