EXTRA-JUDICIAL SETTLEMENT OF THE ESTATE OF A DECEASED PERSON

KNOW ALL MEN BY THESE PRESENTS: This extra-judicial settlement of the estate of Juan de la Cruz Sr. made and executed this 21st of August 2010 by and between the following persons: 1. 2. 3. JUAN DE LA CRUZ, Filipino, of legal age, single and a resident of Dipolog City; MAIRA DE LA CRUZ, Filipino, of legal age, single and a resident of Dipolog; PEDRO DE LA CRUZ, Filipino, of legal age, single and a resident of Dipolog City WITNESSETH: That the above-named persons are the only surviving heirs of the late Juan de la Cruz sr. who died in Dipolog City on January 24, 2006 without any will and leaving no indebtedness; That at the time of his death, said Juan de la Cruz Sr. left the following described properties: PARCEL 1 A parcel of land otherwise known as Lot No. 437, covered by Original Certificate of Title No. O-43647 of the Registry of Deeds of Dipolog City, the exact description of which is indicated on the face of the aforesaid title. PARCEL II A parcel of land otherwise known as Lot No. 542 covered by Original Certificate of Title No. O-43645 of the Registry of Deeds of Dipolog City, the exact description of which is indicated on the face of the aforesaid title. PARCEL III

A parcel of land otherwise known as Lot No 643 covered by Original Certificate of Title No. O-43650 if the Registry of Deeds of Dipolog City , the exact description of which is indicated on the face of the aforesaid title.

-2That the above-named persons hereby decreed and adjudicate among themselves the above-described properties in the following manner: 1. 2. 3. To Juan de la Cruz, Jr.: PARCEL I; To Maira de la Cruz: PARCEL 2; To Pedro de la Cruz: PARCEL 3;

That this extra-judicial settlement does not include any personal property. That in compliance with the provision of the Rules of Court, the above-named persons agree to have this document published in the Mindanao Observer for three (3) consecutive weeks. REPUBLIC OF THE PHILIPPINES) CITY OF DIPOLOG........)s.s BEFORE ME, this 22th day of August, 2010 in the City of Dipolog, personally appeared Juan de la Cruz, exhibiting his Community Tax Certificate No. 0123456 issued in Estaka, Dipolog City on January 8, 2010, Maria de la Cruz exhibiting her Community Tax Certificate No. 7891011 issued in Miputak, Dipolog City on February 3, 2010, and Pedro de la Cruz exhibiting his Community Tax Certificate No. 5867910 issued in Dipolog City, known to me to be the same persons who executed the foregoing Deed of Extra-judicial Settlement and they acknowledged that the same are their free and voluntary act and deed. This document consists of three (3) pages including the page on which this acknowledgment is written, all signed by the parties on every page and also signed by their witnesses.

I, Juan de la Cruz Jr. Filipino, of legal age, single and a resident of Estaka, Dipolog City, under oath depose and say: That I am the only surviving heir of Juan de la Cruz Sr. who died intestate in the City of Dipolog on January 24, 2010 as evidenced by death certificate hereto attached as Annex A; That said deceased person at the time of his death left the following properties: PARCEL 1

A parcel of land otherwise known as Lot No. 437, covered by Original Certificate of Title No. O-43647 of the Registry of Deeds of Dipolog City, the exact description of which is indicated on the face of the aforesaid title. PARCEL II A parcel of land otherwise known as Lot No. 542 covered by Original Certificate of Title No. O-43645 of the Registry of Deeds of Dipolog City, the exact description of which is indicated on the face of the aforesaid title. That pursuant to the Rules of Courts, being the only heir I do hereby adjudicate unto myself all of the above-described properties by means of this affidavit of self adjudication which I intend to file with the office of the Registry of Deeds of Dipolog City, with the request that said adjudication be made effective without judicial proceeding and that the title of the abovedescribed properties be cancelled and that a new Transfer Certificate of Title be issued in my name. That this affidavit of self adjudication shall become effective after publication in the Mindanao Observer for three (3) consecutive weeks.
