THE PUNJAB PROTECTION AGAINST HARASSMENT OF WOMEN AT THE WORKPLACE (AMENDMENT) ACT, 2012 (III of 2013) [5th January, 2013] An Act to amend the Protection Against Harassment of Women at the Work !ace Act 2010" P"&'+2%&. Whereas it is expedient to amend the Protection Against Harassment of Women at the Workplace Act, 2010 (I of 2010! for p"rposes hereinafter appearing# It is enacted as follo$s%& 1 S!o"# #$#%& '() *o++&(*&+&(#. (1! 'his Act ma( )e cited as the P"n*a) Protection Against Harassment of Women at the Workplace (Amendment! Act 2012. (2! It shall come into force at once. 2 A+&()+&(#, $( A*# I- of 2010 . In the Protection Against Harassment of Women at the Workplace Act 2010 (I of 2010!, hereinafter referred to as the said Act, for the $ord +,m)"dsman-, $here.er occ"rs, the $ord +,m)"dsperson- shall )e s")stit"ted. 3 A+&()+&(# $( ,&*#$o( 1 of A*# I- of 2010 . In the said Act, in section 1, for s")section (2!, the follo$ing shall )e s")stit"ted%& +(2! It extends to $hole of the P"n*a).. A+&()+&(# $( ,&*#$o( 2 of A*# I- of 2010. In the said Act, in section 2 (a! in cla"se ()!, for the expression +Ind"strial /elations Act, 2000 (I of 2000!-, the expression +P"n*a) Ind"strial /elations Act 2010 (1I1 of 2010!- shall )e s")stit"ted# ()! in cla"se (g! (i! for paragraph (iii!, the follo$ing shall )e s")stit"ted%& +(iii! the a"thorit(, in relation to an organi2ation or gro"p of organi2ations r"n )( or "nder the a"thorit( of the 3o.ernment, the 4ederal 3o.ernment or an( other Pro.incial 3o.ernment, appointed in this )ehalf or, $here no s"ch a"thorit( is appointed, the head of the organi2ation or gro"p of organi2ations#-# and (ii! in paragraph (.ii!, the $ords +a department or a 5i.ision of- shall )e omitted# and (c! after cla"se (g!, the follo$ing cla"se (gg! shall )e inserted%& +(gg! +3o.ernment- means 3o.ernment of the P"n*a)#-.

In the said Act, for section 9, the follo$ing shall )e s")stit"ted%& +3 O+21),7&",o(. 'he 3o.ernment shall appoint the ,m)"dsperson on s"ch terms and conditions as ma( )e prescri)ed. (2! A person shall )e :"alified to )e appointed as the ,m)"dsperson $ho is not less than fort( fi.e (ears of age and (a! has )een or is :"alified to )e a ;"dge of a High <o"rt# or ()! has )een in the ser.ice of Pakistan in =>&20 or a)o.e# or (c! is an eminent ed"cationist $ith not less than fo"r (ears administrati.e experience. (?! 'he ,m)"dsperson shall not (a! hold an( other office of profit in the ser.ice of Pakistan# or ()! occ"p( an( other position carr(ing the right to rem"neration for the rendering of ser.ices. (7! 'he ,m)"dsperson ma( appoint s"ch staff as ma( )e re:"ired to achie.e the p"rposes of this Act.3 A+&()+&(# $( ,&*#$o( 4 of A*# I- of 2010 . In the said Act, for section @, the follo$ing shall )e s")stit"ted%& 84. R&7"&,&(#'#$o( #o Go9&"(o". An( person aggrie.ed )( a decision of the ,m)"dsperson "nder s")section (8! of section 0 ma(, $ithin thirt( da(s of the comm"nication of the decision, make a representation to the 3o.ernor $hose decision shall )e final.5 A+&()+&(# $( ,&*#$o( 11 of A*# I- of 2010. In the said Act, in section 11 (a! in s")section (?!, for the $ords +petition )efore the 5istrict <o"rt-, the $ords +complaint )efore the ,m)"dsperson- shall )e s")stit"ted# and ()! after s")section (?!, the follo$ing s")section (7! shall )e inserted%& +(7!
