agreement to cover DMD_Chip_and_Full_Labor cost of the current repair of your Model number WD-65735 the receipt and sufficiency of which is hereby acknowledged, Tim_Willform, on behalf of his/her spouse, relatives, persons living in the same household, heirs, executors, administrators, successors, and assigns (Claimant) hereby releases and forever discharges Mitsubishi Electric Visual Solutions America, Inc. (MEVSA) and its parents, subsidiaries, affiliates, successors, and assigns (Released Parties) from any and all claims, demands, liabilities, causes of action, damages, costs, and expenses, whether known or unknown and whether based in tort, contract, statute, or otherwise, against the Released Parties or any of them, arising out of or relating to Claimants purchase, use, and ownership of Mitsubishi WD-65735 television manufactured and distributed by MEVSA or any of the Released Parties. Claimant acknowledges and agrees that this Release pertains to disputed claims and is the result of compromise. As such, it does not constitute and shall not be deemed as an admission of liability by the Released Parties. Claimant expressly agrees that the fact and terms of this Release are to be kept confidential and may not be revealed to any third party, except legal and tax professionals, unless required by law. Claimant further agrees not to criticize, disparage, or otherwise demean the Released Parties in any manner, whether verbal, written, or electronic. Claimant acknowledges that he/she is familiar with 1542 of the California_Civil_Code, which reads as follows: 1542. Certain Claims Not Affected By General Release. A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor. Claimant hereby waives and relinquishes all rights and benefits which he/she has or may have under 1542, or the law of any other state to the same or similar effect, to the fullest extent allowed by law. This Release constitutes the entire agreement and understanding between Claimant and MEVSA with respect to the compromise of the parties dispute regarding Claimants WD-65735 television. Claimant acknowledges that neither the Released Parties, nor any agent of the Released Parties, has made any promise, representation, or inducement with respect to this Release, other than as set forth herein. Any dispute arising out of this Release shall be litigated and decided in accordance with California law. Claimant agrees to submit to the exclusive jurisdiction of the courts located within the State of California to resolve any dispute arising out of this Release. The Release is intended to be a binding, integrated agreement and shall not be changed, modified, amended, waived, or discharged except by a subsequent agreement in writing signed by both parties. THE UNDERSIGNED HAS READ THE FOREGOING RELEASE AND FULLY UNDERSTANDS IT.
