PO Box 375 Portland, ME 04112-0375 Re: GCF# 09-204 Dear Ms. Handrahan and Attorney Waxman: Please be advised that on September 14, 2009, a Grievance Commission panel reviewed the complaint in the above matter and issued its decision which I received today. Based upon that review, the panel found probable cause to believe that Attorney Michael J. Waxman had engaged in misconduct subject to sanction under the Maine Bar Rules for which appropriate discipline should be sought under those Rules. Accordingly, pursuant to Maine Bar Rule 7.l(d)(5), the office of Bar Counsel will prepare and present a formal petition for disciplinary proceedings before a different panel of the Grievance Commission. Those proceedings shall take place pursuant to Bar Rule 7.1(e). At a later date; you will receive advance notice of the time and place of hearing. Thank you.

Dear Ms. Handrahan and Attorney Waxman: Pursuant to the Maine Bar Rules, I am notifying both of you that the above-referenced Grievance Complaint is rescheduled for a confidential review by a panel of the Grievance Commission on or about November 3, 2009. You are hereby notified that the disposition recommended by Assistant Bar Counsel Aria Eee will remain unchanged, that the panel find probable cause to believe that misconduct subject to sanction under the Maine Bar Rules has occurred for which discipline should be imposed after hearing pursuant to Maine Bar Rule 7.1(d)(5). However, this is only a recommendation, and the review panel will ultimately determine the appropriate disposition, which may not be in agreement with that recommendation. In regards to that review, please understand that Assistant Bar Counsel's investigation is now concluded and closed. Consequently, no further submissions will be forwarded to the panel.
