This CD is o nly available as an appendix to the Digital Communications textbook by Bernard S klar, published by Prentice-Hall 2001. Please read very carefully before installing or using this part of the Companion CD. For brevity, the Digital Communications CD Appendix is refered to as Compan ion CD below. The Companion CD is provided as an appendix to the Digital Communications (2nd E dition) textbook by Bernard Sklar, published by Prentice-Hall, 2001. The Compan ion CD is not available by any other means and must not be sold or distributed s eparately. If you did not acquire this CD as the sealed backcover appendix to the above-named textbook, then please inform the publisher immediately and retur n the illegal disk to the publisher. The value of the Companion CD is $0.25 (twenty-five US cents) of the cost of the textbook. Refund or reimbursement costs for the CD will therefore not exceed t his amount. By inserting the Companion CD in your PC CD drive you indicate accep tance of this license agreement and the Software License Agreement by Elanix, In c. (attached below). No responsibility is taken by the author or publishers of the Companion CD for any loss or damages arising out of your use of this product however it may be caused. Should you be in any doubt or have any reservations a bout the use of the Companion CD, then do not install. 1. ISSUE OF LICENSE: This agreement permits you to use the Companion CD for the purpose of learning about digital signal processing and communications. Proper u

se of the Companion CD is viewing files, printing to paper copy, replaying audio files and running SystemView examples via an IBM compatible PC. Some parts of t he Companion CD may be password protected, and certain sections cannot be printe d to hardcopy. The license is for a single user only and the Companion CD must n ot be placed on a network. You are limited to printing one complete copy of avai lable manuals and other printable output of the Companion CD. The printed output and recorded audio segments of the Companion CD also constitutes materials that are copyrighted and must not be duplicated or stored by electronic means. 2. COPYRIGHTS AND RESTRICTIONS: The materials on the Companion CD are protected by international copyright laws and international treaty provisions. 3. LIMITED WARRANTY: For 60 days from the date of receipt, the physical Companio n CD compact disc is guaranteed free from defects in materials or in workmanship . As far as possible every care has been taken in ensuring all materials are co mplete and run error-free on Windows operating systems. Should this NOT be the case, the publisher, authors, and Elanix take no responsibility for any effort or costs associated with correction or usage. 4. LIMITATION OF LIABILITIES: Under no circumstances will the publisher or autho rs be liable for any indirect, accidental, special, economic or consequential da mages out of the use or inability to use the Companion CD even if advised of suc h damages. In no event will the liability of Companion CD exceed the amount paid by you for the software. Please treat it as valuable pr operty. ELANIX LICENSE AGREEMENT This is a legal agreement between you (either an individual or an entity), and E LANIX, Inc. If you do not agree to the terms of this Agreement, promptly return the diskette and/or CD-ROM package and all accompanying items (including writte n materials and binders or other containers) to the place you obtained them for a full refund. ELANIX SOFTWARE LICENSE 1. GRANT OF LICENSE. This ELANIX License Agreement ('License') permits you to use one copy of the specified version of the ELANIX software product identif

ied above ('SOFTWARE') on any single computer, provided the SOFTWARE is in use o n only one, computer at a time. If you have multiple Licenses for the SOFTWARE, then at any time you may have as many copies to the software in use as you have Licenses. The SOFTWARE is 'in use' on a computer when it is loaded into tempor ary memory (i.e. RAM) or installed into the permanent memory (e.g. hard disk, CD ROM, or other storage device) of that computer, except that a copy installed on a network server for the sole purpose of distribution to other computers is not 'in use.' If the anticipated number of users of the SOFTWARE will exceed the num ber of applicable Licenses, then you must have a reasonable mechanism or process in place to assure that the number of persons using the SOFTWARE concurrently d oes not exceed the number of Licenses. If the SOFTWARE is permanently installe d on the hard disk or other storage device of a computer (other than a network s erver) and one person uses that computer more than 80% of the time it is in use, then that person may also use the SOFTWARE on a portable or home computer. 2. COPYRIGHT. The SOFTWARE is owned by ELANIX or its suppliers and is prot ected by United States copyright laws and international provisions. Therefore y ou must treat the SOFTWARE like any other copyrighted material (e.g. a book or m usical recording) except that you may either (a) make one copy of the SOFTWARE s olely for backup purposes, or (b) transfer the SOFTWARE to a single hard disk pr ovided you keep the original solely for backup or archival purposes. You may no t copy the written materials accompanying the SOFTWARE without the express writt en consent of ELANIX. 3. OTHER RESTRICTIONS. This License Agreement is your proof of license to exercise the rights granted herein and must be retained by you. You may transfe r your rights under this ELANIX License Agreement on a permanent basis provided you (1) transfer this License Agreement, the SOFTWARE, and all accompanying writ ten materials and retain no copies, and the recipient agrees to the terms of thi s Agreement, (2) you obtain the express, written approval of ELANIX, Inc. prior to transferring the SOFTWARE. You may not reverse engineer, de-compile, or disa ssemble the SOFTWARE. You may not use the SOFTWARE for commercial purposes. An y transfer of the SOFTWARE must include the most recent update and all prior ver sions. 4. DUAL MEDIA SOFTWARE. If the SOFTWARE package contains both 3.5 inch disk s and CD-ROM, then you may use only the disk(s) appropriate for your single desi gnated computer or network server. You may not use the other disks on another c omputer or computer network, or loan, rent, lease, or transfer them to another u ser except as part of a transfer or other use expressly permitted by this ELANIX License Agreement. LIMITED WARRANTY. ELANIX warrants that (a) the software will perform substantia lly in accordance with the accompanying written materials for a period of ninety (90) days from the date of receipt; and (b) any hardware accompanying the SOFTW ARE will be free from defects in material and workmanship under normal use and s ervice for a period of one (1) year, respectively. Some states do not allow lim itations on duration of and in implied warranty, so the above limitation may not apply to you. CUSTOMER REMEDIES. ELANIX's entire liability and your exclusive remedy shall be the repair or replacement of the SOFTWARE or hardware that does not meet ELANIX 's Limited Warranty and that is returned to ELANIX with a copy of your receipt. This Limited Warranty is void if failure of the SOFTWARE or hardware has result ed from accident, abuse, or misapplication. Any replacement SOFTWARE will be wa rranted for the remainder of the original period or thirty (30) days, whichever is longer. Neither these remedies nor any product support services offered by E LANIX are available for this U.S.A. and Canada version product outside the Unite d States of America or Canada.

NO OTHER WARRANTIES. ELANIX disclaims all other warranties, either express or i mplied, including but not limited to implied warranties of merchantability and f itness for a particular purpose, with respect to the SOFTWARE, the accompanying materials, and any accompanying hardware. This limited warranty gives you speci fic legal rights. You may have others, which vary from state to state. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall ELANIX or its supplie rs be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business informatio n, or other pecuniary loss) arising out of the use of or inability to use this E LANIX product, even if ELANIX has been advised of the possibility of such damage s. Because some states do not allow the exclusion or limitation of liability fo r consequential damages, the above limitation may not apply to you. US GOVERNMENT RESTRICTED RIGHTS The SOFTWARE and documentation are provided with RESTRICTED RIGHTS. Use, duplic ation, or disclosure by the Government is subject to restrictions as set forth i n subparagraph (c)(1)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-701 3 or subparagraphs (c)(1) and (2) of the Commercial Computer Software - Restricted Rights at 48 CFR 52.227-19 as applicable.
