DR-CAFTA: Free Trade Agreement between Central America, United States and Dominican Republic
The Free Trade Agreement between Central America, United States and Dominican Republic (DR- CAFTA), in force since April 1st 2006, has promoted the dynamization of the national economy through significant benefits to various sectors, including a preferential access for footwear exports to the United States. The general rule applied for the majority of footwear stipulates that the product should be assembled in the DR-CAFTA region to benefit from the tax-free access to the United States. For example, a shoe assembled in Nicaragua with raw materials from Brazil would qualify as originating and therefore would enjoy preferential access under the DR-CAFTA framework.
Footwear Manufacturing
Furthermore, the neighboring countries in Central America can all be accessed by land in less than a day. Puerto Limon in Costa Rica and Puerto Cortes in Honduras are only a seven and nine hour ride away, respectively.
However, there is an exception applied to certain tariff lines, which reflects a stricter rule of origin. Such rule of origin indicates that the products should comply with the following conditions to be considered as originating: 1. The uppers should be manufactured within the DR-CAFTA region. 2. The finished product should have a regional value content equal or higher than 55 percent (under the value reduction method). This exception is applied to different kinds of footwear made of impermeable or synthetic materials, specifically to the following tariff lines: 6401.10.00, 6401.91.00, 6401.92.90, 6401.99.30, 6401.99.60, 6401.99.90, 6402.30.50, 6402.30.70, 6402.30.80, 6402.91.50, 6402.91.80, 6402.91.90, 6402.99.20, 6402.99.80, 6402.99.90, 6404.11.90, 6404.19.20.

Footwear Manufacturing
Nicaragua has the most competitive labor costs in the region, which makes the country a highly attractive location for labor-intensive manufacturing operations.
Nicaragua is not only the most competitive option in the region, but it is also drawing the attention of international companies looking to move out of Asia. China, in particular, represents a series of challenges for producers and exporters due to the rise of labor costs, particularly in coastal areas; wages can reach up to US$1.70 per hour or more, comparable to Mexicos. Besides, there is a shortage of Chinese labor in the apparel and footwear industries. This situation in Asia challenges traditional supply models (sourcing) and encourages companies to explore and develop more competitive and closer production platforms to certain destination markets like the United States, making the option of operating in Nicaragua increasingly attractive due to its costs and location.
Acuerdo Tripartito
Tripartite Agreement
Since 2009, the Nicaraguan Government, union leaders and the private sector agreed the annual minimum wage adjustments under the Free Zone Regime in an effort to provide predictability in labor costs and to foster the growth of the manufacturing sector and employment. This consensual effort, called the Tripartite Agreement, establishes the rates of minimum wage increase in advance for subsequent years. This arrangement, unprecedented in Latin America, has been widely recognized as a success that has contributed to the growth of operations under the free zones regime. The Tripartite Agreement was renewed for a third time in 2012. By virtue of the last agreement, it was established an inter-annual growth rate of eight percent in cordobas (equivalent to 2.9 percent in dollars) for the period between 2013 and 2017. The following table illustrates the minimum wage that will be applied for each year between 2014 and 2017, including fringe benefits according to law.
