The Council of Architecture (COA) has been constituted by the Government of India under the provisions of the Architects

Act, 19 !, enacted by the "arliament of India, #hich came into force on 1st $eptember, 19 !% The Act provides for re&istration of Architects, standards of education, reco&ni'ed (ualifications and standards of practice to be complied #ith by the practicin& architects% The Council of Architecture is char&ed #ith the responsibility to re&ulate the education and practice of profession throu&hout India besides maintainin& the re&ister of architects% )or this purpose, the Government of India has framed *ules and Council of Architecture has framed *e&ulations as provided for in the Architects Act, #ith the approval of Government of India% Any person desirous of carryin& on the profession of +Architect+ must have re&istered himself #ith Council of Architecture% )or the purpose of re&istration, one must possess the re(uisite (ualification as appended to the Architects Act, after havin& under&one the education in accordance #ith the Council of Architecture (,inimum $tandards of Architectural -ducation) *e&ulations, 19./% The re&istration #ith Council of Architecture entitles a person to practice the profession of architecture, provided he holds a Certificate of *e&istration #ith up0to0date rene#als% The re&istration also entitles a person to use the title and style of Architect% The title and style of architect can also be used by a firm of architects, of #hich all partners are re&istered #ith COA% 1imited Companies, "rivate2"ublic Companies, societies and other 3uridical persons ar not entitled to use the title and style of architect nor are they entitled to practice the profession of architecture If any person falsely claims to be re&istered or misuses title and style of architect, such acts tantamount to committin& of a criminal offence, #hich is punishable under section /4 or / (!) of the Architects Act, 19 !% The practice of profession of an architect is &overned by the Architects ("rofessional Conduct) *e&ulations, 19.9 (as amended in !55/), #hich deals #ith professional ethics and eti(uette, conditions of en&a&ement and scale of char&es, architectural competition &uidelines etc% "ursuant to these *e&ulations, the Council of Architecture has framed &uidelines &overnin& the various aspects of practice% An architect is re(uired to observe professional conduct as stipulated in the *e&ulations of 19.9 and any violation thereof shall constitute a professional misconduct, #hich #ill attract disciplinary action as stipulated under section /5 of the Architects Act, 19 !% There are !/ institutions, #hich impart architectural education in India leadin& to reco&ni'ed (ualifications% The standards of education bein& imparted in these institutions (constituent colle&es2departments of universities, deemed universities, affiliated colle&es2schools, IITs, 6ITs and autonomous institutions) is &overned by Council of Architecture (,inimum $tandards of Architectural -ducation) *e&ulations, 19./, #hich set forth the re(uirement of eli&ibility for admission, course duration, standards of staff 7 accommodation, course content, e8amination etc% These standards as provided in the said *e&ulations are re(uired to be maintained by the institutions% The COA oversees the maintenance of the standards periodically by #ay of conductin& inspections throu&h Committees of -8perts% The COA is re(uired to 9eep the Central Government informed of the standards bein& maintained by the institutions and is empo#ered to ma9e recommendations to the Government of India #ith re&ard to reco&nition and de0reco&nition of a (ualification%

Architecture is a social art that touches all human beings at all levels of their existence everywhere and everyday. This is the only discipline, which encompasses the four major fields of human endeavour : Humanities, Science, Art, and Technology, actually putting into practice the professional inputs drawn from them. n sum, Architecture is the matrix of human civili!ation " an authentic measure of the social status, and an evocative expression of the ethos of an era. #hen conserved, it is heritage and when in ruins, becomes archaeology, reconstructing tell"tale pictures of the past civili!ations.

The demands on the profession over the years have become much more complex in nature and much wider in scope. Architecture uses the philosophic wholesomeness of Humanities, the logical rationalism of Science, the passionate imagination of Art and the inexhaustible resources of Technology. t calls for originality, creativity, conceptuali!ation, perception, aesthetic values, and a holisti judgment of people, places, objects and events.

Architecture is primarily the art and science of designing spaces for serving the multifarious activities of human beings and for meeting their specific needs in a meaningful built environment. #hen various engineering services are rationally combined with Architecture$s basic elements of Space, Structure and %orm, the performance of human functions and the operation of mechanical utilities become efficient, pleasant and fulfilling. However, in its broadened scope and baffling complexity, Architecture has generate speciali!ations such as Structural &esign, 'rban &esign, (ity )lanning, *andscape Architecture and nterior Architecture. +etrofittin of ,uildings, Architectural (onservation, (onstruction -anagement have also lately emerged as speciali!ations. .ach of these compliment and support each other.

The primary objective of Structural &esign is to evolve a strong, durable and an efficient s/eleton so that the space which architecture encloses, and the form in which it expresses itself as interior content and an exterior container, becomes an organic extension of one another. Structure is so fundamental to architecture that it actually determines its two"pronged functions0 the utilitarian appropriateness and the expressive power of aesthetics. Structural design as a creative discipline assumes an indispensable position as a natural extension of Architectural &esign. .ndowed with an extraordinary power of conceptuali!ation an creativity, an architect can conjure up unprecedented structural systems leading to the genesis of design"ideas introducing new concepts of Space and %orm. n other words, the architect$s contribution to structural design can effectively bring about 1ualitative change in the built"environment to stimulate the advancement of society towards a higher order of civili!ation.

'rban &esign is architecture of the cities, highly complex and gargantuan in scale. The primary aim of urban design is to imbibe and maintain a sense of identity and harmony among buildings, open spaces and other structures by means of a pleasant and memorable visual imagery throughout the length and breadth of an urban setting. Accessibility at city"level and the movement at all levels must be designed to operate smoothly. 2olumetric relationships, harmonious spatial se1uences, transition from buildings to open spaces, streetscape and the services infrastructure must together invest a townscape with an exclusive imageability.

*andscape Architecture deals with the analysis, planning, design, management, preservation and rehabilitation of land and also determines the environmental impact. t is a science capable of objective analysis and synthesis leading to an ecologically"sensitive design, which is self"sustainable. t integrates from the very conception, the elements of architecture, urban design and civil engineering for meaningful and practical solutions. *andscape architecture covers a wide spectrum of professional expertise, rangin from landscape planning at the regional and city scale on the one end, to the small and medium scale of public and private landscape at the other. t involves dealing with such sites as office pla!as3 public s1uares, highways, city par/s3 national par/s, housing developments, institutional campuses, !oological and botanical par/s.

n case of nterior Architecture, the primary objective is to generate a purposeful ambience such as would stimulate the user$s creative potential through multifarious activities. t must facilitate the individual$s sense of orientation, identification and eventual appropriation of architectural spaces, that meld the interiors and exteriors into symbiotic relationships through varied experiences of scale, volume, light and shade. nteriors are not only to protect the users from the extremes of weather but also to nurture them emotionally. Since the interior spaces are truly the life"force of any building, they must be designed 4and not decorated5 as detailed artistic articulation of the basic architectural concept with deep insight and sensitivity to fulfill the fundamental functional and aesthet needs that are efficient and pleasant to live and wor/ in. The development of design is a very conscious act and it infuses life into interiors subconsciously. (reativity is the essence of architecture and harmony an essential aim of architects. Architecture that has been recogni!ed as great in the historic past as well as in our own time, has been harmonious with nature and its immediate environment. These are the essential tenets of design which architects aspire to follow. Architecture &esign essentially is a product of an individual mind but reali!ed through association of experts from allied fields who contribute in the process of construction. -utual respect and understanding wor/ wonders for ensuring high 1uality of the end"

product. The architectural profession feels deeply concerned towards national priorities in the fields of energy conservation, ecology, environmental pollution, protection and preservation of architectural heritage and their precincts, low"cost housing, urban renewals, rural upliftment, economic development at local and district levels, etc. in the interest of 1uality of life both in rural and urban settlements.

The practice of the architectural profession is regulated by the Architects Act, 6789, and the regulations framed thereunder. The (ouncil of Architecture has prescribed the (onditions of .ngagement and Scale of (harges under the Architects 4)rofessional (onduct5 +egulations, 67:7. The documents stipulate the parameters within which the Architect is re1uired to function. These define the responsibilities, the scope of wor/ and services, and prescribe the mandatory minimum scale of professional charges with a view to ma/ing the (lient fully aware of the duties and services which he may expect from the Architect. The professional services re1uired by the (lient may not be comprehensive in scope in all cases and accordingly a clear understanding between the two must be arrived at. The (ouncil of Architecture has prescribed the (onditions of .ngagement based on general practice of the profession in ndia. These documents are applicable to all registered architects and such architects who have speciali!ed in areas such as Structural &esign, 'rban &esign, (ity )lanning, *andscape Architecture, nterior Architecture and Architectural (onservation.

The revised version of these documents reflects the (ouncil$s response to the many challenges which the profession of Architecture is facing at present, and is constantly endeavouring to meet them with active concern and unflinching commitment.

Comprehensive Architectural Services

1. SCOPE OF WORK The Architect is re1uired to provide services in respect of the following : Part I - ARCHITECTURE : 6.6 Ta/ing (lient$s instructions and preparation of design brief. 6.9 Site evaluation, analysis and impact of existing and 3 or proposed development on its immediate environs. 6.> &esign and site development. 6.< Structural design. 6.@ Sanitary, plumbing, drainage, water supply and sewerage design. 6.A .lectrical, electronic, communication systems and design. 6.8 Heating, ventilation and air conditioning design 4H2A(5 and other mechanical systems.

6.: .levators, escalators, etc. 6.7 %ire detection, %ire protection and Security systems etc. 6.6= )eriodic inspection and evaluation of (onstruction wor/s. Part II _ ALLIED FIELDS : 6.66 *andscape Architecture 6.69 nterior Architecture 6.6> Architectural (onservation 6.6< +etrofitting of ,uildings 6.6@ Braphic &esign and Signage 2. SCHEDULE OF SERVICES : The Architect shall, after ta/ing instructions from the (lient, render the following services: CONCEPT DESIGN [STAGE 1] : 9.=6 Ascertain (lient$s re1uirements, examine site constraints C potential 0 and prepare a design brief for (lient$s approval. 9.=9 )repare report on site evaluation, state of existing buildings, if any 0 and analysis and impact of existing and3 or proposed development on its immediate environs. 9.=> )repare drawings and documents to enable the (lient to get done the detailed survey and soil investigation at the site of the project. 9.=< %urnish report on measures re1uired to be ta/en to mitigate the adverse impact, if any, of the existing and 3 or proposed development on its immediate environs. 9.=@ )repare conceptual designs with reference to re1uirements given and prepare rough estimate of cost on area basis. PRELI INAR! DESIGN AND DRAWINGS [STAGE 2] : 9.=A -odify the conceptual designs incorporating re1uired changes and prepare the preliminary drawings, s/etches, study model, etc., for the (lient$s approval along with preliminary estimate of cost on area basis. DRAWINGS FOR CLIENT"S# STATUTOR! APPROVALS [STAGE $] : 9.=8 )repare drawings necessary for (lient$s3 statutory approvals and ensure compliance with codes, standards and legislation, as applicable and assist the (lient in obtaining the statutory approvals thereof, if re1uired. WORKING DRAWINGS AND TENDER DOCU ENTS [STAGE %] :

9.=: )repare wor/ing drawings, specifications and schedule of 1uantities sufficient to prepare estimate of cost and tender documen including code of practice covering aspects li/e mode of measurement, method of payments, 1uality control procedures on material C wor/s and other conditions of contract.

APPOINT ENT OF CONTRACTORS [STAGE &] : 9.=7 nvite, receive and analyse tenders0 advise (lient on appointment of contractors. CONSTRUCTION [STAGE '] : 9.6= )repare and issue wor/ing drawings and details for proper execution of wor/s during construction. 9.66 Approve samples of various elements and components. 9.69 (hec/ and approve shop drawings submitted by the contractor3 vendors. 9.6> 2isit the site of wor/, at intervals mutually agreed upon, to inspect and evaluate the (onstruction #or/s and where necessary clarify any decision, offer interpretation of the drawings3specifications, attend conferences and meetings to ensure that the project proceeds generally in accordance with the conditions of contract and /eep the (lient informed and render advice on actions, if re1uired.

9.6< n order to ensure that the wor/ at site proceeds in accordance with the contract documents3 drawings and to exercise time and 1uality controls, the day"to"day supervision will be carried out by a (onstruction -anager 4(ler/ of #or/s3 Site Supervisor or (onstruction -anagement Agency in case of a large and complex project5, who shall wor/ under the guidance and direction of the Architect and shall be appointed and paid by the (lient. 9.6@ ssue (ertificate of 2irtual (ompletion of wor/s. CO PLETION [STAGE (] :

9.6A )repare and submit completion reports and drawings for the project as re1uired and assist the (lient in obtaining D(ompletion3 Eccupancy (ertificateD from statutory authorities, wherever re1uired. 9.68 ssue two sets of as built drawings including services and structures. $. PROFESSIONAL FEE : >.=6 n consideration of the professional services rendered by the Architect, he shall be paid professional fee and other charges in accordance with the Scale of (harges. >.=9 Any tax levied by law, such as Service tax, etc. contingent to professional services rendered by the Architect, shall be payable by the (lient, over and above the gross fees charged by the Architect in relation to the services provided.

&. EFFECTING PA! ENT TO THE ARCHITECT :

@.6 The fee payable to the Architect shall be computed on the actual cost of wor/s on completion. The payment due to the Architect at different stages be computed on the following basis: @.6.6 +etainer : En rough estimate of cost. @.6.9 At Stage 6 : En rough estimate of cost. @.6.> At Stages 9 to < : En preliminary estimate of cost. @.6.< At Stages @ to Ab : Accepted tender cost. @.6.@ At Stage 8 : Actual total cost. @.9 )rogressive, on account, payments shall be made by the (lient to the Architect against any of the above stages based on the 1uantum of wor/ done during that stage, as may be mutually agreed to between the (lient and the Architect. @.> ?o deductions shall be made from the fee of the Architect on account of penalty, li1uidated damages, part rates or other sums withheld from payment or recovered from contractors3 suppliers.

@.< #hen the wor/ is executed wholly or in part with old materials or labour or carriage is provided by the (lient, the percentage fee shall be calculated as if the wor/ had been executed wholly by the contractor supplying all labour and new materials.

@.@ The actual cost of the completed wor/s shall include cost of execution of assigned wor/s, referred to in Scope of #or/ and also the cost of e1uipment C machinery such as Transformers, &B Sets, Sub"stations, *ifts, Air (onditioning -achines, )umps C -otors #ater and Sewage Treatment )lant, etc., but excluding the cost of land. '. DOCU ENTATION AND CO UNICATION CHARGES :

Apart from the professional fee, the (lient shall pay to the Architect &ocumentation and (ommunication charges, G 6=F of the professional fee payable to the Architect at all stages. (. REI -URSA-LE E.PENSES : n addition to the amounts reimbursable against site visits by the Architect3 (onsultant, the (lient will reimburse the Architect the following expenses incurred by him for discharge of his obligations: 8.=6. Actual cost of travel 4to C fro5, boarding C lodging and local transport for any visit made by his staff to the site or such other place as may be necessary in connection with the execution of wor/ and in connection with the performance of duties referred to in this agreement. 8.=9. (ost of presentation models, computer simulation, presentation drawings, etc., prepared at the instance of the (lient for purposes other than the &esign and execution of the project. /. CLIENT"S ROLE AND RESPONSI-ILITIES : The (lient shall discharge all his obligations connected with the project and engagement of the Architect as follows: :.=6 To provide detailed re1uirements of the project. :.=9 To provide property lease3 ownership documents. :.=> To provide a site plan, to a suitable scale, showing boundaries, contours at suitable intervals, existing physical features

including any existing roads, paths, trees, existing structures, existing service and utility lines and such lines to which the proposed service can be connected. n case such information is not readily available, the (lient shall arrange for the survey3 collection of necessary information and pay for the same. :.=< To furnish reports on soil conditions and test as re1uired by the Architect or pay for the preparation of the same. :.=@ To furnish specific conditions3 Statutory stipulations3 (odes of )ractice3Schedule of rates, etc., desired to be followed. :.=A To pay all the fees, levies, security deposits and expenses in respect of statutory sanction. :.=8 To give effect to the professional advice of the Architect and cause no changes in the drawings and documents without the consent of the Architect. :.=: To honour Architect$s bills within one month of its submission. :.=7 To appoint a (onstruction -anager 4(ler/ of #or/s3 Site Supervisor or (onstruction -anagement Agency in case of a large and complex project5 as per the Architect$s advice. 0. E.ECUTION OF THE ASSIGN ENT : 7.=6 The Architect shall /eep the (lient informed about the progress of wor/ in his office. 7.=9 The Architect shall appoint specialised consultants in consultation with the (lient, if necessary. 7.=> The Architect shall be responsible for the direction and integration of the consultants wor/. The consultants, however, shall be fully responsible for the calculations, the detailed design and periodic inspection and evaluation of the wor/ entrusted to them. The Architect shall, if re1uested, ma/e available the design calculations. 7.=< The Architect will advise the (lient on the Time Schedule 4,ar (hart3).+T3 ()- ?etwor/5 prepared by the contractors for the completion of wor/, if re1uired. 7.=@ The Architect shall supply to the (lient, free of cost, upto six sets of drawings at different stages. 7.=A The Architect shall not ma/e any deviations, alterations or omissions from the approved drawings, involving financial implications without prior consent of the (lient.

7.=8 Any professional services to be rendered by the Architect at the instance of the (lient after the agreed project completion perio shall be compensated for on mutually agreed terms.

7.=: The Architect shall exercise all reasonable s/ill, care and diligence in the discharge of his duties and shall exercise such gener superintendence and inspection as may be necessary to ensure that wor/s are being executed in accordance with the (onditions o (ontract.

7.=7 Any revision in the drawings, tenders and documents, once approved, re1uired to be made by the (lient shall be compensated as additional services rendered by the Architect and paid for G @=F of the fee prescribed for the relevant stage4s5. 7.6= ?o change shall be made in the approved drawings and specifications at site without the consent of the Architect.

7.66 Any curtailment of the professional services, beyond Stage 9, shall ma/e it obligatory for the client to pay at least 9=F of the fe for the remaining Stage4s5 of the curtailed wor/3 Services. 11. TI E SCHEDULE : The Architect shall, in consultation with the (lient, prepare a Time Schedule in respect of various services to be rendered and

discharge of (lient$s obligations. 11. INDE NIFICATION : n the event that a claim or suit is brought against the Architect or the (onsultants by any third party for damages arising from personal injury or property damage caused wholly by the (lient, or anyone employed by the (lient, or anyone for whose acts the (lient may be held responsible, then the (lient shall indemnify the Architect and fully reimburse any loss, damage or expenses, including the attorney$s fees, which the Architect may incur in connection therewith. 12. OWNERSHIP OF COP!RIGHT : Architectural design is an intellectual property of the Architect. The drawings, specifications, documents and models as instruments of service are the property of the Architect whether the project, for which they are made, is executed or not. The (lient shall retain copies of the Architect$s models, drawings, specifications and other documents for his information and use in connection with the project. These shall not be used for any other project by the (lient or the Architect or any other person, except for the repetition as stipulated in the Scale of (harges. 1$. TER INATION OF AGREE ENT : 6>.6 Agreement between the Architect and the (lient may be terminated by either one giving the other a written notice of not less than >= 4thirty5 days, should either fail substantially to perform his part of responsibilities3duties, so long as the failure is not caused by the one initiating the termination.

6>.9 #hen termination of this Agreement is not related or attributable, directly or indirectly to any act, omission, neglect or default on the part of the Architect, the Architect shall be entitled to professional fees as stipulated under (lause < and sub"clauses 7.=7 and 7.66 of (lause 7.

6>.> n the event of Architect$s firm closing its business or the (lient having terminated the agreement, the (lient shall have the righ to employ another Architect to complete the wor/, after ma/ing payment to the previous architect$s firm. 1%. INTERPRETATION :

n case of any ambiguity or difficulty in the interpretation of the (onditions of .ngagement and Scale of (harges, the interpretation o the (ouncil of Architecture shall be final and binding on the Architect and the (lient. 1&. AR-ITRATION :

All disputes or differences which may arise between the (lient and the Architect under D(onditions of .ngagement and Scale of (hargesD with regard to the meaning or interpretation or matter or things done or to be done in pursuance hereof, such disputes and differences shall be referred for arbitration to the (ouncil of Architecture. The arbitrator shall be appointed by the )resident, (ouncil of Architecture. The arbitration shall be conducted as per the provisions of the Arbitration and (onciliation Act, 677A. The decision and award of the arbitrator shall be final and binding on the Architect and the (lient.

Urban Design

1. SCOPE OF WORK : The Architect is re1uired to provide services for 'rban &esign 3'rban +enewal Scheme in respect of the following :

Part I - UR-AN DESIGN# UR-AN RENEWAL 6.6 Ta/ing (lient$s instructions and preparation of design brief. 6.9 Site evaluation, analysis of architectural character, social issues and heritage. 6.> %easibility study. 6.< )reliminary proposal for development3 re"development and their impact on immediate environs. 6.@ 2olumetric study and 'rban form recommendations including pedestrian 3 vehicular movement and par/ing. 6.A Architectural controls3 guidelines. 6.8 (onceptual design of : i. Site development, services and their interconnectivity. ii. *andscape Architecture. iii. Architectural (onservation. iv. Braphic &esign and Signage. Part II _ SITE DEVELOP ENT 6.: (omprehensive Architectural Services beyond )art with regard to external .ngineering Services and related buildings 3 structures0 +oads, pathways, culverts C bridges0 boundary walls, gates. PART III _ LANDSCAPE ARCHITECTURE 6.7 *andscape Architectural Services beyond )art with regard to public spaces. 2. SCHEDULE OF SERVICES : The Architect shall, after ta/ing instructions from the (lient, render the following services: PROGRA ING AND SITE EVALUATION [STAGE 1] :

9.=6 Ascertain (lient$s re1uirements, examine site constraints C potential 0 and prepare a design brief for (lient$s approval. 9.=9 Study of existing land use in and around the project area. 9.=> Study of contextual issues, socio"cultural aspects, landscape features and built form etc. 9.=< Study of existing infrastructure, accessibility, circulation pattern and par/ing.

The consultants, however, shall be fully responsible for the calculations, the detailed design and periodic inspection and evaluation of the wor/ entrusted to them. The Architect shall, if re1uested, ma/e available the design calculations. 7.=< The Architect will advise the (lient on the broad Time Schedule for implementation of the project. 7.=@ The Architect shall supply to the (lient, free of cost, upto six sets of drawings at different stages. 7.=A The Architect shall not ma/e any deviations, alterations or omissions from the approved drawings, involving financial implications without prior consent of (lient.

7.=8 Any professional services to be rendered by the Architect at the instance of the (lient after the agreed project completion perio shall be compensated for on mutually agreed terms.

7.=: The Architect shall exercise all reasonable s/ill, care and diligence in the discharge of his duties and shall exercise such gener superintendence and inspection as may be necessary to ensure that wor/s are being executed in accordance with the (onditions o (ontract.

7.=7 Any revision in the drawings, tenders and documents, once approved, re1uired to be made by the (lient shall be compensated as additional services rendered by the Architect and paid for G @=F of the fee prescribed for the relevant stage4s5. 7.6= ?o change shall be made in the approved drawings and specifications at site without the consent of the Architect. 7.66 Any curtailment of the professional services, beyond Stage 9b, shall ma/e it obligatory for the (lient to pay at least 9=F of the fee for the remaining stage4s5 of the curtailed wor/3 services. 11. TI E SCHEDULE : The Architect shall, in consultation with the (lient, prepare a Time Schedule in respect of various services to be rendered and discharge of client$s obligations. 11. INDE NIFICATION : n the event that a claim or suit is brought against the Architect or the (onsultants by any third party for damages arising from personal injury or property damage caused wholly by the (lient, or anyone employed by the (lient, or anyone for whose acts the (lient may be held responsible, then the (lient shall indemnify the Architect and fully reimburse any loss, damage or expenses, including the attorney$s fees, which the Architect may incur in connection therewith.

12. OWNERSHIP OF COP!RIGHT : Architectural design is an intellectual property of the Architect. The drawings, specifications, documents and models as instruments of service are the property of the Architect whether the project, for which they are made, is executed or not. The (lient shall retain copies of the Architect$s models, drawings, specifications and other documents for his information and use in connection with the project. These shall not be used for any other project by the (lient or the Architect or any other person, except for the repetition as stipulated in the Scale of (harges. 1$. TER INATION OF AGREE ENT : 6>.6 Agreement between the Architect and the (lient may be terminated by either one giving the other a written notice of not less than >= 4thirty5 days, should either fail substantially to perform his part of responsibilities3 duties, so long as the failure is not caused by the one initiating the termination.

6>.9 #hen termination of this Agreement is not related or attributable, directly or indirectly to any act, omission, neglect or default on the part of the Architect, the Architect shall be entitled to professional fees as stipulated under (lause < and sub"clauses 7.=7 and 7.66 of (lause 7.

6>.> n the event of Architect$s firm closing its business or the (lient having terminated the agreement, the (lient shall have the righ to employ another Architect to complete the wor/, after ma/ing payment to the previous architect$s firm. 1%. INTERPRETATION :

All disputes or differences which may arise between the (lient and the Architect under D(onditions of .ngagement and Scale of (hargesD with regard to the meaning or interpretation or matter or things done or to be done in pursuance hereof, such disputes and differences shall be referred for arbitration to the (ouncil of Architecture. The arbitrator shall be appointed by the )resident, (ouncil of Architecture. The arbitration shall be conducted as per the provisions of the Arbitration and (onciliation Act, 677A. The decision and award of the arbitrator shall be final and binding on the Architect and the (lient.

Landscape Architecture

SCHEDULE OF SERVICES : The Architect shall, after ta/ing instructions from the (lient, render the following services : CONCEPT DESIGN [STAGE 1] : 9.=6 %urnish a site evaluation and analysis report with basic approach to circulation, activity distribution, interaction and external lin/ages. 9.=9 Analyse schedule of spaces in relation to activities and site potential. 9.=> )repare conceptual designs with reference to re1uirements and prepare rough estimate of cost on area basis. 9.=< -odify the conceptual designs incorporating re1uired changes, prepare the preliminary drawings, interior views and schedule o finishes for the (lient$s approval along with the preliminary estimate of cost on area basis. APPROVAL [STAGE $] : 9.=@ )repare drawings necessary for (lient$s3 statutory approvals and ensure compliance with codes, standards and legislation, as applicable and assist the (lient in obtaining the statutory approvals thereof, if re1uired. 9.66 2isit the site of wor/ and fabrication wor/shop, at intervals mutually agreed upon, to inspect and evaluate the progress of wor/s and where necessary clarify any decision, offer interpretation of the drawings3specifications, attend conferences and meetings to ensure that the project proceeds generally in accordance with the conditions of contract and /eep the (lient informed and render advice on actions, if re1uired.

9.69 n order to ensure that the wor/ at site proceeds in accordance with the contract documents3 drawings and to exercise time and 1uality controls, the day"to"day supervision will be carried out by a (onstruction -anager 4(ler/ of #or/s3 Site Supervisor or (onstruction -anagement Agency in case of a large and complex project5, who shall wor/ under the guidance and direction of the Architect and shall be appointed and paid by the (lient.

&. EFFECTING PA! ENT TO THE ARCHITECT :

@.6 The fee payable to the Architect shall be computed on the actual cost of wor/s on completion. REI -URSA-LE E.PENSES : n addition to the amounts reimbursable against site visits by the Architect3 (onsultant, the (lient will reimburse the Architect the following expenses incurred by him for discharge of his obligations: 8.=6. Actual cost of travel 4to C fro5, boarding C lodging and local transport for any visit made by his staff to the site or such other place as may be necessary in connection with the execution of wor/ and in connection with the performance of duties referred to in this agreement.

CLIENT"S ROLE AND RESPONSI-ILITIES : The (lient shall discharge all his obligations connected with the project and engagement of the Architect as follows: :.=6 To provide detailed re1uirements of the project. :.=9 To provide property lease3 ownership documents.

:.=> To provide location plan, measured drawings and photographs of existing space with full structural and relevant details, existin services and common outlets to which proposed services can be connected. n case such information is not readily available, the (lient shall arrange for the collection of necessary information and pay for the same. :.=< To furnish specific conditions3 statutory stipulations3 codes of practice3 schedule of rates, etc. desired to be followed. :.=@ To pay all the fees, levies, security deposits and expenses in respect of statutory sanction. :.=A To give effect to the professional advice of the Architect and cause no changes in the drawings and documents without the consent of the Architect. :.=8 To honour Architect$s bills within one month of its submission. :.=: To appoint a (onstruction -anager 4(ler/ of #or/s3 Site Supervisor or (onstruction -anagement Agency in case of a large and complex project5 as per the Architect$s advice. 0. E.ECUTION OF THE ASSIGN ENT : 7.=6 The Architect shall /eep the (lient informed about the progress of wor/ in his office. 7.=9 The Architect shall appoint specialised consultants in consultation with the (lient, if necessary. 7.=> The Architect shall be responsible for the direction and integration of the consultants wor/. The consultants, however, shall be fully responsible for the calculations, the detailed design and periodic inspection and evaluation of the wor/ entrusted to them. The Architect shall, if re1uested, ma/e available the design calculations. 7.=< The Architect will advise the (lient on the Time Schedule 4,ar (hart3).+T3 ()- ?etwor/5 prepared by the contractors for the completion of wor/, if re1uired. 7.=@ The Architect shall supply to the (lient, free of cost, upto six sets of drawings at different stages. 7.=A The Architect shall not ma/e any deviations, alterations or omissions from the approved drawings, involving financial implications without prior consent of the (lient.

7.=8 Any professional services to be rendered by the Architect at the instance of the (lient after the agreed project completion perio shall be compensated for on mutually agreed terms.

7.=: The Architect shall exercise all reasonable s/ill, care and diligence in the discharge of his duties and shall exercise such gener superintendence and inspection as may be necessary to ensure that wor/s are being executed in accordance with the (onditions o (ontract.

7.=7 Any revision in the drawings, tenders and documents, once approved, re1uired to be made by the (lient shall be compensated

as additional services rendered by the Architect and paid for G @=F of the fee prescribed for the relevant stage4s5. 7.6= ?o change shall be made in the approved drawings and specifications at site without the consent of the Architect.

7.66 Any curtailment of the professional services, beyond Stage 9, shall ma/e it obligatory for the client to pay at least 9=F of the fe for the remaining stage4s5 of the curtailment wor/3 services. 11. TI E SCHEDULE : The Architect shall, in consultation with the (lient, prepare a Time Schedule in respect of various services to be rendered and discharge of client$s obligations. 11. INDE NIFICATION : n the event that a claim or suit is brought against the Architect or the (onsultants by any third party for damages arising from personal injury or property damage caused wholly by the (lient, or anyone employed by the (lient, or anyone for whose acts the (lient may be held responsible, then the (lient shall indemnify the Architect and fully reimburse any loss, damage or expenses, including the attorney$s fees, which the Architect may incur in connection therewith. 12. OWNERSHIP OF COP!RIGHT : Architectural design is an intellectual property of the Architect. The drawings, specifications, documents and models as instruments of service are the property of the Architect whether the project, for which they are made, is executed or not. The (lient shall retain copies of the Architect$s models, drawings, specifications and other documents for his information and use in connection with the project. These shall not be used for any other project by the (lient or the Architect or any other person, except for the repetition as stipulated in the Scale of (harges. 1$. TER INATION OF AGREE ENT : 6>.6 Agreement between the Architect and the (lient may be terminated by either one giving the other a written notice of not less than >= 4thirty5 days, should either fail substantially to perform his part of responsibilities3 duties, so long as the failure is not caused by the one initiating the termination.

6>.9 #hen termination of this Agreement is not related or attributable, directly or indirectly to any act, omission, neglect or default on the part of the Architect, the Architect shall be entitled to professional fees as stipulated under (lause < and sub"clauses 7.=7 C 7.66 of (lause 7.

6>.> n the event of Architect$s firm closing its business or the (lient having terminated the agreement, the (lient shall have the righ to employ another Architect to complete the wor/, after ma/ing payment to the previous architect$s firm. 1%. INTERPRETATION :

n case of any ambiguity or difficulty in the interpretation of the (onditions of .ngagement and Scale of (harges, the interpretation o the (ouncil of Architecture shall be final and binding on the Architect and the (lient. 1&. AR-ITRATION :

All disputes or differences which may arise between the (lient and the Architect under D(onditions of .ngagement and Scale of (hargesD with regard to the meaning or interpretation or matter or things done or to be done in pursuance hereof, such disputes and differences shall be referred for arbitration to the (ouncil of Architecture. The arbitrator shall be appointed by the )resident, (ouncil of Architecture. The arbitration shall be conducted as per the provisions of the Arbitration and (onciliation Act, 677A. The decision and award of the arbitrator shall be final and binding on the Architect and his (lient.
