In view of the disagreeing votes on the said House Bill, the Senate requested the House of

TUESDAY, DECEMBER 3, 2013 light of the recent Supreme Court (SC) ruling on the issue of the Priority Development Assistance Fund (PDAF). Rep. Dela Cruz then debated with Rep. Ungab regarding several aspects of the Bill, including among others: 1) certain constitutional and legal issues surrounding the measure; 2) the rationale and adequacy of the proposed supplemental budget as well as its breakdown by percentage for the services and purposes mentioned therein and for the disaster areas; 3) an indicative listing of obligations committed for the balance of the 2013 GAA amounting to P133 billion as of the end of October 2013; 4) the possible use of the Disbursement Acceleration Program (DAP) as an additional funding source of the instant measure; and 5) the amount of financial aid whether in the form of grants, loans and pledges as well as noncash assistance committed by foreign institutions and individuals for the rebuilding of calamity-stricken areas. The Sponsor promised to give Rep. Dela Cruz a copy of the report on the actual noncash assistance received by the government in behalf of the calamity victims, and also stated that data and figures on the foreign aid commitment or pledges in cash and noncash can be accessed at the government website called Foreign Aid Transparency Hub (FAITH). In addition, Rep. Dela Cruz further sought clarification on the funds allocated and spent for the reconstruction and rehabilitation of the victims of Typhoons Yolanda, Odette, Labuyo, Sendong, Pablo, Santi and Vinta, the 7.2-magnitude earthquake in Bohol and Cebu, and the siege of Zamboanga City. This, as he emphasized the failure of pertinent government agencies comprising Task Force Typhoon Yolanda to provide the Committee on Appropriations with a copy of their rehabilitation plan necessary in the deliberations of House Bill No. 3423. Rep. Dela Cruz similarly took exception to Rep. Ungabs statement that Congress must not dilly-dally in approving the measure because a days delay has grave results to the victims of the devastating calamities. He then shared his view on how the proposed supplemental budget being declared unconstitutional by the Supreme Court would constitute a graver crime against the victims of calamities. He stressed that he wanted answers to his questions especially as he has just received a copy of a Philippine Center for Investigative Journalism (PCIJ) report claiming the questionable validity of thousands of Special Allotment Release Orders (SAROs) issued by the Department of Budget and Management (DBM) for the years 2010 and 2011.

RESUMPTION OF SESSION The session resumed at 4:14 p.m. UNFINISHED BUSINESS: COMMITTEE REPORT NO. 8 ON HOUSE BILL NO. 3423 On motion of Rep. Jorge Bolet Banal, there being no objection, the Body resumed consideration on Second Reading of House Bill No. 3423, as contained in Committee Report No. 8 and reported out by the Committee on Appropriations. Upon direction of the Chair, the Secretary General read the title of the Bill, to wit: AN ACT APPROPRIATING THE SUM OF FOURTEEN BILLION SIX HUNDRED MILLION PESOS (P14,600,000,000) AS SUPPLEMENTAL APPROPRIATIONS FOR FY 2013 AND FOR OTHER PURPOSES. Rep. Banal stated that the parliamentary status was that the Bill was still in the period of sponsorship and debate, with Rep. Jonathan A. Dela Cruz interpellating the chairperson of the sponsoring Committee, Rep. Isidro T. Ungab. The Chair thereafter recognized Reps. Dela Cruz and Ungab to continue with their debate. INTERPELLATION OF REP. DELA CRUZ After noting that House Bill No. 3423 is a consolidation of several measures and resolutions in response to all the recent calamities that had ravaged the country, Rep. Dela Cruz maintained that it is a significant measure that should have undergone public hearings not only at the Committee level but by the full membership of the House, especially in

Gonzales, there being no objection, the Body resumed consideration of House Bill No. 3423 and the Chair recognized Rep. Dela Cruz anew to continue with his interpellation of Rep. Ungab. INTERPELLATION OF REP. DELA CRUZ (Continuation) Rep. Dela Cruz explained that he did not wish to obstruct the proceedings, but to ask for more money if the proposed supplemental budget is inadequate and to ensure that the people are not being given false hopes. Rep. Ungab said that despite wanting to augment the additional appropriation, he was limited by what the National Treasury had certified as available and unappropriated funds. MOTION OF REP. BARZAGA Upon recognition by the Chair, Rep. Elpidio F. Barzaga Jr. pointed out that the Body had given Rep. Dela Cruz sufficient time to interpellate since the previous days session. He invoked Section 55 of the Provisional House Rules and moved that the Chair order his colleague to desist from speaking further so that other Members could interpellate the Sponsor. The Chair motu proprio suspended the session at 5:48 p.m. RESUMPTION OF SESSION The session resumed at 5:51 p.m. WITHDRAWAL OF REP. BARZAGAS MOTION Upon recognition by the Chair, Rep. Barzaga withdrew his previous motion. MOTION OF REP. BARZAGA Rep. Barzaga instead moved that the Body close the debate on House Bill No. 3423 and proceed to its approval on Third Reading. The number of speeches in favor and against it, he explained, had already been complied with in accordance with Section 54 of the Provisional House Rules. SECONDING MOTION OF REP. EVARDONE Upon recognition by the Chair, Rep. Ben P. Evardone seconded the motion. OBJECTION OF REP. ATIENZA Objecting to the motion, Rep. Jose L. Atienza Jr. asked for more time for deliberations and interpellations and said his own would not be lengthy and redundant. He remarked that he did not want the Members differences to deepen. REMARKS OF REP. BARZAGA Rep. Barzaga clarified that the Majority was not railroading the proceedings and had given sufficient time and opportunity for interpellations. He said that he understood Rep. Atienzas position on the motion but that the Members could only express theirs by voting on it. VIVA VOCE VOTING ON REP. BARZAGAS MOTION Thereupon, the Chair called for a viva voce voting on Rep. Barzagas motion, and with the majority of the Members voting for it, the same was carried. TERMINATION OF THE PERIOD OF SPONSORSHIP AND DEBATE On motion of Rep. Gonzales, there being no objection, the Body terminated the period of

8 sponsorship and debate on House Bill No. 3423 and proceeded to the period of amendments. COMMITTEE AMENDMENTS On motion of Rep. Ungab, there being no objection, the Body approved on page 1, lines 4 to 7, Section 1, between the words therein and for, to delete the comma (,) and the remaining phrase starting with the word for up to the word activities. PROPOSED COMMITTEE AMENDMENT Rep. Ungab then proposed on the same page, lines 9 to 10, Section 2, after the word for, to replace the phrase starting with the word the up to the word activities with the phrase RELIEF AND REHABILITATION SERVICES AND THE REPAIR, REHABILITATION AND RECONSTRUCTION OF PERMANENT STRUCTURES, INCLUDING OTHER CAPITAL EXPENDITURES FOR DISASTER OPERATIONS AND REHABILITATION ACTIVITIES. QUERY OF REP. DELA CRUZ Upon recognition by the Chair, Rep. Dela Cruz asked how the pertinent provision would read as amended. Rep. Ungab said the entire Section 2, as amended by the Committee, would read as follows: Sec. 2. Use and Release of Funds. The amounts appropriated herein shall be used for RELIEF AND REHABILITATION SERVICES, AND THE REPAIR, REHABILITATION AND RECONSTRUCTION OF PERMANENT STRUCTURES, INCLUDING OTHER CAPITAL EXPENDITURES FOR DISASTER OPERATIONS AND REHABILITATION ACTIVITIES in areas affected by disasters and calamities, including but not limited to the areas devastated by typhoons Labuyo, Odette, Pablo, Sendong, Santi and Vinta, the siege and unrest in Zamboanga City, the magnitude 7.2 earthquake in Bohol and Cebu, and the massive onslaught of super typhoon Yolanda which severely hit the Central Philippines, including Leyte, Eastern Samar, Capiz, Aklan and the northern areas of Cebu, Iloilo and Palawan. Releases from this Fund shall be made by the Department of Budget and Management (DBM) directly to the appropriate implementing agencies in accordance with the approval of the President of the Philippines, which shall consider the recommendation of the National Disaster Risk

TUESDAY, DECEMBER 3, 2013 Reduction and Management Council. REMARKS OF REP. GONZALES With the permission of the Chair, Rep. Gonzales informed the Body that each and every Member was provided a copy of Committee Report No. 8 on House Bill No. 3423, which contained on pages 3 and 4 thereof the Committee amendments approved by the Committee on Appropriations. He stated that once the Body approve said Committee amendments, the measure or the particular section which is sought to be amended by the Committee will then read as provided for in the approved version of House Bill No. 3423 by the Committee. Whereupon, Rep. Ungab moved for the approval of the amendment on Section 2. There being no objection, the motion was approved. COMMITTEE AMENDMENTS (Continuation) As further proposed by Rep. Ungab, there being no objection, the Body approved the following Committee amendments: 1. On page 1, Section 2, line 10, between the words calamities and including, to insert the phrase BOTH NATURAL AND MAN-MADE; 2. On the same page, Section 7, line 18, between the words effect and its, to delete the phrase fifteen (15) days following and in lieu thereof, to substitute the word UPON. TERMINATION OF THE PERIOD OF COMMITTEE AMENDMENTS There being no other Committee amendments, on motion of Rep. Gonzales, there being no objection, the Body terminated the period of Committee amendments.

TUESDAY, DECEMBER 3, 2013 INDIVIDUAL AMENDMENTS Thereafter, on motion of Rep. Gonzales, there being no objection, the Body considered individual amendments. PROPOSED AMENDMENT OF REP. DELA CRUZ Considering the appointment of the President of a new rehabilitation czar, Rep. Dela Cruz proposed on page 2, Section 2, line 7, to insert the phrase AND THE NEWLY APPOINTED REHABILITATION CZAR. The Sponsor stated that the Committee cannot accept the proposed amendment, explaining that the House has not yet officially received a communication from the Executive Department regarding the appointment of former Senator Panfilo Lacson as the rehabilitation czar. He said that if said appointment would be made official, the Senate could make the necessary amendments considering that the measure would be transmitted to the Senate once approved by the House. With the permission of the Chair, Rep. Dela Cruz asked why the Sponsor cannot accept his proposed amendment considering that the President has already appointed former Senator Lacson as the rehabilitation czar which the latter has accepted and has in fact already made consultations with the urban planners and architects. REMARKS OF REP. GONZALES At this point, Rep. Gonzales informed the Body of the parliamentary status of the Bill wherein the Sponsor had rejected Rep. Dela Cruz proposed individual amendment. He then inquired on the intention of Rep. Dela Cruz. APPEAL OF REP. DELA CRUZ As he wanted the Body to vote on his proposed amendment, Rep. Dela Cruz however expressed hope that the Committee would accept his proposed amendment considering that it was well publicized that former Senator Lacson had already accepted the position and would eventually implement the rehabilitation plan being considered for funding under the supplemental budget. Rep. Gonzales inquired whether Rep. Dela Cruz was appealing his proposed amendment to the Body which the Sponsor did not accept. Rep. Dela Cruz replied in the affirmative. Evardone considering that the National Disaster Risk Reduction and Management Council (NDRRMC) would provide the necessary plans and programs for rehabilitation in accordance with the approval of the President. He pointed out that the Sponsor also mentioned earlier that all the plans, programs, and projects will be consolidated at the level of the NDRRMC and that he does not understand why the Committee would exclude said agency as far as the implementation of the rehabilitation is concerned. QUERY OF REP. GONZALES Rep. Gonzales stated that the parliamentary status was that Rep. Evardone had proposed an individual amendment which was accepted by the Sponsor. He then inquired whether Rep. Dela Cruz on House Bill No. 3423, Rep. Rufus B. Rodriguez manifested and underscored several issues, to wit: 1) that the measure conforms to the provisions of the Constitution and processes of budget-making and program funds; and 2) that Congress can immediately respond and act on the needs of the people. EXPLANATION OF VOTES The following Members explained their votes: 1. Rep. Luzviminda C. Ilagan voted no to the measure on the ground that: 1) House Bill No. 3423 rationalizes the use of supplemental appropriations without the requisite safeguards that funds will directly benefit the affected victims and will not be subject to graft and corruption; 2) it allows the use of lump-sum appropriations for the discretion and use of the President in contravention of a recent Supreme Court decision on the use of public funds and on public accountability; and 3) it does not provide for a clear program of expenditures that will guide the disbursement of public funds for rebuilding and rehabilitation. 2. Rep. Ben P. Evardone explained that the approval of the measure signified the collective intent of the Body to bring needed relief, aid and hope to the victims of the recent calamities. 3. Rep. Felix William B. Fuentebella enumerated the following reasons for his affirmative vote: 1) that the measure conformed to the provisions of the Constitution, specifically Section 29 (1) of Article VI; 2) that it signified the resolve of Congress to respond to the immediate needs of the victims of calamities; and 3) that Members of Congress, specifically, the Members of the Minority, would exercise the duty of oversight functions to ensure that disbursements of funds will be in accordance with law. He commended the Members and the Committee on Appropriations for deliberating and acting on the measure. 4. In explaining his affirmative vote, Rep. Roy V. Seeres Sr. explained that while Congress is mindful of the plight of the victims of Typhoon Yolanda, it has forgotten the continuous prejudicial conditions and adverse labor status of 10 million overseas Filipino workers (OFWs), particularly the

He expressed hope that Congress will take cognizance of the plight of OFWs and that the President will provide the required support to the Department of Labor and Employment and the Department of Foreign Affairs. 5. Rep. Neri J. Colmenares explained that his negative vote was premised on two substantial issues, namely: 1) the absence of concrete rehabilitation program and details of expenditures for Congress to provide supplemental appropriations to victims of Typhoon Yolanda and other natural and man-made calamities, and 2) that the supplemental appropriations was apparently a form of presidential pork and subject to the sole discretion of the President considering the deletion of the provision in the measure allowing the NDRRMC to recommend specific budgetary allocations for disbursement to provinces and localities affected by calamities. He opined that the supplemental appropriations will not equitably and effectively go to the victims of these calamities 6. Rep. Antonio L. Tinio explained that he voted against the measure inasmuch as he did not want to be part of the travesty of the principle of checks and balances in government by providing full authority to the President to spend the P14.6 billion supplemental appropriations without a concrete rehabilitation plan and required budget of expenditures. He maintained that this was a violation of the congressional power of the purse and the duty of Congress to ensure check and balance against the Executive Department. He subscribed to Rep. Colmenares opinion that House Bill No. 3423 was a form of presidential pork, and also cited the constitutional issues he had raised in his interpellation regarding the procedure followed in enacting the supplemental budget measure. Rep. Tinio stated that he raised his concerns because he wanted to make sure that every single centavo would go to the victims of calamities. He said that because he was not sure where the calamity fund would go, he was voting no to the measure. 7. In explaining his affirmative vote, Rep. Celso L. Lobregat said that inasmuch as he would have wanted an accounting of the calamity funds, he knew that it could not be done at this point in time considering that there were still many things to be decided upon. This, as he clarified that his district which was hit by a man-made calamity, has yet to come up with a plan on how to rebuild a better community. 8. Rep. Tupay T. Loong voted in favor of the measure because he believed that this was the only

15 way for each Member to express their sympathy to all the victims of natural and man-made calamities. TRANSMITTAL TO THE SENATE OF HOUSE BILL NO. 3423 Thereafter, on motion of Rep. 16 QUESTION OF PRIVILEGE OF REP. UMALI (R.) Upon recognition by the Chair, Rep. Umali rose in defense of a colleague; the House of Representatives Electoral Tribunal (HRET); and the Philippine Constitution. Rep. Umali enumerated instances in defense of the Constitution, against judicial despots involving the Supreme Court and its members who callously disregard long established principles of law and jurisprudence, in complete disrespect for the separate and independent powers of coequal branches of government through flip-flopping decisions. He then cited the high Courts final disqualification of Rep. Regina Ongsiako Reyes as a Member representing the Lone District of Marinduque. He discussed the hasty dismissal of Rep. Reyes petition for certiorari notwithstanding her proclamation by the Commission on Elections (Comelec); the view that the HRET should have decided on the case; the allegations of vested interests in the disqualification; and the constitutional dilemma and legal absurdities arising from the decision. In conclusion, Rep. Umali said that the judiciary should not be allowed to violate principles of law and jurisprudence and democratic doctrines or to emasculate the powers of Congress and the Executive. Impeachment complaints could be filed against it if does not rid itself of despots, he stressed. On motion of Rep. Sherwin N. Tugna, the Chair subsequently recognized Rep. Lobregat for interpellation. INTERPELLATION OF REP. LOBREGAT Rep. Umali agreed with Rep. Lobregat that the recent Supreme Court decision on the PDAF was a man-made calamity which affected the country more strongly than the recent typhoons and earthquakes. Both Members then discussed the flip-flopping decisions and rulings of the Supreme Court particularly declaring previously the Countrywide Development Fund (CDF) and the PDAF as constitutional and now overturning its own ruling when it declared the PDAF and other lump-sum appropriations as unconstitutional. Rep. Lobregat stressed that the decision of the Supreme Court declaring the PDAF as unconstitutional rendered the legislators as helpless considering that their constituents expect them to bring projects and development to their districts.

TUESDAY, DECEMBER 3, 2013 For his part, Rep. Umali urged his colleagues to fight for the powers and the mandate of Congress and take action, through the power of impeachment, against certain magistrates of the Supreme Court who are accountable for betrayal of public trust and violate the principle of separation of powers. Thereafter, on motion of Rep. Tugna, the Chair recognized Rep. Terry L. Ridon for his interpellation. INTERPELLATION OF REP. RIDON Rep. Ridon discussed with Rep. Umali the despotism of the Supreme Court particularly the discretionary use of its funding known as the Judiciary Development Fund (JDF). The latter stated that the Supreme Court spoke with unclean hands with regard to accountability and responsibility in the use of public funds, pointing out that the Supreme Court too has its own pork barrel system in the form of the JDF which the Chief Justice solely administers. They agreed that the fund should also be declared as unconstitutional and that Congress, through its oversight functions, should look into the matter of the JDF which can be repealed as it was created by a presidential decree. MOTION OF REP. TUGNA Thereupon, Rep. Tugna moved for the referral of the speech of Rep. Umali, together with the interpellations thereon, to the appropriate Committee. MOTION OF REP. LOBREGAT Before the Body could act on the motion, Rep. Lobregat moved for the suspension of the interpellation on the speech of Rep. Umali as other Members might like to interpellate the latter the next day considering the importance of the issue. WEDNESDAY, DECEMBER 4, 2013 SUSPENSION OF SESSION On motion of Rep. Tugna, the Chair suspended the session at 4:22 p.m. RESUMPTION OF SESSION At 4:45 p.m., the session resumed.

Representative Sherwin N. Tugna, moved that the Body proceed to the Additional Reference of Business. There being no objection, the Chair thereafter directed the Secretary General to read the titles of the Bills and Resolutions on First Reading, including the Subpoena Duces Tecum. REP. ATIENZAS QUESTION OF QUORUM Upon recognition by the Chair, Rep. Jose L. Atienza Jr. however remarked that the Body was proceeding to the Order of Business without even calling the Roll of Members to determine the presence of a quorum pursuant to Section 74 of the Provisional Rules of the House. He then questioned the quorum. SUSPENSION OF SESSION On motion of Rep. Tugna, the session was suspended at 4:01 p.m. RESUMPTION OF SESSION The session resumed at 4:17 p.m., with Rep. Jorge Bolet Banal presiding. ACKNOWLEDGMENT OF GUESTS In the meantime, Rep. Oscar Richard S. Garin Jr. acknowledged the presence in the Session Hall of guests of Reps. Walden F. Bello, Leah S. Banal, there being no objection, the Body designated the following Members as House conferees to the Conference Committee to reconcile the disagreeing provisions of House Joint Resolution No. 7 and Senate Joint Resolution No. 5, entitled: JOINT RESOLUTION EXTENDING THE VALIDITY OF APPROPRIATIONS UNDER THE CALAMITY FUND AND QUICK RESPONSE FUND, INCLUDING THOSE SOURCED FROM SAVINGS REALIGNED IN THE CURRENT YEAR, AS WELL AS ALL UNOBLIGATED ALLOTMENTS AND UNRELEASED APPROPRIATIONS FOR MAINTENANCE AND OTHER OPERATING EXPENSES AND CAPITAL OUTLAYS UNDER REPUBLIC ACT NO. 10352 OR THE FY 2013 GENERAL APPROPRIATIONS ACT UNTIL DECEMBER 31, 2014, AMENDING FOR THE PURPOSE SECTION 63 OF THE GENERAL PROVISIONS THEREIN: Reps.
