New Delhi: Speculation over law minister Ashwani Kumar intensified after he visited the Prime Ministers Office on Thursday in the wake of the Supreme Court ticking him off for vetting a CBI report on Coalgate, only to emerge a while later without meeting the PM. New Delhi: A landmark judgment and the man who helped the Supreme Court frame it converged again after almost 15 years. As the highest court in the land revisits its 1997 judgment in the Vineet Narain vs Union of India case to build jurisprudence on insulating the CBI from executive interference, its central protagonist, journalist and anti-corruption crusader Vineet Narain, was in court. Speaking to TOI after Wednesdays marathon hearing where the SC derisively referred to the CBI as a caged parrot, Narain said

he wasnt surprised but felt an acute sense of deja vu during the coal scam hearings. In more than 15 years since the verdict on my PIL, we havent travelled any distance. My PIL filed in 1993 demanded an honest probe in the hawala case which had dangerous consequences for the nations security and finances. Despite SC monitoring, the case was never properly probed. I saw how CBI and governments top law officers played a dubious role to ensure the probe was botched up. From SCs observations in the coal scam, its clear we are back to square one, he said. However, Narain added a

sobering note to the current euphoria over the SCs stinging observations and said: Contrary to general expectation, the SC on Wednesday didnt emphasize much on accusations against the political leadership. In a carefully treaded path, they expressed anguish and anger in no uncertain terms against interference of the executive in the ongoing investigations. It appears the court is more interested in ensuring that the 1997 judgment is implemented in letter and spirit. So much so, they have asked the

law officers to come back with a firm commitment. Narain, whose investigative journalism during the 1990s threatened to singe the high and mighty, believes no political party wants to let go of the CBI and the coal allotment case is no different. Narain hasnt just been an interested observer in the current PIL proceedings before the apex court. Encouraged by the SCs repeated reference to the hawala judgment authored by the late Justice J S Verma, the activist has filed a written submission in court, urging the judges to pay heed to his suggestions on making the CBI effective and efficient.

Hyderabad: It is an open secret in the corridors of Rail Nilayam, the headquarters of the South Central Railway that their boss, general manager Devi Prasad Pande will become member (traffic) of the Railway Board in the first week of July . They are also aware that Pande, who arrived in Secunderabad a month ago on April 10, has just come here to fulfill the requirement that mandates only officers who have served as general managers of a zonal railway can be appointed as a board member. Pande, a 1976 batch Indian Railway Traffic Service (IRTS) officer, was additional member (traffic) at the Railway Board before he parachuted to this city . In the meanwhile, the post of member (traffic) is being held by the chairman of the Railway Board, Vinay Mittal. So why is Mr Mittal holding charge? Is it to warm the chair for Mr Pande till he fulfills the mandatory requirement of being a zonal general manager? asks a railway officer. The question is significant in view of the recent scandal in appointments in railway posts. Mittal will superannuate at the end of June this year and the expectation is that his exit will lead to Pandes elevation. Though Pande has a good track record, there is a senior officer whose claims are being overlooked. S V Arya, general manager of the West Central Railway headquartered in Jabalpur, in normal course should have been appointed as the member (traffic) but due to inexplicable reasons his claims have been overlooked.

New Delhi: CBI director Ranjit Sinha on Thursday said he agreed with the Supreme Courts observations that the agency lacked independence as it was a caged parrot with many masters. Sinha offered the brief comment as he was surrounded by TV crews on his return to Delhi on Thursday morning. Inundated by questions on the SCs remarks, Sinha said whatever the court had said was correct. The court had come down heavily on the CBI for sharing the status report on the coal allocation scam probe with law minister Ashwani Kumar and PMO and coal ministry officials. The agency had issued a statement, saying: CBI assures the Supreme Court of thorough and qualitative investigation into Coalgate. It will follow directions of Supreme Court in letter and spirit. Observing that the CBI was like a caged parrot, the court had said it should stand up to all pulls and pressures and not share its probe with anyone, including the law minister. In a significant order on Wednesday , a bench headed by Justice R M Lodha had asked the government to make efforts to come out with a law before July 10 to insulate the CBI from external intrusion. When asked about his reaction, Sinha said: It is up to the government. We accept Supreme Courts observations with great respect.

New Delhi: The Central Vigilance Commission has sought a detailed report from the CBI on its controversial decision to share the coal scam status report with the government, even as many observers are hoping that the government will come up with a comprehensive autonomy package for the agency unlike in the past. The CVC is believed to have taken cognizance of the entire development in the coal scam, and has sought details. The commission has superintendence over the CBI under the CVC Act, 2003 on all cases of corruption being investigated by the federal agency . The CVC has also sought a detailed report from the CBI on the status of its investigation into the scam. Given the Supreme Courts strictures on the law minister, the attorney general and officials of the PMO and the coal ministry carrying out changes to the CBI report, it is not clear what action the CVC will initiate. Given the partial superintendence that the CVC has over the CBI, many within

the government are arguing that, this time, the agencys autonomy should be comprehensive and not piecemeal. The Supreme Court on Wednesday asked the government to come up with a comprehensive proposal before July 10 to protect the CBI from external influence and intrusion. The court also pointed out that despite its judgment in the Vineet Narain case 15 years ago ordering autonomy for the CBI, the situation has only got worse.

Government officials said when the government comes up with its suggestions, it should not play the kind of games played last time when such an opportunity came. The CVC Act said the CVC will review the progress of investigations conducted by the Delhi Special Police Establishment Act into offences alleged to have been committed under the Prevention of Corruption Act, 1988. This limited the CVCs oversight over the agency , with a large part of the CBIs activities outside the CVCs superintendence.

New Delhi: The CBI has arrested a bevy of businessmen and others in connection with the railway jobs for sale scam and this is giving the agency a headache in more ways than one. As if questioning them and trying to piece together evidence was not enough, the agency is having to coordinate delivery of home cooked food to the accused and even employing a food taster to sample the eatables lest they be laced with poisonous substances. Then, it has to take care of the medication of several of the arrested persons. Among those in CBI custody are railway minister Pawan Bansals nephew Vijay Singla, businessmen Sandeep Goyal, Ajay Garg, Sushil Daga, Samir Sandhir, Rahul Yadav, Manjunath and Railway Board member (staff) Mahesh Kumar. An officer from the investigating team told TOI that the accused had to be kept inside CBI headquarters at Lodhi Road during the remand. Most of them were given food by the agency but some, on the special request

The agency had to keep the accused persons in an interrogation room or in the investigating officers room during the day time, when they needed to be questioned or confronted with the other accused or any documentary evidence, while at night, guards had to be around to keep an eye on them.

New Delhi: Investigative website Cobrapost has released further secret tapes to show alleged money laundering by more banks. In the third part of its tapes, Cobrapost claimed it has recorded officials of Bank of India, Central Bank of India, Bank of Maharashtra, Allahabad Bank and Bank of Baroda, all major public sector banks, as well as IndusInd Bank, ING Vysya Bank, HDFC Bank , ICICI Bank and Axis Bank, among private sector banks. Officials of these banks allegedly offered to help a corrupt politician invest his black money into banking accounts and various insurance products. In part one of its expos, Cobrapost had claimed that officials of ICICI Bank, HDFC Bank and Axis Bank were willing to assist a corrupt politician to convert his corrupt money. In the second part, Cobrapost had unveiled secret tapes of 23

banks and insurance firms offering to help launder money. Among the 23 were SBI and Life Insurance Corporation. The RBI continues to act as a protector, and not as a regulator or enforcer. The RBI is loathe to admit that there exists a massive money laundering racket in our financial institutions across the board, flourishing under its very nose, simply because if it were to admit to this deep-rooted malaise, it would strip the

RBI of its halo as one of the best banking regulators in the world, Cobrapost said. New videos allegedly show bank officials offering to help the assistant of a corrupt politician to exploit banking channels to route dirty money into banks and insurance products. The latest tapes covered 10 banking institutions, including HDFC Bank, ICICI Bank and Axis Bank, which were already covered in the first part of the Cobrapost expos. In the third part, more officials of already named banks figure. The videos, across the large spectrum of such illegal activity, clearly prove that this is not simply the design of some criminally oriented officers, or for that matter, some young, front-office executive succumbing to performance pressures. It proves without doubt that this corruption is endemic, and spread through the Indian banking and insurance system, a statement by Cobrapostsaid.
