Subject : Illegal and forceful dislocation of Complainants from their lands and violation of Human Rights of daily wage earners belonging to Scheduled Castes, Scheduled Tribes and Minorities in NTR Nagar. Respected Sir,

I, the undersigned, on behalf of the NTR Slum Dwellers Upliftment Society, beg to submit the following Complaint for your kind consideration.

The Complainants are Residents of Sy.No.13 and 14, Saroornagar village, GHMC L.B. Nagar Zone, Ranga Reddy District. They are daily wage earners and mostly work as labourers to eke out a living. For many years the men have been going to any place which offers them work, even out of the city/state. In such times the women and children have been living in the subject lands from the last 20 and more years. They are currently pursuing the Government to regularize the subject lands in their favour and enable them to provide for a shelter for their children and women.

All the petitioners in writ petition No.11569 of 2008 and writ petition No.6564 of 2012 have made applications for regularization of the subject lands in their favour and the same have been pending from many years. They also obtained various orders

periodically from the Honble Court of Andhra Pradesh directing the Respon dent Authorities and private persons to not disturb the possession of the Petitioners and the latest order dated 20.04.2014 in Writ Petition No.6564 of 2012 dated directs all

parties to maintain status quo as on that date. The said Orders have been enclosed along with this Complaint.

It is submitted that as on that date the residents were in occupation of the subject lands and their huts and dwellings have been present on the site for many decades. However, in spite of the said order of this Honble Court, driven by greed and other vested elements, on 22.03.2013, the Authorities with the help of the police who are acting as their henchmen came and set fire to our dwellings and drove many of us out of the subject lands using brute force to which we immediately filed a contempt case. The said matter came up for hearing and they sought time to get instructions and file their counter which they have not filed to this day.

It appears that HUDA Vanasthalipuram, in collusion with the some powerful and politically connected Developers, is creating third party rights and claiming that this land was assigned to one Chitra Layout Colony Welfare Association and that it has a right in the subject property.

These actions were resisted by us stating that we are all part of the group of Slum Dwellers Upliftment Society, which was litigating against the Government and other powerful private persons for decades in respect of land in Sy.No.9/1 and abutting lands and that we have orders of this Honble Court directing status quo to be maintained and that any action against us would amount to violation of the same and that the contempt case was also pending.

Sy.No.13 and 14 are abutting lands across the road to the NTR Nagar Colony, which is comprised in Sy.No.9/1. It is of course true that the occupation in Sy.Nos.13 and 14 is much later to Sy.No.9/1 and there is no dispute with regard to the fact that it is a government land. As far as Sy.No.9/1 is concerned, there had been a dispute whether it is a Government land or land belonging to the said P.V. Hanumantha Rao.

It is further submitted that further litigation is still pending with regard to his right to evict us through process of Land Grabbing Act. The matter is pending before this Honble Court in the form of Writ Petition Nos.861 of 2008 and 381 of 2008. Further, in respect of Sy.Nos.13 and 14, our application for regularization of our possession is long pending and it is only just that the Government grant house site pattas to landless persons who have been in possession for over 20 years.

Suddenly on 23.03.2014, taking advantage of the present political situation, the executive authorities of HMDA in collusion with the support of some other land grabbers, came to the spot and started pulling down with brute force, the huts of the remaining petitioners and some other poor people who are not parties to these writ petitions. I submit that neither women nor children were spared and many persons were hospitalized with severe bleeding wounds and injuries in this macabre and undemocratic and barbaric police action.

Many of the Complainants huts have been burnt and they are left with no shelter and the respondents are also constructing compound wall and creating a private property out of the subject property. All such complainants who have opposed the same have been thrashed by the Police and have been subjected to torture in the police lockups

and innocent daily wage earners have been threatened with being branded as history/Rowdy- sheeters and that their life will be made unbearable. Many injured persons have been hospitalized and even the media personnel who reached the site were, in front of the residents given bribes to suppress the story and the atrocities have either not been reported at all or have been wrongly covered to show as if it was the Complainants themselves who were forcibly entering the lands and trying to construct. As many as 70 to 80 families have been driven out of their huts and were severely beaten up. We have enclosed several photographs which were taken on that day which clearly show the extent of damage that was inflicted on the Complainants.

Such an assault on the inhabitants of NTR Nagar who also belong the Scheduled Caste, Scheduled Tribes is violative of various sections of the SC/ST (Prevention of Atrocities) Act, 1989. They have infringed various sections of the Act including Section 3 (1) (v) which states that wrongful dispossession of a Scheduled Caste or a Scheduled Tribe member from a land belonging to them is an offence under this Act.

What astounds us the most is that one Krishna Devi, the AEO, HMDA despite being a Respondent in the pending contempt case colluded with the HMDA, the Animal Husbandry Department, and the Police and with utter disregard to the status quo order carried out such a heinous atrocity. Several high ranking Police Officers like Nanu Nayak (S.I.), Srinivas Reddy (C.I.), Sita Ram (ACP), Vishwa Prasad (DCP) were present and along with Anji Reddy, the President of the Chitra Layout Colony Welfare Association were present and willfully participated in the said atrocity.

This is a complete failure of the administration of justice in our state and given the current political scenario, the Complainants dread to think as to what is going to happen in the coming days and seek the protection of this Commission.

It is submitted that we are not in a position even to go to police as the local police in its entire force was a participant in arson and assault. We come before this Commission asking to protect our body and limbs, we require shelter and the people who are injured in this assault are to be treated by giving some medical help. It is humbly prayed before this Commission that an inquiry maybe conducted and recommendations be made to the Government and further any other steps be taken in order to restore the seized land to the Complainants.
