Introduction These terms and conditions have been produced for the information of clients regarding my policies with taking photos, Making payments and image publishing.

BOOKINGS SECTION 1 1.1A) All Bookings must be processed through email or phone. 1.2B) Upon booking you must state exactly what you want from my services. 1.3C) If you would like to publish my work on the internet after the shoot please specify this upon booking. Not specifying and then publishing my work online without my consent is a criminal offence. 1.4D) Upon booking a one off deposit will be taken of 20% of the final photoshoot quote. This is to secure your booking with me. This 20% will be deducted from the final amount when full payment is due. 1.5E) Once youve booked youll receive a booking conformation email stating the date, time and location of shoot along with the amount of deposit paid. 1.6F) Bookings can be changed with 24 hours notice. 1.7G) If you cancel your booking or fail to turn up you will not revive a refund of the deposit. 1.8H) I have the right to change shoot bookings with 24 hour notice.

Quotes SECTION 2 2.1A) A request for a quote of the finally price for the work to be carried out can be made via email at Daniel.gillingham@gmail.com. 2.2B) once I have received your request I will supply you with a final price for the work to be carried out. This will be calculated on the following things: How long the work will take to produce Where the location is What is expected from the photos Are the photos going to be published online Extra services to be included e.g. make up and props The time it takes for the photos to be edited The turnaround time in which the client wants the photos to be received

2.3D) Once a final price had been produced it will be made up into a detailed invoice and sent to the clients email address or by post.

PAYMENTS SECTION 3 3.1A) All deposits must be paid upon booking. 3.2B) Deposits are Non-Refundable. 3.3C) Deposits can only be accepted via PayPal or Cash. 3.4C) Payments for the work carried out can be paid up front on must be paid upon shoot completion. 3.5D) Refunds are not accepted but there may be some exceptions, please see Refunds section of this document. 3.6E) once the full payment had been cleared the work on your photos will commence.

COPYRIGHTS SECTION 4 4.1A) As the photographer I will own all copyrights to all photos you receive. 4.2B) As stated in SECTION 1 1C.. It is VERY IMPORTANT to state if you would like to publish my work for online upon booking. Depending on what the work will be used for depends on how much the copyright image lease will be made for. 4.3C) Do not assume that because you have been granted a copyright image lease that you can edit, change, or remove information from the images listed on the lease. This will be stated in the provisions in the lease. 4.4D) Before you change any information or do anything to my images that is not stated in the contract, you must have written permission from me. 4.5E) Copyright image leases must be signed by myself and the client and agreed on and the amount paid before any of the images are published. 4.6F) Failing to comply with any of the terms stated above or in the Copyright Image release may lead to court proceedings. If you publish, edit or change any information in my work without consent you will need to pay a fee. The fee is worked out by using your original publication fee and X by 3. So for example: you require publishing and image set on a website or blog, and you are changed 150. If you abuse the terms, edit or remove information your sum to pay will be 150X3=450 and the total of 450 must be paid. If you fail to pay this sum It will be a breach of these terms and conditions and you may face legal action against yourself. 4.7G) ALL work published must be credited to me in some way unless otherwise agreed on the image release contract. 4.8H) The Licensee indemnifies and holds Daniel Gillingham against all claims, liability, damages, costs and expenses stemming from a breach of this agreement, the use of the image, your failure to abide by any restriction regarding the use of an image, or any claim by a third party related to the use of the image.

REFUNDS SECTION 5 5.1A) unfortunately due to the nature of my business I cannot accept refunds. 5.2B) The following condition shows when a refund may be considered. Technical problems with photography equipment that may have affected the quality of work produced

5.3C) To request a refund please contact me via email. 5.4D) Once the request has been received; it will be reviewed for the circumstances as to why the refund was requested. I cannot hold responsibility if a refund is refused.

OTHER POLICYS SECTION 6 6.1A) I cannot be held responsible for lost or damage of files once youve received them. If you would like copies of photos sent to you there will be a charge of 5 per photo. 6.2B) Copyright Infringement is taken very seriously and any offender who has been caught with my work will face legal action!
