NOW, COMES the Petitioners, David Lee; Buess & Rodney Dale; Class with this PETITION FOR REVIEW OF NOTICE OF APPEAL PROCEDURES VIOLATION, VIOLATION OF 28 USC 1652, PUBLIC LAW VIOLATION, CONSTITUTIONAL, AND VIOLATION OF STATE OF EMERGENCY UNDER BANKRUPTCY CLAUSE VIOLATION. The Petitioners brought an administrative claim into the Administrative Tax Court, only to see it moved by the Defendants into a court that held an 11th Amendment standing with No Judicial Power to hear a Claim on Law and Equity. This Notice is to let the Defendants know that an Appeal is being filed on CASE #: 1:09-cv-02151-HHK.

1. The UNITED STATES DISTRICT COURT OF THE DISTRICT OF COULUMBIA has violated it s own standards, pursuant to U.S.C. Title 28 judiciary and judicial procedures and especially section 1652 of this Title. 2. The IRS and the defendants knowingly violated Pubic Laws under P.L.10 48, 48 stat 112, P.L.1 48 stat C,1, and P.L. 73-10, 48 stat 411. 3. They violated their Constitutional Oath to uphold all the Statutes as written by Congressional Acts . 4. The Defendants violated Public Law, more specifically the State of Emergency Bankruptcy Clause of 1933 as agreed to. 5. The government made it a criminal penalty for the people to own gold and silver in order to pay their debts. 6. The Petitioners and the People had no choice but to come into compliance with P.L. 10 ch. 48, 48 stat 112 or face criminal charges. 7. The IRS and the Defendants were required to discharge or cancel the debt on behalf of the Petitioners and the People. 8. U.S.C. Title 26 sections 6331 defines who comes under tax liens, the defendants have abused this private law. 9. The 16th Amendment of the U.S. Constitution gave the government no new means of taxing, from that time until now. 10. Under the Statutes at Large, the Tax Code Volume section defines the tax codes and to whom it applies. 11. The State of Emergency under Bankruptcy gave the people no means to pay such a debt as all gold and silver had been taken under penalty of imprisonment. ch.

12. The Petitioner had demanded an Administrative Hearing only to have it denied by the Court and the defendants. 13. The Petitioners were entitled to exhaust their administrative relief and remedies only to be denied by all parties. 14. The Petitioners did give the defendants a means of 12 b 6 only to have it turned down as it was not to their liking.
