EXECUTIVE ORDER NO. __________

AN EXECUTIVE ORDER RE-ORGANIZING THE MERCEDES LOCAL HOUSING BOARD ( MLHB ).

WHEREAS, Republic Act 7279, otherwise known as the Urban development & housing Act (UDHA) of 1992 mandates as a state policy the improvement of the conditions of the underprivileged and homeless citizens in urban areas and in resettlement areas by making available to them decent and affordable housing, basic services and employment opportunities; WHEREAS, Municipal Ordinance 192-2010 mandates the creation of Municipal Housing Board to serve as a clearing house for eviction and demolition activities concerning informal settlers in danger areas, public places and government projects; WHEREAS, considering the vastness of the informal settlement problems and needs for housing in the municipality there is a need to expand the powers and function of the MMHB as the local regulatory and implementing body of the provisions of the Republic Act 7279. NOW, THEREFORE, 1, ALEXANDER LO PAJARILLO, Mayor of the Municipality of Mercedes, Camarines Norte, by virtue of the powers vested in me by laws, do hereby order:

SECTION 1. Composition As provided in the M.O. 192-2010, the Mercedes Municipal Housing Board, which shall herein be referred to as the Board shall be composed of the following; Chairman Vice Chairman Members SB Chairperson on Housing and urban Development or its equivalent The Municipal Planning and Development Coordinator The Municipal Engineer or a representative from the said office A representative from a PCUP registered Urban Poor Organization A representative from a SEC registered NGO The MHHB Administrator/Manager as an Ex-Officio Member The Municipal Mayor The Municipal Vice Mayor

SECTION 2. Function & Responsibilities 2.1. To serve as the central-clearing committee of all private or government housing and resettlement projects in the municipality including the monitoring of the projects during and after its implementation; 2.2. To represent the municipal government and to coordinate with the Housing and Land Use Regulatory Board and the Housing and Urban development Coordinating Council in formulating a National Urban Development ant Housing framework, as mandated by Republic Act No. 7279 2.3. To undertake a review and rationalization of existing Municipal Land Use Plan pertaining to housing programs, and all other projects and activities of the municipal government and private sector which may substantially affect land use patterns, transportation movements; 2.4. To recommend to the municipal government a continuing inventory and identification of lands for socialized housing and as resettlement areas for the immediate and future needs of the urban poor, underprivileged and homeless in the urban areas, taking into consideration and degree of availability and proximity to job sites and other economic opportunities, and the actual number of beneficiaries; 2.5. To draft, approve and recommend to the municipal government the terms, conditions and other stipulations of contracts with landowners, beneficiaries, developers other parties relative to the implementation of the program; 2.6. To recommend to the municipal government the expropriation of idle lands in urban and urbanizable areas and the alternative scheme for the disposition of the same and other inventories or identified lands to the beneficiaries; 2.7. To design a system for the registration of qualified program beneficiaries; 2.8. To design a system that will provide opportunities for adequate consultation with the private sector involved in socialized housing and other urban development projects, as well as from program beneficiaries to be heard and to participate in the decisionmaking process over matters involving the protection and promotion of their legitimate collective interests which shall include appropriate documentation and feedback mechanisms; 2.9. To adopt measures to identify and effectively curtail the nefarious and illegal activities of professional squatters and squatting syndicates; 2.10. To adopt guidelines for the lawful and humane relocation and resettlement of persons living in danger areas such as esteros, garbage dumps, river banks, waterways, and in other public places such as sidewalks, roads, parks, and playground. Provided, that the relocation and resettlement sites shall be afforded basic services and facilities and access to school, daycare centers, and employment and livelihood opportunities sufficient to meet the basic needs of the affected families; 2.11. To promote the production and use of indigenous alternative and low-cost construction materials and technologies for socialized housing, and to device a set of mechanism including incentives to the private sector so that a viable transports system shall evolve and develop in urban areas; 2.12. To plan and regulate urban activities for conservation and protection of vital unique and sensitive ecosystem, scenic landscapes, cultural sites and other similar resource areas; 2.13. To immediately development and implement housing and development programs for all lands and areas already identified by the City Government as suitable for socialized housing; 2.14. To be at the forefront of the implementation and monitoring of RA 7279 and this Ordinance;

2.15. To formulate and adopt requisite policy guidelines and standards in the implementation of all housing projects to the approval of the local Chief Executive and/or the Sangguniang Bayan as the case may be; 2.16. To certify the selection of beneficiaries for all housing projects by the Local Government of Mercedes; 2.17. To recommend and adopt the costing and payment scheme of all amortizations payable to the municipal government effecting from all housing projects by the Local Government of Mercedes; 2.18. To coordinate and cooperate with any and all national and city government agencies, officers, and bodies in the exercise of all foregoing power, functions and areas of responsibilities.

SECTION 3. Local Housing Unit

A Local Housing Unit (LHU) is hereby established as the representative of the Board in the implementation of the policies, plans, and programs adopted by the Board\ to be headed by the Municipal Assessor as Administrator/manager or any qualified person to be appointed by the Chairman. He shall be supported by staff from various offices to handle the following functions; a. Administrative and Records Staff shall be; ( From the mayors office ) Responsible for the over-all direction and supervision of personnel; Implement policies/guidelines/ procedures related to accreditation/ monitoring/evaluation of community associations and beneficiaries; Handle the documentation of all socialized housing projects; Keep the records or files of all documents and personnel; Custodian of all properties acquired for safekeeping; Procurement and deliver all supplies and equipment needs; and Prepare Deeds of Sale and monitoring of the same.

b. Technical Planning and Development Staff shall be; ( From the Assessors office )

Identify project sites related to shelter development and land acquisition; Formulate plans and programs for upgrading specific/existing projects; Undertake the demolition of illegally constructed housing units on government and private properties and along danger zones; Prepare plans, lot surveys, on-site inspection, and (partially) supervise projects to ensure that these conform to the approved specifications and existing regulations as embodied in the local development plan.

c. Community Affairs and Development Division shall be; ( from the MSDO ) Conduct census of potential beneficiaries of the projects; Render assistance to families and associations in relation to meeting their basic needs by giving self-employment or self-help projects and cooperatives, through livelihood trainings; Prepare plans and programs/projects for the communities, NGOs and GOs in line with the administrations activities for the under-privileged. Perform all integral tasks in the implementation of policies and guidelines on the utilization and individualization of titles and housing loans.

d. Financial and Legal Services Division shall be; ( from the Accounting or Budget Office ) Provide all services in connection with the collection and servicing of loan accounts; Prepare contracts and all other documents pertinent to the award to qualified beneficiaries; Be accountable for all payments made, for updating debts by giving clearance certificates to fully paid beneficiaries.

SECTION 4

Function and Responsibilities of the LHU

It shall be the primary function of the LHU to act as the Secretariat of the Board during meetings and shall likewise perform the following;

Prepare a comprehensive settlement and housing development land use plan. Conduct an inventory of all lands and improvements within their respective localities and update the inventory every three (3) years; 4.3 Identify lands for socialized housing and resettlement areas for the immediate and future needs of the underprivileged and homeless in urban areas; 4.4 Certify the blighted (unproductive) status of lands, considered as one of the factors in the evaluation of the market value of land for socialized housing; 4.5 Identify and register all qualified socialized housing beneficiaries within their respective localities; 4.6 In pursuit of balanced housing development, enter into joint venture projects with private developers; 4.7 Facilitate the provision of basic services/facilities (potable water, power/electricity, sewerage facilities and adequate solid waste disposal system, and access to primary roads and transportation facilities) in the socialized housing or resettlement areas in coordination with concerned national government agencies and the private sector; 4.8 Establish consultative mechanisms to provide beneficiaries or their duly designated representatives the opportunity to participate in decision-making process to protect and promote their collective interests; 4.9 Adopt measures to neutralize squatting and squatting syndicates; 4.10 Implement the prescribed procedures and guidelines in the execution of eviction and demolition orders, including the provision of adequate relocation or compensation; 4.11 4.11 Resettle persons living in danger areas esteros, railroad tracks, garbage dumps, riverbanks, shorelines, waterways and in other public places such as sidewalks, roads, parks and playgrounds; Provide relocation/resettlement sites with basic services and facilities, and access to employment/livelihood opportunities sufficient to meet the basic needs of affected families; 4.12 Prevent the construction of any kind of illegal dwelling units or structures within their respective localities; 4.13 Work with the National Home Mortgage Finance Corporation (NHMFC) in initiating the organization of Community Mortgage Program (CMP) beneficiaries; 4.14 Promote the production and use of indigenous, alternative, and low-cost construction materials and technologies for socialized housing;

4.15 Submit a detailed annual status and accomplishment report. 4.16 Recommends policies, programs and proposals for the sourcing of the units operating fund. 4.17 Impose an additional one-half percent (0.5%) tax on the assessed value of all lands in urban areas in excess of Fifty Thousand Pesos (P50.000.00)

Section 5. Executive Committee. The Board shall form from its membership an Executive Committee, composed of three (3) members to represent it and act on its behalf on matters that needs immediate action and approval provided that such actions are consistent with Board approved plans and programs.

SECTION 4. Meetings The MMHB board shall meet once every two (2) months or as the need arises at such place and time as may be determined and agreed upon by the Board. The quorum shall be + 1 of the board members.

SECTION 5. Budget The Municipal budget Officer is hereby instructed to include in the annual budget an amount equivalent to 1% of its annual IRA, as provided in Section 11 of M.O. 192-2010 for the operations and activities of the Board and the LHU subject to government accounting standards.

SECTION 6. Repealing Clause All Executive Orders and municipal issuances, or any part thereof, which are inconsistent with the provisions of this order are hereby repealed or modified accordingly.

SECTION 7. Effectivity This Executive Order shall take effect immediately.
