COUNTER-AFFIDAVIT

I, Bogart Aquino, of legal age, Filipino Citizen. married and a resident of 456 Balong Bato, San Juan City, after having been sworn to in accordance with law hereby depose and say:

I am one the accused in IS no. 789 for the crime of Serious Illegal

Detention under Article 267 of the Revised Penal Code.

I vehemently deny the allegations of Garcia. I admit that I know

Michelle Madrigal but she is a mere acquaintance that I met through my friends Marlito Roxas and Paco Ochoa at a party held last December at a club in Makati City.

I admit that I saw and approached Garcia on the evening of January

20, 2014 while I was heading for my car parked inside the same building. At that time he was very drunk and could hardly walk so I offered my help. He was shouting at the top of his voice and started cursing me. I asked him what seems to be the problem but he continued to blurt out profanities. Considering his condition, I asked him to just get in his car but he refused to do so.

I deny punching him in the stomach or holding him captive inside his

own car as I left Garcia by himself immediately since he could no longer be

pacified. I did not bother with Garcia as I understood he was just really drunk and that it was only the influence of alcohol. 5. I left Atlanta Centre at around 9:15 pm and went straight home at my

condominium unit in Gilmore, Quezon City, as evidenced by the logbook entry attached hereto as Annex A and by the Affidavit executed by Bong Revilla, the guard on duty that night at the basement parking of Atlanta Centre, attached hereto as Annex B.

I am executing this counter-affidavit to attest to the truthfulness of the

foregoing to refute the allegations of Andrew Garcia.
