. 2. DEFINITIONS Forthepurposesofthiscode,thefollowingdefinitionsshallapply: 2.1.ProfessionalConducttheterm"professionalconduct"shallmeantheadherencetoa standardofbehaviourbefittingaprofessionalquantitysurveyorandInstitutemember atalltimeswhileengagedinaprofessionalcapacity. 2.2.ProfessionalMisconducttheterm"professionalmisconduct"shallmeanbehaviour whichintheopinionoftheInstitutefallsshortofordirectlycontravenesprofessional conduct. 2.3.PartnershipandCorporationthewords"partnership"or"corporation"shallmean partnershipsorcorporationsofferingquantitysurveyingserviceseithersolelyorin combinationwithotherprofessionalservices,andhavingpartnersordirectorswho aremembersoftheAustralianInstituteofQuantitySurveyors. 2.4.Clienttheword"client"shallmeananindividualwhooranorganisationwhich entersintoanagreementwithamember,partnershiporcorporationfortheprovision ofprofessionalservicesonaspecificprojectorprojects. 2.5.Employertheword"employer"shallmeananindividualwhoorapartnershipor corporationwhichengagesamemberasasalariedemployee. 2.6.Secretarythewordsecretaryshallmeanthepersonappointedfromtimetotimeas thecompanysecretaryundertheAustralianSecuritiesCommissionregulations. 3. RESPONSIBILITIESOFMEMBERS,PARTNERSHIPSANDCORPORATIONS Members,partnershipsorcorporationsshall: 3.1.Provideprofessionalservicesofahighstandard. 3.2.Maintainahighprofessionalstandard,beofgoodfame,integrityandcharacter. 3.3.Competefairlywithothermembers,partnershipsandcorporationsbypromotingthe principleofselectionofquantitysurveyorsbyclientsuponthebasisofmerit,andnot onthebasisoffeesalone. NoteA:ItshallnotbeabreachofthisCodeofProfessionalConductforamember,firmor corporationtosubmit,inresponsetoanenquirybyaClientorprospectiveClient,afee
proposalfortheprovisionofprofessionalservices,providedalwaysthatsuchafee proposalformspartofasubmissionoutliningtechnicalskills,experience,resources,etc. NorshallitbeabreachofthisCodewheresuchaproposalisknowinglysubmittedin competitionwiththesubmissionsofotherQuantitySurveyors. 3.4.Conductthemselvesinamannerwhichisnotderogatorytotheirprofessional characternorlikelytolessentheconfidenceofthepublicintheInstituteorthe professionnorbringthemintodisrepute. 3.5.Promotetheadvancementofthequantitysurveyingprofession. 3.6.Informtheirclientsoremployersoftheexistenceorlikelihoodofanyconflict betweentheinterestofthemselves,theirpartnershiporcorporationorwhere applicable,anypersonalconflictofinterestrelatedtotheirassociationwiththe partnershiporcorporationandthatoftheirclientsoremployers. 3.7.Informtheirclientsoremployersifanassignmentrequiresqualificationsand experienceoutsidetheirfieldofcompetence. 3.8.Onbeingapproachedorinstructedtoproceedwithquantitysurveyingworkinrespect ofwhichthememberhasreasontobelieveservicesofanothermember,partnershipor corporationhavebeenengagedinrespectofsimilarworkbythesameclient,notify suchmember,partnershiporcorporation. 3.9.Notfalsifyormisrepresenttheirqualifications,experienceandpriorresponsibility. 3.10neithermaliciouslynorcarelesslydoanythingtoinjure,directlyorindirectly,the reputation,prospectsorbusinessofothermembers. 3.11Notsupplantorattempttosupplantanothermember,partnershiporcorporation whoorwhichhasbeenawardedacommission. 3.12Notadvertiseand/orpromotetheirbusinessinanindiscreetmanner,orinamanner whichisinconflictwithanyoftheforegoingresponsibilities. 3.13Whereholdingthemselvesouttothepublicaspracticingquantitysurveyors,have andmaintainappropriateprofessionalliabilityinsurance. 3.14UndertakeaprescribedminimumlevelofContinuingProfessionalDevelopment activities,andcertifytheircompliancetotheInstituteeverythreeyearsasnotified bytheInstitute. NoteB:NotwithstandinganythingelsewherestatedinthisCodeofProfessionalConduct, circumspectadvertisingmaybeproperlyemployedbyamember,firmorcorporationto announcehisoritspracticeandavailability. Themediaorotherformofcommunicationusedandthecontentoftheannouncement shallbedignified,becomingtoaprofessionalQuantitySurveyorandcharacteristicallyfree ofanyfactororcircumstancethatcouldbringdisreputetotheprofession. Informationgivenmustbetruthful,factual,dignifiedandfreefromostentatious, complimentaryorlaudatoryexpressionsorimplications. 3.15ItcanbereasonablyexpectedthatamemberoftheAIQSwill: Meetthestandardsofprofessionalcompetenceforthatmembersgradeof membershipasdefinedintheNationalCompetencyStandardsforQSas publishedbytheAIQS; MeettheminimumtechnicalstandardsrequiredtosuccessfullycompleteAIQS certifiedlearningprograms.
