EO 292 TITLE IX HEALTH SECTION 3. Powers and Functions.

.The Department shall: (1) Define the national health policy and formulate and implement a national health plan within the framework of the go ernment!s general policies and plans" and present proposals to appropriate authorities on national issues which ha e health implications# ($) Pro ide for health programs" ser ices" facilities and other re%uirements as may &e needed" su&'ect to a aila&ility

of funds and administrati e rules and regulations# (() )oordinate or colla&orate with" and assist local communities" agencies and interested groups including

international organi*ations in acti ities related to health# (+) laws# (-) )ollect" analy*e and disseminate statistical and other rele ant information on the country!s health situation" and ,dminister all laws" rules and regulations in the field of health" including %uarantine laws and food and drug safety

re%uire the reporting of such information from appropriate sources# (.) Propagate health information and educate the population on important health" medical and en ironmental matters

which ha e health implications# (/) (1) 0ndertake health and medical research and conduct training in support of its priorities" programs and acti ities# 2egulate the operation of and issue licenses and permits to go ernment and pri ate hospitals" clinics and

dispensaries" la&oratories" &lood &anks" drugstores and such other esta&lishments which &y the nature of their functions are re%uired to &e regulated &y the Department# (3) (15) 4ssue orders and regulations concerning the implementation of esta&lished health policies# and Perform such other functions as may &e pro ided &y law.

SECTION 14. 6ffice for 7ospital and Facilities 8er ices.The 6ffice for 7ospital and Facilities 8er ices" headed &y an 0ndersecretary who shall &e supported &y an ,ssistant 8ecretary" shall include four (+) staff ser ices in ol ed in policy formulation" standards de elopment" program monitoring and pro ision of speciali*ed assistance in the operations of hospitals and the management of facilities" which are as follows: (1) 7ospital 6perations and 9anagement 8er ice which shall formulate and implement plans" programs" policies"

standards and techni%ues related to management impro ement and %uality control of hospital operations# pro ide consultati e" training and ad isory ser ices to field offices in relation to the super ision and management of hospital components# and conduct studies and research related to hospital operations and management# ($) 2adiation 7ealth 8er ice which shall formulate and implement plans" programs" policies" standards and

techni%ues to ensure radiation health safety# pro ide consultati e" monitoring" training and ad isory ser ices to pri ate and go ernment facilities with radiation:emitting apparatus# and conduct studies and research related to radiation health# (() 7ospital 9aintenance 8er ice which shall formulate and implement plans" programs" policies" standards and

techni%ues related to assuring the proper maintenance of Department e%uipment# pro ide consultati e" training and ad isory ser ices to implementing agencies in relation to preser ation" repair and maintenance of medical and non: medical e%uipment of the Department# and conduct studies and research related to e%uipment and facility maintenance# (+) 7ealth 4nfrastructure 8er ice which shall formulate and implement plans" policies" programs" standards and

techni%ues related to de elopment and preser ation of health infrastructure# pro ide consultati e" training and ad isory ser ices to implementing agencies in relation to infrastructure pro'ects to assure economical and efficient implementation# and conduct studies and research related to infrastructure de elopment and utili*ation.

SECTION 15. 6ffice for 8tandards and 2egulations.The 6ffice for 8tandards and 2egulations" headed &y an 0ndersecretary and supported &y an ,ssistant 8ecretary" shall include three (() &ureaus and one (1) national office that shall &e responsi&le for the formulation of regulatory policies and standards o er the arious areas of concern in the health sector" whose implementation shall &e the general responsi&ility of the Department!s regional field offices. The same &ureaus shall also &e responsi&le for those areas of acti ity co ered &y regulatory policy to pro ide the 8ecretary with current information on the status of these regulated areas of acti ity and to pro ide the 8ecretary with a &asis for preliminary e aluation of the efficiency of the Department!s field offices in performing their regulatory functions. The same &ureaus shall conduct studies and research pertinent to their areas of responsi&ility. 4n certain instances the &ureaus may also perform consultati e" training and ad isory ser ices to the practitioners and institutions in the area of regulated acti ity. The same &ureaus and national office are the following: (1) ;ureau of 2esearch and <a&oratories which shall de elop and formulate plans" standards and policies" for the esta&lishment and accreditation and licensing of la&oratories# &lood &anks and entities handling &iological products# pro ide consultati e" training and ad isory ser ices to pu&lic and pri ate la&oratories# and conduct studies and research related to la&oratory procedures and operations# ($) ;ureau of Food and Drugs which shall act as the policy formulation and sector monitoring arm of the 8ecretary on matters pertaining to foods" drugs" traditional medicines" cosmetics and household products containing ha*ardous su&stances" and the formulation of rules" regulations and standards in accordance with 2epu&lic ,ct (/$5 (13.()" as amended &y =>ecuti e 6rder ?o. 1/-" s. 131/" and other pertinent laws for their proper enforcement# prescri&e general standards and guidelines with respect to the eracity of nutritional and medicinal claims in the ad ertisement of food" drugs and cosmetics in the arious media" to monitor such ad ertisements# ad ise the Department!s field offices to call upon any erring manufacturer" distri&utor" or ad ertiser to desist from such inaccurate or misleading nutritional or medicinal claims in their ad ertising# should such manufacturer" distri&utor" or ad ertiser refuse or fail to o&ey the desistance order issued &y the ;ureau" he shall &e su&'ect to the applica&le penalties as may &e prescri&ed &y law and regulations# the ;ureau shall pro ide consultati e" training and ad isory ser ices to all agencies and organi*ations in ol ed in food and drug manufacturing and distri&ution with respect to assuring safety and efficacy of food and drugs# conduct studies and research related to food and drug safety# maintain a corps of specially trained food and drugs inspectors for assignment to the arious field offices of the Department# while these inspectors shall &e under the technical super ision and guidance of the ;ureau" they shall &e under the administrati e super ision of the head of the field offices to which they shall &e assigned" the latter &eing responsi&le for regulatory program implementation within the

geographic area of his 'urisdiction# (() ;ureau of <icensing and 2egulation which shall formulate policies and esta&lish the standards for the licensing and regulation of hospitals" clinics and other health facilities# esta&lish standards that shall &e the &asis of inspections and licensure procedures of the Department!s field offices# and pro ide consultati e" training and ad isory ser ices to field offices on the conduct of licensing and regulatory functions o er hospitals" clinics and other health facilities. (+) ?ational @uarantine 6ffice which shall formulate and implement %uarantine laws and regulations and" through its field offices" e>ercise super ision o er rat:proof *ones in designated international ports and airports and o er medical e>amination of aliens for immigration purposes.
