2010 Florida Building Code - Effective
March 15, 2012 All Building Plans
Submitted must comply to this Code
Responsibilities
The building Department is responsible for
administering and enforce all ordinances
applicable to building, construction, blasting,
and explosives as defined in the Monroe County
Code.
Building officials are charged with administering
and ensuring compliance with building codes.
They issue building and construction permits
and certificates of occupancy and supervise
blasting within the county.
Inspections
Inspectors are assigned to county offices in
Marathon and Key Largo. At specified stages
during building construction, the
builder/contractor must request an inspection.
Inspections are necessary before proceeding
with construction and prior to the issuance of a
Certificate of Occupancy.
Mission Statement
The mission of the Building Department is to
protect public health and safety, property, and
the environment by providing an efficient,
effective, and considerate permitting and code
administration system, in accordance with the
Monroe County Code and Florida statues that is
consistent with and furthers the Monroe County
Plan.

your staff regarding my clients, Thomas A. Mulhall and Kimberly S.
Bassett, the owners of the residential property located at 1 Palmetto
Drive, Big Coppit Key, :Monroe County, Florida. I am also in receipt of the
August 23, 2012 oflntent to Record Lien sent to m.y client.
As you are a"""-are, my clients' residence was rendered uninhabitable
due to hUITicane flood damage in October 2005. The residence had been
my client's declared homestead. Shortly thereafter, my client began the
arduous process of obtaining the necessary permits from Monroe Cotu1ty,
Florida to rebuild their residence. In the interim, my clients did not
claim. a Homestead exemption for any other residence since it was and is
their intention to rebuild the Big Coppit residence.
In both September and October o2006, Mr. Mulhall met with
l\'lonroe Cotmty Building officials including Dianne Bair, to discuss my
clients' plans to construct a self-supported second story in order to raise
the living quarters above flood level .
. i\lthough my clients believed that they had reached an amicable
understanding :r.-ls. Bair, my clients' confirming letter was met """1:th
strenuous objection by Ms. Bair in her letter of November 6! 2006, a copy
of which I have attached for your review.

In mid 2007, 1\'Ir. Mulhall once again met with Ms. Bair whose final
recommendation, because of the fifty percent rule, was that my clients
repair the structure to its pre-storm configuration and then, t\vo years
thereafter, make application to elevate the structure. Thereafter, !VIs.
Bair did not return my clients' telephone inquiries or respond to their
attempts to set another appointm.ent to discuss the issues.
Because of this impasse, Mr. Mulhall and Ms. Bassett contacted me
in December of 2008 to discuss what legal options they might have that
would allow them to proceed "i.th the reconstruction of their homestead
residence. On December 23, 2008, I first attempted to contact Ms. Bair
telephonically but receive no reply. Finally, on Aprll 27, 2009, I was able
to speak with Ms. Ba.ir directly regarding the facts and issues and our
need for a complete copy of her file regarding my clients' residence and
proposed construction. I confirmed our telephonic conversation the sa.m.e
day by a facsimile, a copy of which is attached for your

Since the cost oflitlgation to contest Ms. Bair's obstructive opinion was
cost prohibitive, my clients chose to wait to see if Monroe County's
position would change. nus "wait and see" approach was supported by
l\fr. Mulhall's conversation with Joe Paskalik, the 1v1onroe County
Building Official, who opined that my clients patience would likely be
rewarded since !vis .. Bair was soon retiring.
As discussed with your staff, under the facts of this case and in
view of the clear language of Section 196.131 (6), Florida Statutes, my
clients should be entitled to their Homestead Tax Exemption through
December 31, 2008. In an abundance of caution, I have advised my
clients to pay the arrearage claim.ed by your office for 2009, 2010 and
2011. My clients have also applied for their Homestead property tax
exemption for 2012 for their Marathon residence.
Based upon the foregoing, I would appreciate your reconsideration
of your decision to -rn.cate my clients' Homestead tax exemption for 2007
and 2008. I believe that the facts 'varrant its reinstatement.

I am in receipt of your letter dated November 1, 2006 regarding our meeting where
we discussed non-substantial improvements and repairs to pre-FIRM buildings.
First, the conclusion in your item number I. is not correct. Pursuant to the Monroe
County Code, the ONLY time you can add 20% is in conjunction with the Monroe
County Property Appraisers depreciated building value, but not in conjunction with
a cost approach appraisals depreciated building value. I would like to point out that
the valuations listed in the year by year column on the property record card are not
depreciated values and 20% cannot be added to that figure. You may have to ask
the property appraiser for the depreciated building value, it used to be listed on the
bottom of the property record card as "depreciated building value", but I have not
seen it listed lately.
Second, if you submit a cost approach appraisal that is accepted by the building
official, you may not amortize it. You may be able go back to the appraiser and see
if he is able to give you an appraisal that establishes the depreciated building value
prior to I 0/24/06, but there is no procedure providing for amortization.
The conclusion in your item number 2. is not correct. You state that it is your
understanding that any new building to be done on the property, of an independent
structural building up and over the existing building will not be counted in the 50%
rule calculations. All vertical improvements must be counted. Only LATERAL

additions, structurally independent and elevated to the correct base flood elevation,
(NOT up and over) are not counted in the 50% calculations.
As we discussed only one application for the repair and addition should be
submitted. The combination of repair or renovation and addition is known as a
rehabilitation. It should NOT be done by separate permits. You will need to
submit a completed cost breakdown along with engineered plans for the repair and
rehabilitation. Also, you will need a ':Proof of Loss" form from you insurance
company. There is no fonnat with which to submit a cost approach appraisal,
simply submit the cost approach appraisal with your permit application. We will
send it to the Building Official for approval. If he does not accept the appraisal, the
Monroe County Code provides you with the right to pay for a third party
independent appraisal prepared by an appraiser chosen by the Building Department.

Here are two of the reports that have been submitted on Mulhall, I was mistaken on my year, it was 2008. There are
numerous reports indicating that he has been playing a game with his address, which stopped when I went to the S.A.O.
to write up a warrant.
I do recall him living at the Palmetto address in 1997 or 1998 when he was arrested by Federal agents after his house
being hit on a search warrant for Child Porn, which is why he has a Sex Offender status now.
Back then he and Kim where living on Palmetto, I believe they lived there until she was promoted to her current position
with Fisherman's in Marathon, but at his own word, the house on Palmetto was destroyed during Wilma.

1 came into the unit in 2007 and Mulhall was residing in Marathon then, he was trying to play the" I go between
residences and don't live in one or the other more". We nailed him down in 2007 as living in Marathon and at that time I

had also obtained sworn statements from neighbors that indicated that he had not been living on Palmetto for some
time.
I JUST did his address verification about four months ago, and he is still living in Marathon.
It is my understanding that his house on Palmetto was declared uninhabited after Hurricane Wilma.

This was a follow up to the sex offender sweep that was prefonned. Mr. Muhall's residence on 1 Palmetto
Is uninhabitable due to Willa. He was advised that he needed to change his primary residence for FDLE to his temp
house at Faro Blanco. He stated he did not know that he needed to do this due to both are on the fonn. I explained
that since he Is residing at the Faro Blanco for more than 5 days that this becomes his primary residence.
Mr. Muhall has changed his residence to Faro Blanco.
1 request that this case be CLOSED due to it was a follow up and explained what needed to be done for
Mr. Muhall to be in compliance.

On March 20th a meeting with A.S.A. Val Winte,. was arTanged and the particula,. of this case were presented to
him by this Investigator and Sgt. Dally. It was determined by A.S.A. Winte,. that Mulhall would be prosecuted If he

Detective Mashburn then made contact with Mulhall and advised him of his violations , giving him until March 24,

On March 14, 20081 met with Mr. Mulhall at his residence of 1998 Overseas Highway Unit A33 In Marathon
Florida. I went over our Sex Offender Address Verification Form as I was filling out the form I had arrived to the
question of how long did he live at his current address. He advised that it was 11/2 years since Wilma. I asked
which address was he stating, he stated this one In Marathon. As we spoke he stated that he had both addresses
listed that the one in Key West was being renovated and that it was uninhabitable. I then stated that since he was at
the address in Marathon that this should be his permanent one. He stated that he was going to change but did not
think he had too. 1 advised him that he needed to. Mr. Mulhall stated that we knew where to get a hold of him and
that he did not appreciate the letter of contact that we put at both address to have him get In contact with us. I
advised him due to him not being at either residence that we posted the letter to assist him and us to verify his
residence. Mr. Mulhall stated that he was going to do this because he wanted to be in compliance.
On March 20, 2008 I went to 1998 Overseas Highway A33 the residence of Mr. Mulhall, at this time he was
not at his resident I than attempted to contact him via phone. I did reach a partner in his business and was
advised that he was with a customer. I gave my name and my cell phone number for Mr. Mulhall to contact me.
About 20 mins latter Mr. Mulhall contacted me on my cell. I advised him that we presented his case of temporary vs
permanent to the State Attorney's Office in Key West I advised him that he was In violation and that he had ti11500
hrs on Monday the 24th to change his Florida DL and to go to the Jail and change his address on the registration
fonn. He state that before it was no problem. I advised him we received clarification via SAO and FDLE and If he
did not comply that we would proceed to get a warrant for his arrest. At this time Mr. Mulhall stated that he wanted
to be in compliance and that he would do both. At this time we are waiting for Monday the 24th to see if Mr. Mulhall
complies.

Narrative
On March 21, 2008 this Investigator attempted to make contact with the occupants of the homes surrounding
Mulhall's at #1 Palmetto Drive on Big Coppitt Key .
The occupant of 149 Palmetto Drive Is an elderly man who stated that Mulhall lived In Marathon since his home had
been damaged In Hurricane Wilma, but did not want to give a statement.
The care giver of #49 Palmetto Drive was identlfled by this Investigator as Kathleen Harper , she stated to this
investigator that Mulhall did not reside at #1 Palmetto Drive since at least Hurricane Wilma.
The residence to the left of #1 Palmetto Drive, is marked at #49 Palmetto Drive, although there were many cars in the
driveway , no one would answer my knocks at the door. A note was left taped to the door asking that the occupant
call me In reaards to my Investigation.

The residence just to the right of Mulhall's is closed up with the storm shutters in place and a chain across the
driveway.
The residence across the street Is marked as #48 Palmetto Drive , the family residing there was their vehicle packing
for vacation , but stated that they had lived in the residence for over a year and that they have not seen the house
occupied in that time period. A sworn statement was provided by Krystal Kane , her statement Is as follows: "1 have
lived at 48 Palmetto Dr since Mar 07 and has never seen anyone come In I out of the house across the street Since
I've lived her with my husband.
I then made contact with the residence numbered as #47 Palmetto Drive ,and spoke to the adult female who
answered the door. As soon as I identified myself to her as a detective with the Sheriffs Office Crimes Against
Women and Children's Unit, she stated that I must be there in regards to the registered sex offender who owns the
house near hers, and pointed towards the Mulhall's residence. The female then stated that she had seen the photo
of Mulhall on the Florida Sex Offender Registry , but that she hadn't seen him in the area since Hurricane Wilma. I
asked her to provide a sworn written statement and she advised that she would have to consult with her husband
first as she was afraid of retaliation from Mulhall . I left a business card with her in the event that she wanted to
complete a statement form.

I re-read the article and realized it may be referring to a different property. I have attached the article for your
reference. I guess the "saltponds" refers to 3635 Seaside. Thomas Mulhall's wife, Kim Bassett, owns unit 411. I had a
twilight zone moment when I did a check to see if Ms. Bassett still owned the property, but accidentally entered unit
418 ..... owned by a John Pekarik!! I did a double take when I saw the last name! The property with the homestead
exemption is 1 palmetto dr., so you can ignore my comment regarding the article. Sorry for any confusion.
Anyway, considering Mr. Mulhall is a registered sex offender, I would hope your local law enforcement agency has the
correct history of where he has lived for the last 6-7 years. He and his wife, Kim Bassett, have been reporting 1998
Overseas as their mailing address since 2006- even for payment of their property taxes. Having a mailing address
different from the homestead exemption address for more than a year should be an automatic red flag.

6. Affor4able Housing. The Property shall contain 108 pennanent dwelling units as
affordable housing. For the purpose of this Agreement, "affordable housing" shall mean a pennanent
dwelling unit, which will be of the same size, materials of construction, fixtures and equipment as the
other units pennitted within SaltPonds, a Condominium. This Unit is an affordable housing unit and
as such is subject to the following restrictions, which restrictions run with the land.
The sale of the affordable housing units shall be available to individual buyers as delineated
in A, below; or to corporate buyers as delineated in B, below. Each respective buyer category shall
be subject to the respective following condition as appropriate:
either A. (Individual)
(1) No more than one affordable housing unit shall be available for purchase by a buyer
and his/her household member.
(2) At time of purchase, buyer will execute an affidavit that the Property being purchased
is to be used and occupied solely as the buyer's primary residence for permanent living
purposes.
(3) The initial maximum sales price calculation for the Property, units shall utilize the
yearly projected U.S. Government Census Bureau 'Median Household Income' data
for Monroe County, Florida beginning 1/1/99 for the baseline rate ("Monroe County
Median Income (circa January 1999)"). The initial maximum baseline price ("Initial
Baseline Price") for the Property shall be the Monroe County Median Income (circa
January 1999) times 3.
{4) Prospective purchasers of the Property shall meet the following income
requirements to be eligible to purchase such units: At time of sale, the maximum
gross income allowed for buyer eligibility, shall be calculated by taking the then
current monthly payment of mortgage (calculated at the purchase price) including
principal, interest, real estate taxes, insurance and condo fee (collectively referred to
as the "Housing Costs''), times 12 months, times 3 ("Eligible Income Limit"). After
the initial 90 days of local public advertisements, press releases, and marketing
undertakings, if the affordable units are not pre-sold to Eligible Income Limit
buyers (as defined above) then the Eligible Income Limit will be raised to be equal
to the Housing Costs times 12, times 3, times 110% for the succeeding 120 days. If
after that period of time, if the affordable units are not pre-sold then the Eligible
Income Limit will be raised to the Housing Costs times 12, times 3, times 120%
thereafter until all the affordable housing units have been sold. Prospective
purchasers, as defined herein, shall comply with the conditions as set forth in
paragraph 6(5) as hereinafter described.
(5) The following conditions shall apply to the resale of the Property:
(a) For units owned from 0 to 5 years after the initial sale, the maximum re-sale
price shall be calculated at the then current Monroe County Median Income times 3,
times 102% during year one; 104% during year two; 106% during year three; 108%
during year four; and 1100/o during year five (which calculation shall not be less
than the Initial Baseline Price), plus recapture ofbuyers transaction capital costs (as
verified by closing statements) to include loan and closing costs at purchase and
sale plus third party brokerage fees.
(b) For units owned from 5 to 10 years after the initial sale, maximum re-sale price
shall be calculated at the then current Monroe County Median Income times 3,
times 115% during years 6 and 7, and 120% during years 8, 9 and 10 (which
calculation shall not be less than the Initial Baseline Price), plus recapture of buyers
transaction capital costs (as verified by closing statements) to include loan and
closing costs at purchase and sale plus third party brokerage fees.

(c) At time of purchase, buyer will execute an affidavit that the Property being

subsequent purchasers of affordable housing units shall meet the following
income requirements to be eligible to purchase such units: At time of sale, the

price) including principal, interest, real estate taxes, insurance and condo fee
(collectively referred to as the "Housing Costs"), times 12 months, times 3,
times 120% ("Eligible Income Limit"). At time of resale, the subsequent buyer
will execute an affidavit that the affordable housing unit being purchased is to be
used and occupied solely as the buyer's primary residence for permanent living
purposes.
In the event of foreclosure or lender takeover of the Property, in lieu of
foreclosure, the conditions of this paragraph shall not apply.
For a period of ten (10) years after the initial sale, in each deed transferring
ownership of an affordable housing unit, the language of this paragraph shall be
included as a covenant to run with the land.
or B. (Cwporate)
( 1) No more than 30% of the 108 permanent dwelling units designated as
affordable housing shall be made available for employer corporate
purchases.
(2) At time of purchase, the corporate buyer will execute an affidavit that the
affordable housing unit being purchased is to be used and occupied solely as
employee housing for permanent living purposes in accordance with this
paragraph B. Additionally, this affidavit shall stipulate that: (i) all leases
with employee tenants shall include language acknowledging DCA's right to
enforce this Agreement; (ii) said employer corporate purchasen shall agree
to comply with this Agreement; and, (iii) said employer corporate purchasers
shall acknowledge that they will issue an annual report, for the duration of
this Agreement, to DCA, detailing such compliance in regards to lessee
qualifications under this paragraph B.
(3) Qualified corporate buyers under this plan shall have a minimum of 10 (ten)
equivalent full time employees.
(4) The initial maximum sales price calculation for the affordable housing units
shall utilize the yearly projected U.S. Government Census Bureau 'Median
Household Income' data for Monroe County, Florida beginning 111/99 for
the baseline rate ("Monroe County Median income (circa January 1999)").
The initial maximum baseline price ("Initial Baseline Price") for the
affordable housing units shall be the Monroe County Median Income (circa
January 1999) times 3.
(S) Any habitation by corporate employees, whether by a rental or other program,
shall be limited to permanent residents of the Keys who are permanently
employed by said corporate unit owner- Any such employees inhabiting the
corporate owned unit must remain as an employee of the corporate owner (or
affiliate) for the duration of which they occupy the unit.
(6) If rented to employees by a corporate owner, the annual rental proceeds, taken
in total for all inhabitants of a unit, shall not exceed 30% (thirty percent) of
the median household income [as defined in paragraph 6B(4) herein] times
120%. Rental lease terms shall be for a minimum of 6 months duration.
(7) Prospective employee inhabitants of affordable housing units shall meet the
following income requirements to be eligible to inhabit such units: At time of

habitation, the maximum gross income allowed for inhabitant eligibility, shall
be calculated by taking the then current monthly payment of mortgage (or its
equivalent, calculated at the purchase price) including principal, interest, real
estate taxes, insurance and condo fee (collectively referred to as the
"Equivalent Housing Costs"), times 12 months, times 3, times 120%
("Eligible Income Limit").
(8) The following conditions shall apply to the resale of the Property, if corporate
owned:
(a) For units owned from 0 to S years after the initial sale. the maximum
re-sale price shall be calculated at the then current Monroe County Median
Income times 3, times 102% during year one; 104% during year two; 106%
during year three; 108% during year four; and 110% during year five (which
calculation shall not be less than the Initial Baseline Price), plus recapture of
buyers transaction capital costs (as verified by closing statements) to include
loan and closing costs at purchase and sale plus third party brokerage fees.
(b) For units owned from S to 10 years after the initial sale. the maximum
re-sale price shall be calculated at the then current Monroe County Median
Income times 3, times 115% during years 6 and 7, and 120% during years 8,
9 and 10 (which calculation shall not be less than the Initial Baseline Price),
plus recapture of buyers transaction capital costs (as verified by closing
statements) to include loan and closing costs at purchase and sale plus third
party brokerage fees.
(c) At time of purchase, the new buyer, whether individual or corporate, will
execute an affidavit in accordance with paragraph 6 A (2) or 6 B (2) herein,
as appropriate.
(d) For a period not to exceed ten {10) years following the initial purchase,
subsequent individual purchasers of the Property shall meet the following
income requirements to be eligible to purchase such units: At time of sale, the
maximum gross income allowed for buyer eligibility, shall be calculated by
taking the then current monthly payment of mortgage (calculated at the
purchase price) including principal, interest, real estate taxes, insurance and
condo fee (collectively referred to as the "Housing Costs"), times 12 months,
times 3, times 120% ("Eligible Income Limit").
(e) For a period not to exceed ten (10) years following the initial purchase,
subsequent corporate purchasers the Property shall meet the conditions of
paragraph 6B herein.
(f) For a period not to exceed ten (10) years following the initial purchase,
subsequent individual inhabitants of the Property if corporate owned shall
meet the following income requirements to be eligible to inhabit such units:
At time of habitation, the maximum gross income allowed for buyer
eligibility, shalJ be calculated by taking the then current monthly payment of
mortgage (or its equivalent, calculated at the purchase price) including
principal, interest, real estate taxes, insurance and condo fee (collectively
referred to as the "Housing Costs"), times 12 months, times 3, times 120%
("Eligible Income Limit").
