NATIONAL ANTHEM AND PRAYER Pursuant to Section 72, Rule XI of the Provisional Rules of the House, the Members sang the National Anthem and thereafter, observed a minute of silent prayer and meditation. SUSPENSION OF SESSION On motion of Representative Arthur R. Defensor Jr., the Chair suspended the session at 4:02 p.m. RESUMPTION OF SESSION The session resumed at 4:08 p.m. with Deputy Speaker Giorgidi B. Aggabao presiding. ACKNOWLEDGMENT OF GUESTS Rep. ACKNOWLEDGMENT OF GUESTS Thereupon, Rep. Defensor acknowledged the presence in the Session Hall of the guests of Deputy Speaker Aggabao as well as of Reps. Leopoldo N. Bataoil and Neri J. Colmenares. DEFERMENT OF THE ROLL CALL, APPROVAL OF THE JOURNAL AND REFERENCE OF BUSINESS On successive motions of Rep. Defensor, there being no objection, the Body deferred the calling of the Roll, the approval of the Journal of the previous session and the Reference of Business. PRIVILEGE HOUR It being a Monday, on motion of Rep. Defensor, there being no objection, the Chair declared a Privilege Hour and thereafter, recognized Rep. Agapito H. Guanlao of Party-List Butil for his privilege speech. PRIVILEGE SPEECH OF REP. GUANLAO Rep. Guanlao delved on the issue of rice smuggling in the country which he noted threatens the existence and livelihood of rice farmers as well as the food sufficiency program of the government. He lamented that government efforts against rice smuggling have continued to fail because government officials and enforcement agencies are allegedly in cahoots with smuggling syndicates. In particular, he mentioned the accusation made by Bureau of Customs (BOC) Commissioner John Philip Sevilla that certain regional trial court (RTC) judges from Batangas, Davao and Manila have been tolerating or coddling violators of the Tariff and Customs Code as rice smuggling happens in every major port in the country. Rep. Guanlao subsequently urged: 1) the proper government agencies to review and rationalize the rice accreditation process as well as the rules and regulations of rice traders and others involved in rice trading; 2) the House to support his antismuggling measure House Bill No. 3536; 3) the government to conduct a no-nonsense investigation on the complicity of government officials, judges and enforcement agencies with smuggling syndicates; 4) the BOC to

2 execute legal actions to prevent RTCs from impinging on customs law; and 5) the Congress to review laws and policies to strengthen the governments antismuggling efforts and initiatives. Thereafter, the Chair recognized Rep. Pryde Henry A. Teves to interpellate Rep. Guanlao. INTERPELLATION OF REP. TEVES Rep. Teves discussed with Rep. Guanlao certain issues, such as the continuing price increase of rice and other basic commodities; the need for additional rice importation; and the rice smuggling controversy in the BOC involving a certain David Tan. The Chair then recognized Deputy Speaker Carlos M. Padilla for his interpellation of Rep. Guanlao. INTERPELLATION OF DEPUTY SPEAKER PADILLA Rep. Padilla centered on the persistent rice smuggling in the Philippines vis--vis the price of rice in the domestic market as well as on the need to support local farmers. In his reply, Rep. Guanlao emphasized that lack of irrigation systems, insufficient agricultural support services and inadequacy of marketing support from the National Food Authority (NFA) hinder the way to high rice production in the country. The Members then discussed how the NFAs marketing strategy intervention could be made effective. Rep. Padilla then suggested that any congressional inquiry on the matter should also focus on the reason why in spite of the high cost of rice in the country, the smugglers can still afford to sell them at a lower price. He also asked that the inquiry should ascertain the NFAs role in buying palay from the local rice farmers. INTERPELLATION OF REP. BONDOC With the indulgence of Rep. Jonathan A. Dela Cruz, the Chair recognized Rep. Juan Pablo Rimpy P. Bondoc who discussed with Rep. Guanlao his following concerns: the rice cartels control of the countrys rice industry; the meaning of the term cartel and the lack of free market for rice in the country due to high production costs and lack of government support for agriculture; and the need to revamp the current importation process which is being abused by the rice cartel.

MONDAY, JANUARY 20, 2014 Rep. Guanlao then appealed to the government to intervene in pushing for a stronger NFA so it can better regulate the prices of rice in the country. He likewise asked the Members and concerned government agencies to seriously implement the different laws and programs concerning the rice industry to ease the livelihood problems of the farmers and to solve the countrys rice problem. INTERPELLATION OF REP. DELA CRUZ Recognized by the Chair on motion of Rep. Defensor, Rep. Dela Cruz initially congratulated Rep. Guanlao for his explanation on the real culprit behind the stalled Food Self-Sufficiency Program of the government. They then discussed the following issues, among others: 1) the smuggling problem in the rice industry and Rep. Guanlaos proposal to amend the Customs law on rice importation, increase the penalties for smuggling, and strengthen the NFA; 2) the countrys total rice production, total percentage of smuggled rice and the total requirement of the country to have an affordable and accessible rice supply; 3) the BOCs tax collection on the so-called smuggled rice; 4) the governing law on the NFAs grant of authority to farmers cooperatives; 5) the rules and regulations covering the minimum access volume (MAV) and rice importation; 6) the additional support programs of the Department of Agriculture (DA) for the farmers affected by natural calamities; and 7) the assumption by the national government of the NFAs P4-billion debt. In closing, Rep. Dela Cruz underscored the need for the national government to provide the NFA and agricultural farmers with additional and necessary support considering their impact on livelihood in particular and the society in general. REERRAL OF REP. GUANLAOS PRIVILEGE SPEECH On motion of Rep. Defensor, there being no objection, the Body referred the privilege speech of Rep. Guanlao and the interpellations thereon to the appropriate Committee. EXTENSION OF THE PRIVILEGE HOUR On motion of Rep. Defensor, there being no objection, the Chair extended the Privilege Hour for 30 minutes to accommodate Rep. Leopoldo N. Bataoil from the Second District of Pangasinan for his privilege speech.

MONDAY, JANUARY 20, 2014 PRIVILEGE SPEECH OF REP. BATAOIL Upon recognition by the Chair, Rep. Bataoil recalled the repeated onslaught of natural and manmade calamities in the country, which he said highlighted the Filipino peoples resilience and ability to recover from disasters and calamities and the innate spirit of bayanihan or volunteerism by all sectors of the society. He claimed that the recent devastation caused by Typhoon Yolanda had not only enabled Filipinos to help those affected by the supertyphoon but had also provided local government units (LGUs) the opportunity to show their disasterresponse readiness and capabilities and humanitarian-relief efforts. riela Womens Party-List for her privilege speech. Rep. Bataoil informed the Body that the spirit of volunteerism is very much apparent in the humanitarian-relief efforts undertaken by the Provincial Government of Pangasinan in Dulag, Leyte where more than 100 volunteers engaged in medical missions, reconstructed school buildings, provided food and medicines and helped 11 chosen affected families resettle in Pangasinan. He thereafter proceeded with an audio-video presentation of said humanitarian relief operations. After the presentation, Rep. Bataoil stated that Pangasinans assistance to the Yolanda victims in Leyte is a long-term one and added that similar efforts must continue until the calamity victims have fully recovered from the onslaught of the supertyphoon, as well as from the earthquake in Bohol and Cebu, and the MNLF attacks in Zamboanga City.

Rep. Ilagan focused on her concerns regarding the passage of the Electric Power Industry Reform Act (EPIRA) which promised lower electricity rates for Filipino households and the industry, as well as the restructuring of the power sector that would have ushered in increased private sector participation in the generation, transmission and distribution of electricity that will pay off the debts incurred by the National Power Corporation (NPC). However, she said that 13 years after, the promised results under the EPIRA regime remains just a promise. She averred that EPIRA has driven the government into virtual inutility in the face of power rate hikes and added that the Energy Regulatory Commission (ERC) has been stripped of its powers thus failing to protect energy consumers from the profit-seeking big power industry players.

Rep. Ilagan then asked the Body to rectify the failure of the EPIRA, thus heeding public calls for relief amidst disaster, calamity and poverty, and to envision an energy sector owned and controlled by the government.

He thereafter asked Filipinos of all faith to join President Aquino and the whole nation in prayer, to thank the Lord for all the blessings He has bestowed upon everyone.
