The article being examined here dives into U.S. Immigration law. Recently, this year, the Tenth Circuit of the United States reviewed the case United States v. Rosales-Garcia. This case involves the deportation of an undocumented immigrant who was convicted of a state drugtrafficking charge, deported, and then illegally reentered the United States. The defendant in this case brings up the argument that, before he was deported, he was imprisoned in the U.S. Mr. Rosales questioned that he had to be imprisoned prior to his deportation. The article then shifts to a more fundamental question of why the view on immigration has changed so drastically from years prior. This articles author takes the argument that deportation itself is a punishment and the addition of an incarceration to deportation is an unnecessary measure.
