Structures functioned we(( and incor'orated (oca( know(ed e and ex'ertise. /(( voters e(i ib(e under t+e /frican 6nion <i + 4m'(ementation &ane( 7/6<4&8 'ro'osa(4 commended by t+e /6&S. and ot+er internationa( institutions and overnments +ad o''ortunity to re ister and vote3 and no e(i ib(e voter was 'revented from doin so. :e wou(d (ike to commend t+e //.". for a com're+ensive and t+orou + 'rocess we((;executed. :e are satisfied t+at t+e resu(ts of t+e /byei /rea .ommunity "eferendum accurate(y re'resent t+e enuine ex'ression of t+e wi(( of t+e e(ectorate. :+i(e t+ere were minor irre u(arities derivin from t+e s+ort timetab(e and (ack of time avai(ab(e for voter education and staff trainin 3 t+e inte rity and credibi(ity of t+e 'rocess was not com'romised. *+is was an extraordinary ac+ievement iven t+e (o istica( c+a((en es t+e .ommission faced. :e +ad some concerns about assisted votin and (ack of attention to secrecy by bot+ voters and staff in a sma(( number of centres3 but t+is was t+e exce'tion and not t+e norm. :+ere it did take '(ace3 we are satisfied voters were iven a enuine c+oice and mani'u(ation was not t+e intent. /ssistance was enera((y iven in res'onse to re5uests by voters and attem'tin to miti ate t+e 'rob(ems faced by i((iterate and disab(ed voters. 4n many res'ects t+e /byei referendum exceeded t+e standards met by t+e Sout+ Sudanese referendum +e(d in Aanuary %#11. :e find t+at t+ere are no ood tec+nica( reasons to fai( to reco nise t+e /byei referendum. .ountries and institutions w+o reco nised t+e resu(ts of t+e Sout+ Sudanese referendum of %#11 as a enuine ex'ression of t+e wi(( of t+e e(ectorate3 but w+o fai( to do so in t+is case3 wi(( do so for 'o(itica( rat+er t+an tec+nica( reasons.

Overview of Observation Mission


/(t+ou + t+e //.". accredited (oca( observers and externa( 7i.e.3 externa( to t+e 9 ok ,inka community8 observers from o''osition 'o(itica( 'arties and civi( society or anisations based in Sout+ Sudan3 we were t+e on(y internationa( observers of t+e /byei /rea .ommunity "eferendum. *+is was due to a (ack of interest from or anisations t+at traditiona((y observe referenda and e(ections. / c(ear invitation was issued to internationa( observers5 and t+e //.". were ready to accredit ot+er internationa( observers w+o 'resented t+emse(ves. 694SF/ 76nited 9ations 4nterim Security Force for /byei8 a''eared to +ave t+eir own observation mission3 but did not seek accreditation from t+e //.".. On re'eated occasions we witnessed t+em makin s+ort visits (astin a few minutes to "eferendum .entres in /byei town3 bot+ durin re istration and 'o((in . 7Our visits usua((y (asted % +ours.8

*+e internationa( observers were *im F(atman3 a re u(ar visitor to /byei workin vo(untari(y and direct(y wit+ (oca( c+urc+es to su''ort t+e dis'(aced 9 ok ,inka and returnees nort+ of t+e river Ciir3 and <anna+ .ross3 +is fiancee3 w+o was visitin /byei for t+e first time. *im +as been an e(ection a ent on numerous occasions in t+e 6C and is fami(iar wit+ a(( as'ects of e(ectora( 'rocedures. <is ex'erience and contacts in /byei +e('ed in identifyin w+ic+ (ocations wou(d be most usefu( to visit3 and enab(ed t+e verification of im'ortant information 7for exam'(e3 c+eckin t+e numbers of re istered voters in rura( 'o'u(ation centres a ainst t+e ex'ectations of t+ose invo(ved in assistin returns to t+ose areas or 'rovidin +umanitarian su''ort8. <anna+ 'rovided a usefu( counter;'ers'ective as one new to /byei /rea.

im'ortant to note3 iven t+e obstruction internationa( observers faced w+en tryin to access t+e data centre in Auba durin t+e %#11 referendum on t+e se(f;determination of Sout+ern Sudan.! :e were even 'rovided wit+ soft co'ies of t+e sections of t+e voter (ist we re5uested3 in s'reads+eet format3 so t+at we cou(d run our own c+ecks on it. ,es'ite t+e (ack of ve+ic(es avai(ab(e to t+e //.". and t+e (o istica( difficu(ties t+is 'resented3 t+e //.". a(tered t+eir own '(ans to faci(itate trans'ort to centres we wis+ed to visit3 rat+er t+an t+e centres t+ey +o'e we wou(d visit3 durin bot+ re istration and 'o((in . //.". a(so faci(itated t+e trans'ort of 0ourna(ists. /s far as we are aware3 t+e on(y com'(aint made by any 0ourna(ist t+rou +out t+e entire 'rocess re(ated to +avin to wait a mornin for trans'ort to nort+ernmost 'o((in centres. :e do not find t+is com'(aint reasonab(e. *+e //.". +ad no duty to faci(itate trans'ort for 0ourna(ists. *+e de(ay was caused by a (ack of avai(ab(e ve+ic(es and t+e need to use some ve+ic(es to trans'ort ba((ot boxes from a secure overni +t (ocation to referendum centres so t+at votin cou(d be in on time. Sometimes referendum staff warned t+em a ainst t+ese 'ractices3 but on ot+er occasions t+ey a''eared to be intimidated by forei n 0ourna(ists and said not+in . :+i(e trans'arency is crucia(3 it +as (imits and s+ou(d not com'romise t+e secrecy of t+e ba((ot. :e are satisfied t+at t+is +a''ened on a sma(( number of occasions on(y. <owever3 0ourna(ists s+ou(d be aware t+at re u(ations a''(y to t+em as muc+ as to staff at referendum centres.

*+e commission and its staff reco nised t+e im'ortance of trans'arency to ensure t+e referendum com'(ied wit+ internationa( standards as far as was 'ossib(e. <owever3 a stron er motivation was t+e desire for t+e wor(d to see t+e 9 ok make t+eir decision as to t+e fina( status of /byei /rea. .ommission members3 staff at referendum centres and voters we s'oke to viewed t+e 'rocess as t+e im'(ementation of t+e /frican 6nion <i + 4m'(ementation &ane( 'ro'osa( for a referendum in October %#13. *+ey we(comed us and 0ourna(ists a(ike as t+ose w+o wou(d testify as to t+e conduct of t+e referendum and 'resent conc(usions to t+e internationa( community. *+is in itse(f dis'(ayed a +i + (eve( of confidence in t+e inte rity of t+eir 'rocess. Before t+e se'aration of Sout+ Sudan on - Au(y %#113 t+e Sudanese /rmed Forces ;inc(udin Misseriya mi(itias incor'orated into it; destroyed muc+ of /byei town and dis'(aced t+e 9 ok ,inka 'o'u(ation in May %#11. / series of a reements fo((owed. :+en t+e Bovernments of Sudan and Sout+ Sudan 'roved unab(e to reac+ a reement on a 'rocess to reso(ve t+e fina( status of /byei3 a 'ro'osa( was 'resented by *+abo Mbeki.1# *+e 'ro'osa( was acce'ted by t+e Bovernment of t+e "e'ub(ic of Sout+ Sudan but re0ected by t+e Bovernment of Sudan. *+e 'ro'osa( +as been reco nised by t+e /frican 6nion &eace and Security .ounci( 7/6&S.8 as t+e on(y 1fair3 e5uitab(e and workab(e211 so(ution for /byei /rea3 but +as not yet been im'(emented by it. *+abo MbekiDs 'ro'osa( 'romised a referendum in October %#13 and offered furt+er c(arification as to voter e(i ibi(ity. / ain3 t+e 9 ok ,inka were identified as t+e tar et community. *+e Misseriya3 as seasona( nomads3 were not e(i ib(e to vote. <owever3 t+e 'ro'osa( offered a series of 'rotections so t+at t+ose sections of Misseriya w+o traditiona((y mi rate into and t+rou + /byei /rea3 wou(d be ab(e to continue to do so3

Stron rassroots backin for t+e second o'tion stren t+ened t+e +and of t+e minority of (eaders w+o 'referred a uni(atera( referendum and t+is became t+e dec(ared o'tion. *+e conference a(so set u' t+e /byei /rea .ommunity "eferendum .ommission3 a tec+nica( body tasked wit+ overseein and im'(ementin t+e referendum3 and ado'ted ru(es and re u(ations overnin t+e conduct of t+e referendum. /(t+ou + t+e 9 ok ,inka saw t+e referendum as im'(ementation of t+e /6<4& 'ro'osa( in t+e (i +t of t+e /6&S.Ds fai(ure to do t+e same3 t+eir decision was wide(y condemned. "SS wit+drew its backin 3 t+ou + its current 'osition is3 as above3 ambi uous. Misseriya (eaders c(ose to t+e Bovernment of Sudan and (ivin in C+artoum t+reatened vio(ence.
