/ #ctio#! The )hili//ine Mediation Center 5)MC6 shall, amon2 others: 1#1 Esta lish, in coordination 4ith; the Office of the Court %dministrator 5OC%6, units of the )hili//ine Mediation Center 5)MC6 in courthouses, and in such other /laces as may e necessary: Each unit, manned y Mediators and (u/er0isors, shall render mediation ser0ices to /arties in court&referred, court&related mediation cases9 1#! -ecruit, screen, train and recommend Mediators for accreditation to this Court, 1#= -eGuire /ros/ecti0e Mediators to under2o four&4eeF internshi/ /ro2rams9 1#H )ro0ide trainin2 in mediation to :ud2es, court /ersonnel, educators, trainors, la4yers, and officials and /ersonnel of Guasi&:udicial a2encies9 1#' O0ersee and e0aluate the /erformance of Mediators and (u/er0isors 4ho are assi2ned cases y the courts, 1#6 )re/are a Code of Ethical (tandards for Mediators for a//ro0al y the )*+L,% Board of i rustees and this Court9 1#E +m/lement the /rocedures in the assi2nment y the )MC Anits of court&referred, court& reiaied mediation cases to /articular Mediators9 1#3 )ro/ose to the (u/reme Court 5a6 Guidelines on Mediation and 5 6 Com/ensation Guidelines for&Mediators and (u/er0isors9 and# 1#7 )erform other related functions# +irectio# a#' Ma#a,e.e#t )*+L,% 4ill direct and mana2e the )hili//ine Mediation Center 5)MC6, enlistin2 for this /ur/ose the technical and mana2ement assistance of a//ro/riate and Gualified or2ani>ations or indi0iduals, on such terms as may e sti/ulated in a Memorandum of %2reement et4een )*+L,%, throu2h its Chancellor, and such other or2ani>ations or indi0iduals, su :ect to ratification y the )*+L,% Board of Trustees# (ec%#ica" a#' Ma#a,e.e#t A!!i!ta#ce Technical and mana2ement assistance shall include, amon2 others9 =#1 Esta lishment of Mediation Cha/ters 4ith their res/ecti0e (u/er0isors9 =#!-ecruitment, trainin2 and education, monitorin2 and /erformance e0aluation of (u/er0isors and Mediators 4ho 4ill e assi2ned to different )MC units9 =#= %ssi2nment of trainors, monitors, and lecturers for /ur/oses of instruction, internshi/, monitorin2 and e0aluation9 =#H Trainin2 and education in mediation of :ud2es, court /ersonnel, trainors, educators, la4yers, and officials and /ersonnel of Guasi&:udicial a2encies9 =#' Continuin2 education, trainin2, sFills de0elo/ment, and 48 u/2radin2 of accredited Mediators at least once e0ery t4o 5!6 years9 =#6 1e0elo/ment of trainin2 and other instructional materials9

The o/erational control and su/er0ision o0er )MC Anits and Mediation Cha/ters 4ith res/ect to court&referred, court&related mediation cases shall e 4ith the Mediation 1i0ision of )*+L,%, in coordination 4ith the OC%# )*+L,% may seeF the assistance of a//ro/riate and Gualified or2ani>ations and indi0iduals in su/er0isin2 )MC Anits and Mediation Cha/ters throu2h a Memorandum of %2reement# % ClerF&in&char2e shall e assi2ned y the E<ecuti0e ,ud2e, after /rior consultation 4ith )*+L,% and OC%, to coordinate et4een the courts and Mediators and (u/er0isors in e0ery )MC Anit# Ro"e o$ t%e Pre!i'i#, J ',e The )residin2 ,ud2e, efore 4hose court the case su :ect of mediation is /endin2, shall e<tend to the Mediator, e0ery /ossi le su//ort and assistance# The Mediator 4hose selectionIa//ointment is confirmed y the Court is deemed an officer of the court# Mo#t%"0 Re)ort The (u/er0isor of each )MC Anit, shall su mit to the Mediation 1i0ision of#the ,udicial -eforms Office of )*+L,% a monthly re/ort of its acti0ities and o/erations, duly noted y the E<ecuti0e ,ud2e, furnishin2 a co/y thereof to the Office of the Court %dministrator# A## a"1 Se.i-A## a" Sett"e.e#t 2ee31! )*+L,% shall determine, 4ith the /re0ious a//ro0al of this Court, 4hen to conduct %nnual andIor (emi&%nnual (ettlement JeeFIs, 4ithout /re:udice to year&round mediation#

The trial court, after determinin2 the /ossi ility of an amica le , settlement 5or of a su mission to alternati0e modes of dis/ute resolution, Khall issue an Order referrin2 the case to the )hili//ine Mediation Center&5)MC6 Anit for mediation and directin2 the /arties to /roceed immediately to the )MC Anit The Order shall e /ersonally 2i0en to the /arties durin2 the /re& trial# Co/y of the Order to2ether 4ith a co/y of the Com/laint and %ns4erIs, shall e furnished the )MC Anit 4ithin the same date The )MC Anit There shad e a )MC Anit in courthouses or near the /remises of the trial court for court& referred mediation /roceedin2s# (election of Mediator The (u/er0isor of the )MC Anit shall assist the /arties select a mutually acce/ta le Mediator from a list of duly accredited Mediatory and inform the /arties a out the fees, if any, and the mode or /ayment +f the /arties cannot a2ree on a Mediator, then the (u/er0isor shall assi2n the Mediator# The trial court shall immediately e notified of the name of the Mediator, anu s##aii thereafter confirm the selectionIa//ointment oi the Mediator# The Mediator shall immediately commence the mediation /roceedin2s unless oth /arties a2ree to reset the mediation 4ithin the ne<t fi0e 5'6 4orFin2 days, 4ithout need of further notice# )resence of la4yers La4yers may attend the mediation /roceedin2s and shall coo/erate 4ith the Mediator to4ards the amica le settlement of the dis/ute# Mediation )roceedin2s a6 The Mediator shall e considered as an ofricer of ihe court# 6 % conference efore the Mediator shall first e held 4ith oth /arties /resent# The Mediator shall e</lain the mediation /roceedin2s stressin2 the enefits of sn early settlement of the dis/ute and shall attem/t immediate settlement# +f no settlement is reached at this conference, the Mediator may, 4ith the consent of oth /arties, hold se/arate caucuses 4ith each8/arty to ena le the Mediator to determine their res/ecti0e real interests in the dis/ute# Thereafter, another :oint conference may e held to consider 0arious o/tions /ro/osed y the /arties to the Mediator to resol0e the dis/ute# c6 The Mediator shall not record the /roceedin2s in any manner ut he may taFe do4n /ersonaL notes to 2uide him# d6 The Mediator shall su mit to the trial court, 4hich referred the case to mediation, a status re/ort on the /ro2ress of the /roceedin2s at the end of the mediation /eriod#

e6 The )MC shall not Fee/ a file of mediation /roceedin2s e<ce/t the re/ort of the Mediator# %ll other records or documents that ha0e een su mitted y the /arties shall e returned to them# f6 %t the end of the thirty&day /eriod allo4ed y the trial court, if no settlement has een reached, the case must e returned to the trial court for further /roceedin2s, unless the /arties a2ree to further continue the mediation, in 4hich case a Mast e<tension of thirty 5="6 days may e 2ranted y the trial court# Confidentiality of -ecords To encoura2e the s/ontanity that is condusi0e to effecti0e communication, there y enhancin2 the /ossi ility of sucessful medation efforts, the mediarion /roceedin2s and all incidents thereto shall e Fe/t strictly confidential, unless other4ise s/ecifically /ro0ided y la4, and all admissions of statements made thereto shall e inadmissi le for any /ur/ose in any /roceedin2# E<&/arte communications y one /arty to the Mediator 4hich are not intended to e Fno4n y the other /arty shall not e commun cated to such other /arty# 1ocuments, re/orts, /osition /a/eN and affida0its su mitted y one /arty shall not e sho4n to the other 4ithout the consent of the former# Both /arties undertaFe not to rely or introduce as e0idence in any other /roceedin2, the follo4in2 matters: a6 .ie4s e</ressed or su22estions made y the ether /arty in res/ect of a /ossi le settlement of the dis/ute9 6 %dmissions made y either /arty in the course of the /roceedin2s9 c6 )ro/osals made y the Mediator9 d6 The fact that the other /arty had indicated his 4illin2ness to acce/t a /ro/osal for settlement made y the /arties to the Mediator# No transcri/t or minutes of the mediation /roceedin2s shall e taFen, and /ersonal notes of the Mediator on the mediation /roceedin2s shall not e furnished the trial court# %ny such transcri/t, minutes and notes shall e inadmissi le as e0idence in any other /roceedin2s# (us/ension of )roceedin2s The /eriod durin2 4hich the case is under2oin2 mediation shall e e<cluded from the re2ular and mandatory /eriods for trial and rendition of :ud2ment in ordinary cases and in cases under summary /rocedure# The /eriod for mediation shall not e<ceed !" days, e<tenda le for another =" days, in order to allo4 the /arties sufficient time to reach a com/romise a2reement and /ut an end to liti2ation# )ersonal a//earanceI)ro/er authori>ations

+ndi0idual /arties are encoura2ed to /ersonally a//ear for mediation# +n the e0ent they cannot attend, their re/resentati0es must e fully authori>ed to a//ear, ne2otiate and enter into a com/romise y a (/ecial )o4er of %ttorney# % cor/oration shall, y oard resolution, fully authori>e its re/resentati0e to a//ear, ne2otiate and enter into a com/romise a2reement# )roceedin2s in case of (uccessful (ettlement +f the mediation is successful, the trial court shall immediately e informed and 2i0en 5a6 the ori2inal Com/romise %2reement entered into y the /arties as asis for the rendition of a :ud2ment y com/romise 4hich may e enforced y e<ecution or, 5 6 a 4ithdra4al of the Com/laint or, 5c6 a satisfaction of the claim# The la4yers are e</ected to /ro0ide le2al assistance to their clients and the Mediator in the draftin2 of the necessary /leadin2sI/a/ers# )roceedin2s in Case of Cailure to (ettle +f the mediation is not successful, the Mediator shall issue a #;Certificate of Cailed Mediation11 for the /ur/ose of returnin2 the case for further :udicial /roceedin2s# (anctions (ince mediation is /art of )re&Triai, the trial court shall im/ose the a//ro/riate sanction includin2 ut not limited to censure, re/rimand, contem/t and such sanctions as are /ro0ided under the -ules of Court for failure to a//ear for /re&trial, in case any or oth of the /arties a sent himselfIthemsel0es, or for a usi0e conduct durin2 mediation /roceedin2s# 1uty of the Court Courts and their /ersonnel are en:oined to assist in the successful im/lementation of mediation as one of the Fey modes of %lternati0e 1is/ute -esolution and there y reduce and con2estion# (e/tem er ', !""1# iii. CO+4 O/ 4(HICAL S(AN+AR+S /OR M4+IA(OR +# -es/onsi ilities to Courts % Mediator shall e candid, accurate, and fully res/onsi le to the trial court concernin2 his Gualifications, a0aila ility, and all other /ertinent matters# % Mediator shall o ser0e all

administrati0e /olicies, a//lica le /rocedural rules, and statutes# % Mediator is res/onsi le to the :udiciary for the /ro/riety of his acti0ities and must o ser0e :udicial standards of fidelity and dili2ence# ++# -es/onsi ilities to )arties +m/artiality# The Mediator shall maintain im/artiality to4ard all /arties&+m/artiality means freedom from fa0oritism or ias either y a//earance, 4ord&or y action, and a commitment to ser0e all /arties as o//osed to a sin2le /arty# %t no time may a Mediator meet 4ith any of the /arties to discuss a case referred to him for mediation 4ithout the /resence or the consent of the other /arty# % Mediator shall 4ithdra4 from mediation if the mediator elie0es he can no lon2er e im/artial# % Mediator shall not 2i0e or acce/t a 2ift, eGuest, fa0or, loan or any other item to cr from a /arty, attorney, cr any other /erson in0ol0ed in and arisin2 from any mediation connection# Com/etence# % Mediator shall maintain /rofessional com/etence in mediation sFills, includin2 ut not limited to: 5a6 stayin2 informed of and a idin2 y all statutes, rules, and administrati0e orders rele0ant to the /ractice of mediation9 and 5 6 re2ularly en2a2in2 in educational acti0ities /romotin2 /rofessional 2ro4th# Conflict of +nterest The Mediator shall refrain from /artici/atin2 in the mediation of any dis/ute if heIshe /ercei0es that /artici/ation as a Mediator 4ill e a clear conflict of interest The Mediator shall also disclose any circumstanr&that may create or 2i0e the a//earance of a conflict of interest and circumstance that may raise a Guestion as to the Mediator8s im/artiality# The duty to disclose is a continuin2 o li2ation trou2hout the /rocess# +n addition, if a Mediator has re/resented either /arty in# any ca/acity the Mediator should disclose that re/resentation# % Mediator shall disclose any Fno4n, si2nificant current or /est /ersonal or /rofessional relationshi/ 4ith any /arty or attorney in0ol0ed in the mediation and the Mediator and /arties should discuss on a case& y&case asis 4hether or not to continue# %fter the Mediator maFes his disclosures, and a /arty does not seeF inhi ition, the Mediator shall continue as such# No Mediator shall ha0e any interest in any /ro/erty, real or /ersonal, that is the su :ect matter of the case referred to himIher for mediation# *e,she may not offer to /urchase or to sell such /ro/erty, 4hether at the ince/tion, durin2 or at any time after the mediation /roceedin2s, either /ersonally or throu2h other /arties#

%0oidance of 1elays# % Mediator shall /lan a 4orF schedule, refrain from acce/tin2 a//ointments 4hen it ecomes a//arent thai com/letion of the mediation8assi2nments cannot e done in a timely and e</editious manner, and /erform the mediation ser0ices in such a 4ay as to a0oid delays# )rohi ition %2ainst (olicitation or %d0ertisin2# % Mediator shall not use the mediation /rocess to solicit, encoura2e, or other4ise incur future /rofessional ser0ices and financial 2ain from either or oth /arties# Neither shall a Mediator maFe untruthful or e<a22erated claims a out the mediation /rocess and hisIher Gualifications# )rohi ition %2ainst Coercion# % Mediator snail not coerce or unfairly influence a /arty into a settlement a2reement and shsll not maFe su stanti0e decisions for any /arty to a mediation /rocess# a6 )rohi ition %2ainst Misre/resentation# % Mediator shall not intentionally& or Fno4in2ly; misre/resent material facts or circumstances in the course of conductin2 a mediation# 6 % Balanced )rocess# % Mediator shall /romote a alanced /rocess and shall encoura2e the /arties to conduct the mediation deli erations in a non&ad0ersarial manner# c6 Mutual -es/ect# % Mediator shall /romote mutual res/ect amon2 the /arties throu2hout the mediation /rocess# )ersonal O/inion# Jhile a Mediator may /oint out /ossi le outcomes of the case, under no circumstance may a Mediator offer a /ersonaL or /rofessional o/inion as to ho4 the trial court, 4here the case has een filed, 4ill resol0e the dis/ute# 1isclosure of Cees# E<ce/t for hisIher authori>ed fees, the Mediator in Court&-eferred Mediation shall not acce/t any commission, 2ift or other similar forms of remuneration from /arties or their re/resentati0es# +n case of Non&Court -eferred Mediation, the Mediator shall enter into a 4ritten a2reement 4ith the /arties re2ardin2 reasona le fees, time and manner of /ayment, efore e2innin2 the mediation# Confidentiality# The Mediator shall treat information re0ealed in mediation in strict confidentiality, e<ce/t for the follo4in2: +nformation that is statutorily mandated to e re/orted9 +nformation that, in the :ud2ment of the Mediator, re0eals a dan2er of serious /hysical harm either to a /arty, to a third /erson or to himselfIherself# -ole of Mediator in (ettlement# The Mediator has the res/onsi ility to see to it that the /anies consider and understand the terms of the settlement#
