R&R Benefits for the Affected FamiliesExtracts from the Jharkhand R&R Policy 2008

SNo 1 Policy No 7.2 Condition Any affected family owning a House and whose house has been acquired /lost Benefit Affected family may be allotted free of cost house site to the extent of actual loss of area of acquired house, not more than 10decimal of land in rural areas,not more than 5decimal of land in Urban areas. --Requiring body shall construct on the house site, a pucca house ,atleast two bed rooms,one kitchen,one toilet of carpet area of equal to 100 Sq.meter --Provided further that an affected family losing less than 10 decimal of land in rural area or 5 decimal of land in urban area, as the case may be, shall be allotted land for homestead purpose measuring at least 150 square metre, and the pucca house constructed shall have carpet area equal to the carpet area of house lost or 55 square metre, whichever is more, but limited to carpet area of 100 square metre. --If family does not want a house/Or desires to relocate elsewhere,family shall get financial assistance of Rs.3.00lacs. House of minimum 55Sq.m carpet area in rural areas/55 Sq.m in Urban area may be offered in multi stored building complex. --Providing houses to BPL families,Multi Stored Buildings may be constructed with ground coverage of maximum 50% --Affected family does not opt for a house, shall get financial assistance of Rs,2.00lacs. Each affected family shall be entitled to get 1/10th of the land loses on account of account of acquisition of land in the proposed township or adjoining to it. --land allotted will be limited to an extent of half acre. Stamp duty and other fees payable for registration of land or house allotted to the affected families shall be born by Requiring body. Page 1 of 5

Allotted land /house to the affected family,shall be in the joint names of the Husband and wife. --Monitory amount shall be distributed to a joint account in the name of Husband and wife. Shall get financial assistance of Rs.35000/for construction of shed. Shall get financial assistance of Rs.15000/for shifting the family,building materials /belongings and cattle. Shall get a financial assistance of Rs.50000/for construction of work shed or shop. Requiring body shall ensure employment in the project at the rate of atleast one eligible person per nuclear family,among those affected families. --In providing employment,top priority shall be accorded to those affected families who lost all their agricultural and homestead land --If additional employment opportunities are available, priority shall be accorded to displaced persons. --Administrator shall decide priorities in providing employment in consultation with Gramsabha and Requiring Body. Upper age limit shall be relaxed by 10Years

R&R benefits to Scheduled Tribes & Scheduled Caste Involuntary displacement of 100 or more of ST families, A Tribal Development Plan shall be prepared. Plan shall contain a programme for development of alternate fuel,fodder and Non Timber Forest Produce(NTFP) resources on non forest lands within a period of 5 Years. 1/3rd of the compensation amount due shall be paid to the affected families as a first instalment and rest at the time of taking over the possession of the land. Resettlement areas predominantly inhabited by Scheduled Tribes shall get land free of cost for community and religious gatherings. Will get 25% Higher R&R benefits as specified in policy.n.s.7.8,7.9, and 7.10 Who are in a possession of forest lands in affected area prior to the 13th day of December, 2005 shall also be eligible for R&R Benefits under the policy.

and amenities notified by the appropriate Govt. shall be provided in the Resettlement Areas. Such facilities and amenities shall include Roads,public transport,drainage, sanitation,drinking water,drinking water for cattle,community ponds, grazing land, land for fodder, plantation(social or agro forestry) , public utilities such as post offices,fair price shops..etc., Food storage Godowns, panchayatghars, Cooperative societies, Seed cum fertilizer storage, irrigation, electricity supply,health care facilities,child and mother supplemental nutritional services,Children play ground parks, community centers,schools and educational/training facilities,places of worship, land for traditional tribal institutions, service land,burial/cremation grounds and security arrangements. Affected families shall be provided basic infrastructure facilities and amities asper the norms specified by State Govt. Mandatory is that provision of Drinking water, electricity,schools,dispensaries and access to Resettlement site ., etc.are provided. Requiring body shall be responsible for development of Geographical area within 15 KM from the periphery of the project site. --Required to contribute socio economic development of the areas, for this purpose , requiring body will earmark a minimum of 1% of net profit of the project, if no profit of the Project is declared by the requiring body for that year, such minimum amount as may be determined by the State Govt. to be spent in the specified Zone. --Requiring body will carry out the developmental activity within this zone in close coordination with the Commissioner for R&R and concerned Gram Sabha. Grievance Redressal mechanism: R&R Committee at Project Level: Stae Govt . shall constitute committee under the chairpersonship of Administrator R&R

or an officer not below rank of Sub divisional magistrate, and it is called as R&R Committee --It shall monitor and review the progress of implementation of scheme or plan of R&R and carry out post implementation social audits. R&R Committee at District level: State Govt. shall constitute Standing R&R Committee at District level under the chairpersonship of DC of the district to monitor and review the progress of implementation of scheme or plan of R&R. excluding those covered by Project level committee. Tribunal: Three member Tribunal shall be appointed by State Govt. for time bound disposal of Grievances arising of matters covered by the R&R policy. Monitoring Mechanism: Sate level Council on Resettlement and Rehabilitation(SLCRR): State level council on R&R will be constituted under the chairmanship of Chief minister. There shall be monitoring committee to be chaired by Development Commissioner for reviewing and monitoring the progress of implementation of R&R Schemerelating to all Projects to which R&R Policy applies. Department of Revenue and Land Reforms , Government of Jharkhand will be Nodal Department for the State Govt, for the purpose of implementation of and execution of R&R Policy.
