Conduct Complaint against Inspector Richard Clare believed to be engaged with Wakefield Central NPT of West Yorkshire Police

and based at Wood Street police station. Made on behalf of: Stephen Bradbury (the co plainant! and dated "nd #an$ar% "&'(

1. Events giving rise to the complaint

a. The co plainant has long)r$nning and well)rehearsed co plaint iss$es with West Yorkshire Police concerning a n$ ber of violent and $nprovoked assa$lts on hi b% officers that have happened in *$ddersfield (twice! and Wakefield (three ti es!. These have $s$all% been followed b% the $nlawf$l arrest of the co plainant. b. *e has been repeatedl% obstr$cted b% the +orce in his search for the tr$th and appropriate re ed%, lied to repeatedl% b% Professional Standards and other investigating officers, evidence pertaining to those assa$lts ta pered with and a legal $ndertaking breached b% a senior officer in disclosing aterial belonging to the co plainant when e-pressl% restrained fro so doing.. c. *aving e-ha$sted all reasonable approaches to the +orce . and in al ost ever% case been reb$ffed ) part of the co plainant/s search for the tr$th and appropriate re ed% has involved hi seeking to identif% his police assailants, photograph the and then co pile a co posite video for p$blic broadcast on the internet. *e is lawf$ll% entitled to do this and feels it is his p$blic d$t% to ake widel% known the behavio$r of these th$gs, as0$erading as warranted police officers. d. The co plainant when in attendance o$tside *$ddersfield police station, Wood Street police station or +orce *1 alwa%s atte pts to cond$ct hi self in a co$rteo$s and reasonable anner. *e is s all in stat$re, aged 2" and not at all aggressive in an% wa%. e. 3n 4'st #an$ar% "&'" the co plainant had gone to the rear of Wood Street police station in Wakefield cit% centre to tr% to identif% and photograph so e or all of the assailants who had assa$lted and falsel% arrested hi the previo$s 3ctober and 5ece ber. *e feels ver% strongl% that the p$blic are entitled to know the na es and faces of officers $nable to control their aggression and who are prepared to e-ceed their lawf$l powers witho$t re ed% fro the +orce that deplo%s the . f. 6n incident ens$ed between the co plainant and 5C T%ler, a *M7T detective which has been the s$b8ect of a separate co plaint in which 5C T%ler was fo$nd to have breached P6C7. 5C T%ler has alleged that he arrested the co plainant on s$spicion that he was a terrorist, altho$gh he o itted to ention this to the co plainant at the ti e. 6fter the 9arrest: (witho$t stating gro$nds or giving a ca$tion! P; Clare appeared on the scene and ordered the de)arrest of the 9terrorist s$spect:, who i ediatel% asked to ake a co plaint against 5C T%ler concerning the circ$ stances and anner of the arrest and de)arrest. P; Clare ref$sed to take the prima facie co plaint against 5C T%ler witho$t stating an% reason for not so doing.

g. The co plaint against P; Clare had been sta%ed pending the o$tco e of ediation between the co plainant and West Yorkshire Police. The +orce, having ade an 1

$nsatisfactor% witho$t pre8$dice offer to settle all clai s have now $nilaterall% withdrawn fro the ediation process.

2. Grounds for complaint

a. <nder Sched$le ' of the Police (Cond$ct! =eg$lations "&&> all police officers are re0$ired to perfor to the highest personal and professional standards as set o$t in Standards of Professional Behaviour b. ;n this co plaint, atters are aggravated b% the fact that the officer co plained abo$t is of s$pervisor%? anagerial rank and, as s$ch, entr$sted b% the +orce in aintaining those ver% Standards and disciplining those that fall below the . c. This co plaint alleges the following breaches of those Standards. d. ;ncivilit%: P; Clare failed to treat the co plainant with appropriate respect and co$rtes% at the scene of the incident and treat the events that had taken place at face val$e. This is aggravated b% re arks that P; Clare ade in his s$bse0$ent written acco$nt in which he describes the co plainant as a 9persistent n$isance:. e. +orce Polic%: The fail$re to respond to or to acknowledge the co plainants re0$est to file a co plaint against 5C T%ler is, additionall%, in breach of the +orce/s @Police Pledge/. f. 6b$se of 6$thorit%: The officer in aking representations, on behalf of the +orce, concerning the co plainant wanting 9to get hi self arrested: de onstrabl% e-ceeded his?her?their powers and a$thorit%. The co plainant ost definitel% does not want to get arrested, or anhandled. *e wants the +orce to deal with his legiti ate concerns abo$t the cond$ct and perfor ance of certain officers.

g. +ail$re of 5$t% and =esponsibilities: P; Clare had a clear d$t% to treat the events that had taken place at face val$e and record the co plainant/s concerns. ;t was plain that 5C T%ler had breached P6C7 and the co plainant had 8$stifiable gro$nds for having his concerns recorded and 5C T%ler dealt with appropriatel%.

a. ;n view of the seniorit% of the officer, the allegations ade against P; Clare and the aggravated nat$re of the iss$es between the +orce and the co plainant this is not a atter that, in the prevailing circ$ stances, can be disposed of b% Aocal =esol$tion. b. 6 proportionate ;nvestigation sho$ld take place b% an officer of appropriate rank and, in order to aintain hierarchal independence, b% an officer not engaged in Wakefield 5ivision. This is $nderscored b% the rel$ctance of P; Clare/s 5ivisional Co ander to dispose of the atter infor all%, b$t appropriatel%. c. ;t is preferable that investigator and co plainant co $nicate b% e ail so that there is an appropriate and specific a$dit trail of each and ever% contact. ;f telephone calls or eetings beco e necessar%, or $sef$l, then the% will be a$dio recorded. ;t wo$ld be open to the investigator to do the sa e and he?she wo$ld be enco$raged to do so.
