CONSTITUTION OF FAMILY COURT: ITS AIMS AND OBJECTIVES

INTRODUCTION Family is a rapidly changing concept. From being a disorganised set of people living in clans, it has evolved to become the fundamental unit of human society. Burgess & Locke describe family as a group of people united by ties of marriage, blood or adoption constituting a single household interacting and intercommunicating with each other in their respective social roles, creating a common culture. This social entity is not stationary. As is the case with all relations, disputes arise in family as well. Family disputes need protection of honour and position of the parties in the society. Hence family courts were constituted, so that in camera proceedings could be carried out without legal hassles, at the earliest. A family court focusses on reconciliation. It has all the attributes and satisfies all ingredients of a court of law. Matters like matrimonial relief, property, legitimacy, guardianship, etc lie in its jurisdiction. AIMS AND OBJECTIVES 1. To understand the basis of family law. 2. To study the need of family courts. 3. To know about the jurisdiction and procedures of family courts. 4. To comprehend and appreciate the goals and intents of family courts. HYPOTHESIS Family courts help in speedy trials. The courts are already under the burden of a lot many cases. In such circumstance the emergence of family courts saves the time of the courts. It also helps in the protection of the dignity of individuals. For the fear of being laughed at by the public, people dont take matters to court. But the in camera proceedings in family courts facilitate people and encourage them to resolve domestic disputes. METHODOLOGY Doctrinal Method has been adopted in the project.
