Under colonisation rules 1972,sub rule rule 3(1), there is mandatory provision that Rajasthan govt will reserve land for oustees and land will be allotted only from this land to pong Dam Oustees . please supply the copy of list of land so reserved for allotment to PONG DAM OUSTEES in r/o Sub divison Gharsana. 2. Under sub ruleRule3 (2) of Main Rules ibid , Please supply the copy of proforma -1 to be maintained by SDM GHARSANA Cum Allotment authorities Gharsana in r/o Sub divison Gharsana. 3. During 2009,2010 and 2011 SDM Gharsana made some allotment:A B Under which rules these allotments were made. Were these allotments were not covered under limitation Act.

C Whether all these allottees had deposited instalment, taken the possession, cultivated the land personally in r/o their original allotment. D How many of them were allotted alternate allotment and how many of them were restored original allotment . Please supply separate list in each case. E Please supply the names of each allottee with full address as per record available with Allotment authorities or ( proforma -6) to be maintained under rule 5(1). F Supply the names of those persons with address to whom this allotted land was further sold by these allottees. Please supply the copies of sale deeds executed by allottees in favour of so called persons 4 How much land is available for allotment for pong Dam Oustees in Sub divison Gharsana as on 31-12-2011. 5 Honorable Supreme Court has ordered vide 439/92 cwp that land taken from Pong Dam oustees under 6-a should be reverted to state govt and further be allotted to pong Dam Oustees but land so reverted is still being possessed and cultivated by land mafia with the knowledge and support of

local administration. What action is being taken by SDM Gharsana to evict such encroachers on the land so reverted and reserved for Pong Dam Oustees. 6 In para 28 of Honorable supreme court order cwp 439/92 titled as Pardesh Pong bandh Visthapit sangarsh samiti and others v/s union of India, it has been ordered that all oustees who have secured certificate of eligibility except those who have forfeited their right as declared by distt judge has to be settled in command area of indira Gandhi Canal colony and essential amenities will also be provided to oustees.This means that every allottee who have secured eligibility certificate has to be settled irrespective of any fact and colonization rules except mentioned above and denial for land allotment to pong dam Oustees attract contempt proceeding. Please supply the list of allottees who were allotted land under these orders of supreme court and who were denied for land allotment since 26-7-1996 to 29-2-2012 in r/o sub divison Gharsana.. 7 Please supply how much facility i.e. roads.hospitals etc has been provided to oustees as per above orders w.e.f 26-7-96 to 29-2-2012 in r/o gharsana sub divison.. 8 In para 28 of above said judgement, power to settle pong dam Oustees has been shifted to committee under Chairman ship of secretary ,Water resources union of India whereas allotments/cancellation orders are being issued by allotment authorities. Whether any approval has been sought from committee or not. If so please supply the copy. 9 Whether any copy of order of supreme court cwp 439/92 titled as pardesh pong bandh samiti v/s union of india has been received by SDM Gharsana in his office.If yes, what action is being taken as per these orders whereas the orders of supreme court are law itself and binding on each authority . 10 Whether land allotted to pong Dam oustee can be further allotted to Rajasthani local person (non Oustee) after cancellation from Pong Dam oustee. If yes, please supply the no. of such cases in sub divison gharsana till date.
