This appeal raises constitutional issues of exceptional importance in Virginia and nationwide. Five sets of parties have briefed these issues and seek to participate in oral argument. To ensure that this Court has the full benefit of all of these perspectives at oral argument, all parties to this appeal now jointly move, pursuant to Local Rule 34(d), that oral argument time in this case be extended to one houran addition of ten minutes per sideto be divided evenly between those seeking reversal of the judgment of the district court and those seeking affirmance. Those parties seeking reversal of the judgment below, Appellants Schaefer and McQuigg, propose to allocate their time by agreement. Those seeking affirmance, the Bostic plaintiffs, the Harris class, and Janet Rainey, agree that their time should be allocated as follows: Bostic plaintiffs: 13 minutes; Harris class: 7 minutes; and Janet Rainey:10 minutes. PROCEDURAL HISTORY On February 24, 2014, the district court entered final judgment in this case, declaring that Virginias marriage laws are unconstitutional insofar as they prohibit same-sex couples from marrying and deny state recognition to same-sex couples lawful marriages from other jurisdictions. The court enjoined enforcement of those laws, but stayed the injunction pending appeal. (No. 2:13-cv-00395-ALWA (ECF# 139)). Defendant George E. Schaefer, III, and Intervenor/Defendant

Michle B. McQuigg filed timely notices of appeal. Although she supported the district courts ruling, defendant Janet M. Rainey also filed a notice of appeal. On February 26, 2014, the Harris class filed a motion in this Court to intervene on appeal and for leave to file separate briefs. (ECF #6.)The Harris class is the certified class in Harris v. Rainey, No. 5:13-cv-77 (W.D. Va.), which consists of approximately 14,000 same-sex couples in Virginia who will be affected by the outcome of this appeal. The next day, the then-existing parties filed a consent motion concerning briefing and argument. (ECF # 12.) The parties agreed that, although she is technically an appellant, Rainey would be joining the appellees in urging that the district court ruling be affirmed, and should file a response brief at the same time as the appellees. Appellants Schaefer and McQuigg also requested leave to file separate briefs. On March 10, 2014, this Court granted both the then-existing parties motion concerning briefing and argument, and the Harris classs motion to intervene, and granted each set of parties leave to file separate briefs. (ECF # 38.) This case is set for oral argument on May 13, 2014. ARGUMENT As the Court implicitly recognized by allowing the parties to file separate briefs and permitting intervention by the Harris class, this is a case of exceptional importance involving weighty constitutional issues. In order to ensure that the 3

Court has an adequate opportunity to explore all of these issues, and to hear from all of the affected parties, the time for oral argument should be extended to one hour30 minutes for those seeking reversal of the judgment of the district court, and 30 minutes for those defending the judgment of the district court, allocated among each set of parties as set forth above. The proposed extension here is consistent with what other courts have permitted in cases raising similar issues. For example, the Tenth Circuit recently granted a motion to extend the oral argument time to one hour in a case challenging Utahs prohibition on same-sex marriage, even though there is only one set of parties on each side in that case. Kitchen v. Herbert, No. 13-4178 (10th Cir. April 7, 2014) (ECF No.1019229701); see also Perry v. Hollingsworth, No. 11-16577 (9th Cir. Nov. 25, 2011) (ECF No. 7979095) (allowing each side thirty minutes of oral argument time). The proposed extension also comports with the standard practice of allowing 30 minutes per side in cases of exceptional importance, including in cases argued en banc before this Court and cases argued in the Supreme Court. CONCLUSION For the foregoing reasons, the parties to this appeal jointly request that the time for oral argument be extended to one hour, and that the time be allocated among the parties as suggested above. 4
