Its hyped as the toughest dont drink and
drive law in Canada. And theres no doubt
BCs immediate roadside prohibition (IRP)
program is scary, in more ways than one.
Since 2010, this provincial law has allowed
police to issue on-the-spot driving suspen-
sions at the roadside and impound your vehi-
cle if a roadside test suggests you drove with
a blood alcohol concentration of .05 or more.
This is a lot lower than the .08 legal limit in
the Criminal Code. And the driving prohibi-
tion starts immediately.
Suspensions can be for 3, 7 or 30 days if the de-
vice reads WARN (suggesting a level between .05
and .08), depending on whether it`s your frst sus-
pension or not. But its 90 days if the device reads
FAIL, suggesting the level is above the legal limit
in the Criminal Code (i.e., .08 or more).
As well, you face impound charges, money
penalties and other costs and you may also
have to take a responsible driver course ($800-
plus) and get an interlock device put in your
car ($1,730-plus) for a 30 or 90 day suspension.
Driving prohibitions stay on your motor vehi-
cle record, and youll face higher car insurance
premiums too.
If you need to drive a vehicle for work, obvi-
ously a suspension could also play havoc with
your employment.
But as a series of court cases show, the IRP pro-
grams drawbacks overshadow its good inten-
tions. In the zeal to keep drunk drivers off the
roads, too much fairness has been sacrifced.
The problem isnt with the laws goal to mini-
mize the mayhem caused by drunk driving its
that an unfair process, offering insuffcient pro-
tection, can ensnare too many innocent people.
Here are some examples.
In late 2011, our courts decided that parts of
the law were unconstitutional. The province
changed the law so since mid-June, 2012,
police offcers have had to swear to their IRP
reports, which go to the Offce of the Super-
intendent of Motor Vehicles (OSMV). A false
report risks perjury charges.
But the OSMV, responsible for IRP reviews
(appeals) if demanded, continued to accept
unsworn police reports.
When challenged in court, the OSMV argued
this was allowed under some other parts of the
law. Not true, said our appeals court. A further
appeal was refused by the Supreme Court of
Canada.
Our courts have also thrown out IRPs because
the offcer based them on the device alone
without other reasons to think the driv-
ers driving ability was affected by alcohol,
though the law requires this (the OSMV will
likely appeal a recent case).
Remember, you initially have only 7 days
to apply for a review of an IRP. The review
process is quite limited and theres little fair
process protection in the face of an up-front
conviction. In a recent case, the BC Su-
preme Court also noted that in many IRP re-
views, the OSMV seems to try to rationalize
desired results.
Still, there are now many ways to win in a re-
view of an IRP. If you are or have ever been
caught up in an IRP (or OSMV review) situ-
ation, dont just roll over see your lawyer.

Castlegar Seed Library And
Seedy Saturday
A seed library is growing out of Castlegar! As the gar-
dening season fast approaches, regional seeds are in reach
of gardeners in the West Kootenay through the Castlegar
Seed Library Project, a pilot program sprouting out of the
Castlegar Library.
Members of the community can check out seeds just
like one checks out a book, for free. Te Castlegar Seed Li-
brary aims to develop seed breeders and a bank of region-
ally-acclimated, local seed. Growers can take, grow, save,
and at the end of season, return seeds back to the library.
Te Castlegar Seed Library kickof is being held on Satur-
day March 29 from 10 am to noon at the Castlegar & District
Public Library. Be part of our local food history and sign up
to grow seeds, obtain seeds, and hear from local experts on
seed saving and storage, and glean other gardening tips.
Following the kickof, the second annual Castlegar
Seedy Saturday ofers opportunity to buy, trade and ob-
tain garden seeds from local growers. Te seed exchange
runs from noon to 3 pm. Both events are in the lower level
of the Castlegar & District Public Library (1005 3rd Street
Castlegar).
Te initiative is being run in partnership between the
Castlegar & District Public Library, Columbia Basin Trust,

Demi is a dazzling spayed female with
a medium length grey tabby coat. She
is an approximately 1 year and 7 month
old kitty who came to live at the Trail
Regional BCSPCA after she was found
as a pregnant stray. Her fnders allowed
her to give birth in their home but could
not keep Demi or her new little family,
so she was brought into the shelter on
July 24, 2013.

her own times for attention. When shes
in the right mood, Demi can be very

Seats Still Available For Selkirk
College Rural Pre-Medicine Program
With interest in the Selkirk College Rural Pre-Medicine
Program high, the application deadline has been extended
to provide more opportunities for those interested in get-
ting a start on a career in medicine.
Selkirk College launched the Rural Pre-Medicine Ad-
vanced Diploma and Associate Degree Program late last
year. Te three-year program has received signifcant in-
terest, but with a few seats lef in the inaugural cohort the
college will now accept applications until the end of April.
Te program has been very well received and we are
pleased with the high quality of applications that have
been submitted so far, says Elizabeth Lund, Selkirk Col-
lege chemistry instructor and originator of the program.
Tis new program and getting the word out to all of those
who might be interested in applying has been a challenge.
We wanted to ensure that any interested applicants would
have the opportunity to learn about the program and get
their applications in. Based out of the Castlegar Campus,
the program is geared towards addressing the rural doctor
shortage across Canada and ofers students the opportun-
ity to learn in the intimate setting of a community college.
In creating this program, Selkirk College has worked
closely with the UBC Faculty of Medicine, the Rural Co-
ordination Centre of BC (a joint venture of the BC Medical
Association, the Ministry of Health and the UBC Faculty
of Medicine), the Native Education College, the Interior
Health Authority, Columbia Basin Trust, local physicians,
nurses, nurse practitioners and other health care providers.
Te start date of the program is Fall 2014 with an initial
cohort of 24 students admitted to the program.

Eight Ways to Downsize
Here are some proven tips and techniques that you can
begin implementing today, even if your move is years away.
Remember that the key to losing 100 pounds is not losing
the 100th pound; its losing the frst one. Te key to down-
sizing is not fnishing the process; its starting it.
1. Stop warehousing your grown kids stuf. Do they visit
their things but not take them home? If so, put them in a
box and place it by the door so your kids can take the car-
ton with them the next time they visit. (If they dont want
their college textbooks and tennis trophies, you dont need
to keep them either).
2. Decide on what go means. It may sound silly, but this
goes can mean you are getting rid of it or taking it with you.
To avoid confusion, decide what go means and use it con-
sistently. Better yet, use removable color-coded dots to sep-
arate what you are keeping and what you are getting rid of.
3. Be clear. If you plan on temporarily storing things in
trash bags, use clear bags for items being stored and opaque
bags for regular trash. We once stored all our winter gloves
and hats in a white kitchen trash bag, only to discover we
had accidentally thrown them out!
4. Trow a downsizing party. Cover your dining room
table with items you no longer need and invite friends over
for cofee, with the caveat that they must take one thing away
with them. Its fun, and since each person selects what she
wants, everyone leaves thinking that they found a treasure.
5. Develop a kitchen tracker. A kitchen tracker is simply
a form that helps you track how ofen you use certain items
in your kitchen. List the items that you dont use frequent-
lylike the ice bucket, Cuisinart, electric mixer, blender,
bundt pan, 30-cup cofee urn, heating tray, turkey roaster,
dutch oven...the list could go on, right? Keep the list on your
refrigerator. Whenever you use an item on the list, make a
check mark next to it. At the end of six months, look at the
items without check marks. You may be surprised to fnd
that you dont use some of those items afer all.
6. Keep sorting sessions short. By that I mean two hours
at most, and start with the simplest room frst. Starting with
the most complicated area means you may get discouraged,
throw up your hands and quit. Starting with a simple room
helps build the confdence to say, I can do this.
7. Once you start working, dont leave the room. Its hu-
man nature to get distracted especially from something
we dont want to do in the frst place.
8. And fnally: DONT PACK! Remember, you are months
or even years away from moving. If you can pack something
away knowing that you wont need it until you move, you
probably dont need it now.

Te Community Fund of North Kootenay Lake Society
(CFNKLS) is entering its ninth year of making grants to
registered charities in Kaslo and Area D. CFNKLS, oper-
ating under the wing of the Osprey Community Foun-
dation, now has assets of $500,000 which, along with a
$3,630 grant from the Kootenay Savings Community
Foundation will generate $23,000 in grants for 2014. In-
cluded in these fgures are four Field of Interest funds
(Seniors Fund; Child, Youth, and Family Fund; and En-
vironment Fund, Arts & Culture Fund) which now hold
suf cient assets to make grants on their own.
Tere is $3,000 available as bursaries from the McKin-
non Family Fund for students wishing to pursue post sec-
ondary training in Trades and Vocations.
