On or about Apr 14 2014 at about 5:00PM at inside 111 Wadsworth, 10E in the County and State of New York, the defendants the defendants knowingly and unlawfully possessed a substance containing a narcotic drug and said preparations, compounds, mixtures and substances are of an aggregate weight of eight ounces or more; the defendants knowingly and unlawfully possessed a substance containing methamphetamine, its salts, isomers or salts of isomers and said preparations, compounds, mixtures and substances are an aggregate weight of two ounces or more; the defendants knowingly and unlawfully possessed a narcotic drug with intent to sell it.

The factual basis for these charges are as follows: I am informed by Senior Investigator Bernard Malone, of the Investigation Unit of the Office of the Special Narcotics Prosecutor, that on April 14, 2014, at approximately 4:30pm, Investigator Malone participated in the execution of a search warrant on 111 Wadsworth Avenue, Apartment 21E, in New York County. Investigator Malone observed one person inside the apartment: defendant Abreu. Inside the apartment, Investigator Malone observed the following items: (i) more than $100,000 in U.S. currency; (ii) numerous narcotics-related records and ledgers; (iii) more than two ounces of methamphetamine; (iv) an electrical bill for 111 Wadsworth Avenue, Apartment 10E; and (v) a set of keys. I am further informed by Investigator Malone that on April 14, 2014, at approximately 9:00pm, Investigator Malone also participated in the execution of a search warrant on 111 Wadsworth Avenue, Apartment 10E, in New York County. Investigator Malone observed that there were no people inside Apartment 10E at that time. Inside the apartment, Investigator Malone observed the following items: (i) more than eight ounces of heroin; (ii) a surveillance camera system with cameras observing the hallway outside of Apartment 10E; and (iii) a device which Investigator Malone recognized, in his training and experience, as consistent with devices used to press kilogram-weight quantities of narcotics into bricks. I am informed by Detective Pat Carroll of the Nassau County Police Department that Detective Carroll participated in the stop of defendants Paulino and Garcia, who were traveling in a taxicab together at the time they were stopped. Detective Carroll searched defendant Garcia and recovered, among other items, a set of keys from defendant Garcia. Detective Carroll later gave these keys to Detective Leo O'Hara of the Nassau County Police Department. I am informed by Detective O'Hara that he also participated in the execution of the search warrant on 111 Wadsworth, Apartment 21E. Detective O'Hara was the first officer to observe defendant Abreu inside the apartment, and Detective O'Hara observed that defendant Abreu was standing right next to a desk, on top of which were the electrical bill and the set of keys described above. Detective O'Hara later tested both these keys from Apartment 21E and the keys which Detective Carroll recovered from defendant Garcia on the door to Apartment 10E. Both sets of keys matched the door to Apartment 10E, and could lock and unlock the door to Apartment 10E. I am further informed by Investigator Malone that he observed surveillance video from the 21st floor of 111 Wadsworth Avenue for several of the days preceding the execution of the above-described warrants. This video depicted all three defendants repeatedly entering and exiting Apartment 21E, often carrying bags into or out of the apartment, and often in the company of one another. I am further informed by Investigator Malone that, shortly before the execution of the 2

warrant on Apartment 21E, he observed defendant Paulino and defendant Garcia exit 111 Wadsworth Avenue together carrying a piece of furniture, then enter a taxicab together. Investigator Malone believes the substances described above are of the kind and weight they are alleged to be based upon: his professional training as a police officer in the identification of drugs, his prior experience as a police officer making drug arrests and an observation of the packaging, which is characteristic of these types of drug.

False statements made herein are punishable as a class A misdemeanor pursuant to section 210.45 of the penal law.
