    DeKalb County, GA, Mar. 1 - In September of 2013, the DeKalb County Board of Commissioners adopted a Juvenile Curfew Ordinance. The ordinance is now in effect. The ordinance was brought forth by DeKalb County Chief of Police Cedric Alexander and Commissioner Larry Johnson. The ordinance imposes a curfew between the hours of midnight and 5 a.m., but allows exceptions for those young people who are working, returning home from a school or religious event and/or are accompanied by a parent or guardian. Back in September '13 when the ordinance was adopted, Commissioner Larry Johnson said, "This ordinance is not intended to make criminals of our youth, the purpose is to aid our officers in addressing juvenile loitering and safeguard our youth so that they do not become victims of crime."

    Sec.1644.Juvenilecurfew.
    (a) Definitions.Wordsortermsnotdefinedinthissectionbutdefinedinapplicablestatelaworthe CodeofDeKalbCounty,asRevised1988,shallbegiventhatmeaning.Allotherwordsor phrasesshallbegiventheircommon,ordinarymeaningunlessthecontextrequiresotherwise. Thefollowingwords,termsandphrases,whenusedinthissection1644andinsection1645, shallhavethemeaningsascribedtothembelowexceptwherethetextclearlyindicatesa differentmeaning: Adultmeansapersonwhoisatleasteighteen(18)yearsofageandauthorizedbyaparentor guardiantohavethelawfulcareandcustodyofaminor,oranemancipatedminor. Curfewhoursmeansthehoursfrom12:00midnightuntil5:00a.m.eachday. Emancipatedminormeansanypersonundertheageofeighteen(18)whohashadthe disabilitiesofminorityremovedandbeendeclaredanemancipatedminorbyacourtofcompetent jurisdiction. Emergencymeansanunforeseencombinationofcircumstancesortheresultingstatethat callsforimmediateaction.Thetermincludes,butisnotlimitedto,aseriousorlifethreatening medicalproblem/condition,afire,naturaldisaster,automobileaccidentoranysituationrequiring immediateactiontopreventseriousbodilyinjuryorlossoflife. Establishmentmeansanyprivatelyownedplaceofbusinesswhichisopenforbusinessandto whichthepublicisinvitedduringcurfewhoursincludingbutnotlimitedtoanyteenclubopenduring curfewhours,placesofamusementorentertainment,malls,restaurants,andshopsthatareopen duringcurfewhours. Guardianmeansapersonwho,undercourtorder,istheguardianofthepersonofaminoror apublicorprivateagencywithwhomaminorhasbeenplacedbythecourtorotheradult. Minormeansanypersonundertheageofseventeen(17)years. Operatormeansanyindividual,firm,association,partnershiporcorporationowning,operating, managing,conductingorhavingcontrolorcustodyofanyestablishmentorpublicplace.Theterm "operator"includes,butisnotlimitedto,electedandappointedofficials,managers,membersor partnersofanassociationorpartnershipandofficersofacorporation. Parentmeansapersonwhoisanaturalparent,anadoptedparentorstepparentofaminor. Publicplacemeansanyplaceownedoroperatedbyagovernmentalentitytowhichthepublic orasubstantialgroupofthepublichasaccessduringcurfewhoursandincludes,butisnotlimitedto, streets,sidewalks,highways,alleys,andpublicschools,andschoolstadiumsorathleticfields. Remainmeanstolingerorstay,orfailtoleavepremiseswhenrequestedtodosobyapolice officer,codeenforcementofficer,authorizedcountyemployee,theoperatororotherpersonincontrol ofanestablishmentorapublicplaceand Seriousbodilyinjurymeansbodilyinjurythatcausesdeathorcreatesasubstantialriskof seriouspermanentdisfigurement,orprotractedlossorimpairmentofanypartofthehumanbody. (b) Curfewforminors.

    Itisunlawfulforanyminortoremaininoratapublicplaceoranestablishmentin unincorporatedDeKalbCountyunsupervisedbyaparentorguardianduringcurfew hoursexceptasallowedinsubsection1644(c). Itisunlawfulfortheparentorguardianofanyminortoknowinglyallowsuchminorto remaininoratanypublicplaceorestablishmentinunincorporatedDeKalbCounty duringcurfewhoursexceptasallowedinsubsection1644(c). Itisunlawfulforanoperatorofanestablishmentorpublicplacetoknowinglyallowa minortoremaininoratanestablishmentorpublicplaceinunincorporatedDeKalb Countyduringcurfewhoursexceptasallowedinsubsection1644(c). Itisafulldefensetoprosecutionunderthissectionthattheoperatorofan establishmentorpublicplacepromptlynotifiedtheDeKalbCountyPoliceDepartment thataminorwaspresentonthepremisesduringcurfewhoursandtheminorrefusedto leave.

    Exceptions.Therequirementsofthissectionshallnotapplyduringcurfewhoursinthe followinginstances: (1) Whenaminorisaccompaniedbyhisorherparentorguardian (2) Whentheminorisinvolvedinanemergencyorifsuchminorisseekingmedical treatment (3) Whentheminorisreturningdirectlyhomefromaschoolactivity,entertainment, recreationalactivityordance (4) Whentheminorisengagedinlawfulemploymentorisgoingtoorreturningdirectly homefromlawfulemployment (5) Whentheminorisattendingortravelingdirectlytoorfromanactivityinvolvingthe exerciseoffirstamendmentrightsoffreespeech,freedomofassemblyorfreeexercise ofreligion (6) Whentheminorisinamotorvehiclewiththeconsentofaparentorguardian.Allminors engagedininterstatetravelthroughunincorporatedDeKalbCountyareexemptfromthe requirementsofthissection1644 (7) Whentheminoristravelingwiththeconsentofaparentorguardianandisinanairport, busstationorotherwaitingorbusinessareaofafacilitythatprovidestransportation fromone(1)placetoanother (8) Whentheminorisanemancipatedminoror (9) Whenapplicablelaworregulationauthorizestheminortobeinapublicplaceor establishment. Violationsandjurisdiction. (1) Anypersonwhodoesanythingprohibitedbysections1644and1645orwhofailsto doanythingrequiredbysections1644and1645,uponcitationorsummonsbya policeorcodeenforcementofficerorotherauthorizedcountyemployee,andjudgment orconvictionoftheviolationinacourtofcompetentjurisdiction,whichincludesthe RecordersCourtandJuvenileCourtofDeKalbCounty,shallbesubjecttoappropriate penaltiesasimposedbythecourt.Aminor,parent,guardianoroperatorofan establishmentorpublicplacewhoviolatesthissectionforthefirsttimeshallbegivena warningcitation. (2) Adjudicationofviolationsofthissectionbyminorsshallbemadeinaccordancewith O.C.G.A.1511etseq. (3) Beforetakinganyenforcementaction,theauthorizedcountyofficeroremployeeshall asktheapparentoffender'sageandthereasonforbeinginthepublicplaceor establishment.Theauthorizedcountyofficeroremployeeshallnotissueacitationor
