Government told to shelve ruthless shoot-to-kill law


The Council of Imams and Preachers of Kenya (CIPK) has called on the government to reconsider its decision to push for the introduction of fresh drafted laws seeking to restore shoot-to-kill powers to the police. The Secretary-General, Sheikh Mohammed Dor said that the proposed law would have serious consequences for the citizens and Kenya as a country. Speaking to Friday Bulletin on Wednesday, Sheikh Dor noted that it was important before the introduction of a new legislation, that adequate and wide consultations be made with stakeholders to ensure that the new law would not turn out to be harmful to citizens. ''We appeal to the government to shelve this law and have it critically revisited as it curtails the rights and freedoms of Kenyans, including the possible return to extra-judicial killings''. Said Sheikh Dor. The former legislator pointed out that right to life was fundamental and enshrined in the constitution hence it was to be protected at all cost, adding that the shoot-to-kill law will easily be misused by police officers whenever differences arises to settle their score and even victimize innocent citizens. In the alarming proposals, police officers will be empowered to open fire and shoot-to-kill while they are protecting property, meaning property will supersede the sanctity of life. ''What is the purpose of the introduction of shoot-to-kill law? Asked Sheikh Dor. Further, in the new proposals, the President can apply to a reciprocating country for police officers to be sent to Kenya to assist in emergency situations. During the course of events initiated on the 20th April, 2011,the defendant (city of Frankfurt represented by the mayor Mrs. Petra Roth) cited section 55 sub-secton8 of the Residence Act-Discretionary Expulsion as justification for the issued order where it states that A foreigner may be expelled if his or her stay is detrimental to public safety and law and order or other substantial interests of the Federal Republic of Germany. In Press Release seen by the Friday Bulletin, it further state that A foreigner may be expelled in accordance with sub-section I in particular if he or she publicly at a meeting or by disseminating literature, endorses or promotes a crime against peace, a war crime ,a crime against humanity or terrorist acts of comparable importance in a manner conducive to disturbing public safety and order or attacks the human dignity of others by insulting, maliciously disparaging or slandering sections of the population. However after considering all circumstances at the time of this decision,the chamber which consisted of Head Judge ReutterSchwammborn, Judge Metcler, Judge Wilke, Volunteer Judge Breitkreuz and Volunteer Judge Dressler were not convinced that Dr. Bilal Philips actions in fact fulfilled any of the requirements given in section 55 through his statements during a public speech in Frankfurt, through his statements available on internet or in any other way. The court went further to say that The statements made by the claimant ([Dr Bilal Philip) are expression of freedom of speech. The validity of the defendants interpretation according to which the claimant has called for the death penalty for homosexuals is questionable. According to the court, the wording and the public statement made on 20th April, 2011 give no room for such an interpretation. Also there is no evidence that there is insincerity in the claimants statements. The Administrative Court further stated that although this opinion contradicts the values of the German constitution it is still covered by the freedom of speech. Merely the opinion that Gods law is above the states

law, does not justify any sanctions since it is not the duty of the state to judge the opinion of a party but their conduct. Disagreeing with the courts ruling, the city of Frankfurt filed an appeal to reverse this decision but the Hessicher Administrative court 3rd senate presided over by Judge Barke, Judge Lehmann and Judge Dr Ferner refused the claim of the mayor to appeal against the verdict of the court Additionally the Mayor was made to bear all ensuing costs associated with the matter. The reasons given for the courts rejection of his appeal were that, the appeal was not based on profound reasons and there are no doubts about the veracity of the challenged verdict. Generally, an appeal can be made if the court has to deal with new legal questions which have not been discussed in the previous cases, therefore the appeal of the defendant did not correspond with these requirements leading to it rejection.

Concern raised over Moyale- Marsabit clashes.


The Muslim leadership in the country has raised concerns over the ethnic clashes witnessed in Moyale and called upon the government and other stakeholders to put up measures to restore peace and harmony in the region. Speaking on Friday at Jamia Mosque Nairobi, Sheikh Ibrahim Lethome said that it was the general responsibility of all Muslims to bring about peace in the region. It is very unfortunate that some people are lacking basics needs such as food. Some are homeless as Kenya marks 50 years of independence. He said. The leaders have called upon the government to deliver on its primary role of protecting people and safeguarding property. Speaking to Friday Bulletin Lethome described the ethnic clashes in Moyale as a form of terrorism act. What is happening in Moyale is terrorism and heavy weaponry is been used in the fighting. We are calling upon the government to combat it as soon as possible. The leaders have urged all religious and political leaders to find a short term solution of cease fire for the delivery of relief and humanitarian services in the region. The leaders have also been urged to find long term solution to the conflict for the prosperity of the county as peace is essential for development. Sheikh Lethome a board member of Jamia Mosque Committee called upon those instigating and financing the clashes in the northern part of the country to stop doing so as the law will come after them sooner rather than later. On Sunday a meeting was held to discuss peace talks between the warring communities. The meeting held at Jamia Mosque Nairobi apparently ended prematurely after the representatives from the communities failed to come to an understanding as majority belonged to one community. The meeting turned chaotic after attendees engaged in a heated argument. Some stormed out of the meeting while others hurled less civilized words at each other leaving the panelist shell shocked. The panelist included Ibrahim Lethome , Sheikh Khalfan Khamis chairman of the Council of Muslim Scholars Kenya and John Githongo. The clashes between the Borana , Burji and Gabra have so far claimed dozens of lives and displaced hundreds.

Sheikh Dor stressed that human rights should be respected as enshrined in the constitution passed in 2010, adding that it is unacceptable to watch fundamental rights and freedoms that are entrenched in our constitution being violated by the state organs that are employed to protect us. The Sheikh further said the shoot-to-kill law should be withdrawn as it is inconsistent with the constitutional provisions and will be a setback for human rights and freedom in the country and should not be allowed to become law. If approved the new laws will restrict National Police Service Commission's powers provided for in the constitution and remove various measures that currently provide for the transparency and accountability of police officers. The Story of Mary and the Birth of Jesus


if thou dost see any man, say, I have vowed a fast to (Allah) Most Gracious, and this day will I enter into not talk with any human being.(Maryam 19:25) When she carried the baby Jesus to her people, they questioned her; and as a baby in her arms, Jesus gave them the answer. The Quran describes this scene in detail: At length she brought the (babe) to her people, carrying him (in her arms). They said: O Maryam! Truly an amazing thing hast thou brought! O sister of Aaron! Thy father was not a man of evil, nor thy mother a woman unchaste! But she pointed to the babe. They said: How can we talk to one who is a child in the cradle? He (the baby) said: I am indeed a servant of Allah: He hath given me revelation and made me a prophet; And He hath made me blessed wheresoever I be, and hath enjoined on me Prayer and Charity as long as I live; (He) hath made me kind to my mother, and not overbearing or miserable; So peace is on me the day I was born, the day that I die, and the day that I shall be raised up to life (again)(Maryam19:26-33) And so the baby Jesus defended his mother from any accusations of adultery, and in a nutshell, explained who he was and why he was sent by Allah. Here ends the story of Maryam and miraculous birth of one of the greatest prophets of Allah, Jesus. Such was Jesus, son of Maryam: (this is) a statement of the truth concerning which they doubt. (Maryam 19:34)

In Islam, Jesus (`Isa in Arabic) is considered one of the five greatest prophets sent by Allah to mankind. Muslims knowledge about Jesus is based on the two main sources of Islamic knowledge: the Quran and Hadith. In the Quran, Jesus is referred to as `Isa ibn Maryam or Jesus, the son of Maryam. The story of Maryam and Jesus is best described in the Quran in the surahs of Aal `Imran and Maryam. Maryam: A Precocious Girlhood The story starts with Maryam, who was blessed as a child with Allahs protection. Maryam was born to the pious household of Aal `Imran, or the family of `Imran. Many people argued for the honor of taking care of the child, but the responsibility was given to Zakariyyah, an elderly and childless man, who immediately noticed that the young girl was special. One day, Zakariyyah noticed that the girl had in her possession certain provisions for which he could not account. He asked her how she came by the food and she answered, From Allah: for Allah Provides sustenance to whom He pleases without measure.(Aal `Imran 3:37) This simple answer had a deep impact on the elderly man. Having long wished for a son, the devout Zakariyyah prayed to Allah for progeny. As the Quran relates in the verses below, his prayers were answered almost immediately, although his wife was barren and beyond childbearing age: Then Zakariyyah prayed unto his Lord and said: My Lord! Bestow upon me of Thy bounty goodly offspring. Lo! Thou art the Hearer of Prayer. And the angels called to him as he stood praying in the sanctuary: Allah giveth thee glad tidings of (a son whose name is) John, (who cometh) to confirm a word from Allah lordly, chaste, a prophet of the righteous. (Aal `Imran 3:38-39) The uniqueness of Maryam, noticed by Zakariyyah, was spelled out to her by the angels: Behold! The angels said: O Maryam! Allah hath chosen thee and purified thee- chosen thee above the women of all nations. O Maryam! Worship thy Lord devoutly: Prostrate thyself, and bow down (in prayer) with those who bow down. (Aal `Imran 3:42-43) Here the story of Maryams upbringing and girlhood, as related in the Quran, ends. The Miracle of Jesus In the surah entitled Maryam, we hear more of this special womans story, best told by the Quran itself. Relate in the Book (the story of) Maryam, when she withdrew from her family to a place in the East. She placed a screen (to screen herself) from them; then We sent her our angel, and he appeared before her as a man in all respects. She said: I seek refuge from thee to (Allah) Most Gracious: (come not near) if thou dost fear Allah. He said: Nay, I am only a messenger from thy Lord, (to announce) to thee the gift of a holy son. She said: How shall I have a son, seeing that no man has touched me, and I am not unchaste? He said: So (it will be): Thy Lord saith, that is easy for Me: and (We wish) to appoint him as a Sign unto men and a Mercy from Us: It is a matter (so) decreed. So she conceived him, and she retired with him to a remote place.] (Maryam 19:1622) From the Quranic description of events, we can deduce that Maryam spent most of her pregnancy alone. What happened to her during this period is not mentioned in the Quran. The Quran picks up the story at the moment that Maryam goes into labor. And the pains of childbirth drove her to the trunk of a palm-tree: She cried (in her anguish): Ah! Would that I had died before this! Would that I had been a thing forgotten and out of sight! But (a voice) cried to her from beneath the (palm-tree): Grieve not! for thy Lord hath provided a rivulet beneath thee; And shake towards thyself the trunk of the palm-tree: It will let fall fresh ripe dates upon thee.(Maryam 19:23-24) Allah, knowing the reaction of society, further guided her how to deal with the situation: So eat and drink and cool (thine) eye. And

Celebrating Christmas?
the walls. Nor would they send cards to everyone they know, wishing them a Merry Christmas. In such an atmosphere, there may be some who wish us a "Merry Christmas," not out of goodwill, but to provoke an argument or to embarrass us into making a response we are not comfortable with. In such a situation, we can politely decline to take the bait. Our actions throughout the year, not just at Christmas time, should show how good Muslims behave and how we are faithful to prayer and dedicate all things to the Mercy of Almighty Allah. Indeed, Christmas time is actually a time for da`wah. In a world which has lost all sense of God and which turns to alcohol and consumerism to drown its sorrows, we can show that there is a better way and that the way for all mankind to experience peace is not by kissing under the mistletoe or visiting Santa Claus in his Grotto, but by embracing Islam. Even Christmas is a time for us to tell others about Islam. Christmas should not be allowed to become a time where Muslims are being singled out as being unfriendly or not a part of the community. Indeed, we should be seen by our neighbors as full of fun and quite comfortable living with them. Showing our non-Muslim friends that Islam is a religion of peace and that we are peaceful and kind people is, indeed, at the heart of how we should behave.

In terms of celebrating feasts, it seems to me that Muslims have got the balance right. Celebrating the two great feasts, Eid al-Fitr and Eid al-Adha, means first of all going to the mosque early in the morning on the day of the feast for the Eid prayers. "Allahu Akbar," the imam begins, "God is the Greatest." When the prayers are finished, the assembled community disperses and everyone goes home to celebrate the rest of the day with the family. A lavish meal, if they can afford it, and new clothes for the children. That is the essence of a Muslim feast. What Christmas Is About Christmas, on the other hand, celebrated in December, is surrounded by so much media hype that many of the shops have begun to display their Christmas range from as early as October. After three months of "jingle bells," shoppers have had enough. The pressure on parents each year to buy bigger and better toys for their children is so great. Many have to borrow money to cope with the financial burden Christmas brings. Similarly, even devout Christians find it a scandal that obscene amounts of money are spent on food, drink, and Christmas decorations when millions in the world are starving. What, then, is Christmas about? The actual feast of Christmas, celebrated on December 25 by most Christians and on January 7 by the Orthodox, remembers the birth of Jesus (peace be upon him). In ancient times, December 25 was a feast of the pagan sun god, celebrated in Europe in the depths of winter to give hope that the cold, dark days of December would soon pass. The Churches took over this date, although nowhere it is actually recorded when Jesus was born. The feast celebrates the belief that God sent His son into the world to redeem it from the Original Sin of Adam and Eve, and Christmas is the time when Jesus was born. That, in a nutshell, is what Christmas means. Whether any of the people staggering around the streets drunk know this, is another matter. Whether the shoppers, frantically clamoring for gifts of any kind to give to relatives they hardly know, understand that this is what they are celebrating is doubtful. Most of the countries of Europe are nominally Christian and their predominant tradition is a Christian one. Christmas, as a traditional part of European and North American culture, is celebrated one way or another by almost everyone in these countries, whether or not they are church-goers or even believe in God. How Christmas Is Celebrated During the Middle Ages, almost everyone went to church. Nowadays, the majority do not. Nonetheless, Christmas has remained very much a part of these societies. For most people, it has become a time to celebrate the love of family and friends and to look back with fondness at happy memories of childhood and to a time when people did, perhaps, pray and have some belief in its power. This is one group. The other group who celebrate Christmas are devout Christian believers. For them it is a religious feast at the heart of their faith. The most important part of the celebration for them is not the turkey or the mince pies, but the religious service. Unfortunately for them, though, they are very much in a minority, and their feast has been robbed from them by the salesmen and the media. Muslims' View of Christmas Where, then, do Muslims stand in all of this? Clearly, as Muslims we do not believe that Jesus was God's son, so there is nothing for us to celebrate. That's why Christmas plays no part at all in the Muslim calendar. For this reason, Muslims would not decorate their homes, schools, or offices with Christmas trees or fairy lights or hang cards around

Muslim Youth: Strong When You Have to Be Different


By Selma Cook As Muslims living in the modern world we have to interact. Today is not a time for isolation. The world needs good people to step up and make a stand, have a voice and be a power of good, and as individuals our faith increases when we live Islam, not just talk about it. This means obtaining an education, finding a career, doing voluntary work and mixing with the people who come our way. However, this does not mean simply soaking up the attitudes and behavior of those around us. Everything has its limits and in life, we have to know ours. Once we realize that our role is to be part of what is happening around us, we have taken the first step. If there is harm or injustice we have to do our best to remove it and help make a change. How to Be Positive? If there is poverty we have to give. If there is ignorance we have to advise. And at all times we have to be patient, friendly, sincere and God-fearing. We do not live in a perfect world and it is obvious that there will be times when we will meet with ridicule, and even hostility. Unfortunately, this kind of behavior even happens within the Muslim community, especially if we are campaigning against cultural attitudes and behavior. What should we do? First, we have to keep our course. We can do this if we know ourselves; what we are trying to do and why we are doing it. Second, we have to recognize when our efforts are fruitless and be able to humbly and kindly just walk away. Third, if we have another chance to return to our endeavor, we should jump at the chance. Follow Almighty Allah's Orders Being a Muslim in todays world takes courage, insight and perseverance. Sometimes we may be tempted to give in a little and compromise but the Muslim who is close to Almighty Allah will immediately recognize that this thinking takes him far from Allah the Almighty and hence, losing the light of faith and insight. Some things should never be compromised. A Muslim should not lie, steal or harm others. We should never manipulate others, be corrupt or come near to adultery and we should steer clear of drugs and alcohol and all dangerous substances. If we do things that Allah the Almighty has prohibited us to do, we only damage ourselves, for the Creator in His mercy has outlined what is good for us and what is not. We are the losers if we bypass His wise and loving legislation. Sometimes we will meet people we really like and want to spend time with them. These people may or may not be good for us and we have to be sensitive to the changes that occur within ourselves when we are around certain people. If we have the habit of looking honestly at ourselves and what we have done each day when we go to sleep at night, we will see the influence of others on us; either in a positive or a negative way. If our goal is to draw closer to Almighty Allah and be a better person, we will automatically pull away from people who, consciously or unconsciously, are trying to take us away from Him. love us most of all, will advise us. The advice of a true friend is precious because it comes from a sincere heart. Therefore, we should listen to what they say without being overly sensitive. This takes great inner strength and control over our desires. Sometimes we will find ourselves with people that we would like to impress. However, there may come a time when they will push us to do or say something we know deep down is wrong. This is a big temptation and especially if we really like these people and value their opinion about us. At such times, we have to ask ourselves who we love more; Almighty Allah or these people. Who will come to our aid if we are in need? Them or Allah the Almighty? Who gave us all we have, and is always there for us? Them or Almighty Allah? The answers are obvious. It is Allah the Almighty who deserves our love and obedience, so if we have to make the choice, always choose Almighty Allah. He, in His mercy, may very

well send us people that we will love even more than these! The Importance of Patience Life continues, grows, develops and unfolds with patience. Without patience there will be much hesitation, uncertainty and obstacles that cannot be overcome. Patience does not mean sitting around doing nothing, and waiting for Almighty Allah to fix everything for us. Patience means making a course of action for ourselves after asking Almighty Allahs guidance, then sticking to it and persevering no matter what. That means, persevering regardless of what people might say or do. Patience undoes the most difficult problems and complex dilemmas. Patience is indeed a sign of strength and it fortifies us when we have to make a stand and keep to the course we have made for ourselves.

SUPKEM launches project to transform Muslims economic status


The Supreme Council of Kenya Muslims[SUPKEM] has launched an ambitious programme aimed at sensitizing the Muslim Community to participate in activities that will empower them economically for sustainability and self reliant. Climate change and Poverty eradication project to run for three years will be undertaken in Kakamega and Vihiga counties respectively. Speaking during the launch of the programme at Shinyalu Jamia Mosque in Kakamega County,the Western Provincial SUPKEM Chairman, Sheikh Abdi Swaleh said the socio-economic challenges being faced by the Muslims in the region were the driving force behind the initiative. Sheikh Abdi added that the region has a lot of untapped economic potential that could open a window of hope for the Muslim Community if well utilized singling out tree nurseries and seedling selling,dairy farming,bee-keeping,poultry keeping and livestock industry as some of the projects that could generate millions of shillings if tapped. At the same time Muslims were called upon to embrace the culture of collective responsibility by rehabilitating the dilapidated forest cover in the country. Sheikh Abdi warned that the countrys 18 water towers are under threat if urgent and drastic measures are not put in place to restore and conserve them in a bid to mitigate the effects of climate change,stressing that it is essential to continue conserving the forests inorder to achieve the targeted forest cover of 10 percent as stipulated in the vision 2030. Indeed all our main economic sectors like agriculture,tourism and energy depend extensively on the environment Abdi said. He further encouraged Muslims to venture into agri-business to improve their economic status and compete others in socioeconomic development for prosperity and jobs creation. The Kakamega Jamia Mosque and Islamic Centre Imam ,Sheikh Ibrahim Sadalla noted that Islam with its in depth teachings encourages Muslims to venture into halal businesses to improve on their living standard and support religious programmes like dawa and other charity activities as a way of appreciating Allah blessings. Sheikh Sadalla further pointed out that Islam was the only religion which stressed on environmental conservation, adding that Prophet Muhammad in his various teachings not only encouraged the planting of trees but also outlawed the cutting down of trees anyhowly and pollution of water points to be conscious of environment. The spiritual leaders further cautioned Muslims against the habits of selling of lands for luxuries and instead venture into zero grazing project by rearing dairy cattle for milk production in order to generate income for sustainability. Shinyalu Muslim Community resolved during the meeting to venture into dairy farming project and environmental conservation activities. Ismail Kimani who spoke on behalf of the Muslim community lauded the move and commended SUPKEM for mooting the idea adding that Muslim development programmes will be undertaken without hindrances. Sheikh Abdi pledged that SUPKEM and other development partners within two weeks would provide dairy cow to Shinyalu Muslim Community and called for unity and understanding among them for prosperity. Abdi asked for commitments and dedications for the success of the project adding that it is through this that the Muslim community would be able to prosper.

Kakamega Jamia Mosque set to be reconstructed


Muslims in Kakamega have a cause to smile after a local nongovernmental organization, the Dawa Development Group (DDG) pledged to facilitate the reconstruction of the Kakamega Jamia Mosque and Islamic Centre. This is after the Friday Bulletin highlighted the plight of the Mosque in its issue No 551 of 22nd November,2013. A multi ultra modern Masjid and what will be an architectural landmark in the town is set to replace the existing structure built in 1975. The proposed four storey complex is expected to cost over Sh 40 million and will consist of prayer halls for both men and women, spacious conference hall, ablution facilities and administration offices among other facilities. According to the chairman, Kakamega Jamia Mosque and Islamic Centre, Sheikh Abdalla Ateka the group recently met the Mosque committee and deliberated on the set up of the project, however it was agreed to give the committee more time to finalize the acquisition of title deed which is under process before the construction works commence. Ateka hailed the organization for the support stressing that the Muslim leadership would do the needful for the success of the project to benefit the Muslim community. The Dawa Development Group CEO Sheikh Musa Ismail commended the Kakamega Jamia Mosque and Islamic Centre management committee for their unity and cooperation and pledged that the organization will engage in various projects geared at improving the socio-economic and spiritual wellbeing of the local Muslims. In attendance were- Mwalimu Bakari Kweyu-[Secretary General],Nassir Mohammed (Treasurer),Mrs Amida Abdalla and Hawa Omar among others.

One Shilling Foundation goes to Kibera


In Nairobi, Kenya, 60 per cent of the population subsists in slums and squatter settlements. That 60 per cent is crowded onto only 5 per cent of the land without adequate shelter, clean water or decent sanitation. Kibera or Kibra as it is popularly known by the locals, is one of the biggest urban slum in Kenya and probably Africa. The Nubians who form the largest one ethnic unity are the majority and original dwellers of the area after the construction of the Kenya-Uganda railway line. Slums come about because of, and are perpetuated by, a number of forces. Rapid rural-to-urban migration, increasing urban poverty and inequality, insecure tenure, and globalisation all contribute to the creation and continuation of slums. Kibera slum is an area that combines to various extents the following characteristics: Inadequate access to safe water , sanitation and infrastructure; Poor structural quality of housing; Overcrowding; and Insecure residential status. The populace living in these harsh conditions are faced with myriads of challenges that range from moral degradation to acute cases of criminality and drug abuse. In an effort to revive the general upbringing of our Muslim Youth in Kibera, One Shilling Foundation in collaboration with Madrassatul Quran wal akhlaq have organised a two weeks symposium that targets close to 100 youth in the area. The Madrassa serves as a learning and tuition centre that aims at improving the lives of youth through religious training and upbringing. The target age groups are the primary graduates and form four leavers who are the victims and most vulnerable. Education is the key topic and emphasis is laid on the need of the youth from the area to acquire higher levels of education. This generally, not only reduces the risk of unemployment, it also increases the chance of obtaining a full time job with permanent contract. Thats why reducing early exits from education is an important challenge in Kibera. Scholars and educationalists have been invited to give lessons and empower the youth to positively face the daily challenges. Remedial education is also very important and emphasis is given to encourage the graduate students from the area to be of great help to the school going students. Attracting premature school leavers back into education and training is a vital element of these remedial programs. Our objective is to: -Orient the youth to cope with strange and harsh environments -Mentor them with good study habits and encourage the school quitters to learning again. -Inculcate the culture of leadership and servitude to the society -Instil the sense of identity, bonding and keep away from peer pressure and senseless intimidations We call upon the entire Ummah to develop the same concepts and let us give meaningful guiding and counselling to our children and especially now when schools have closed and parents are faced with several challenges of containing their children. We should take youth to symposiums and camps where there is a lot to be gained than lost.
