Dear Mr. OHarra: The City of Dallas appears to be the airport sponsor of Dallas Executive Airport (KRBD). On information and belief, and as outlined in the attached letter to Mr. Mark Duebner, Director of the City of Dallas, Department of Aviation dated April 14, 2014 (the Duebner Letter), the City of Dallas provided false grant assurances to the Texas Department of Transportation, Aviation Division and/or the Federal Aviation Administration with respect to the receipt of Airport Improvement Program federal grants obtained in connection with the planned upgrade and expansion of KRBD from ARC D-II to ARC D-III standards. Please allow this letter to serve as a formal request to you to initiate an investigation of the City of Dallas pursuant to FAA Order 5190.6B, Ch. 5, based upon the AIP grant assurance violations detailed in the Duebner Letter. Using the Duebner Letter as a reference, I expect the Texas ADO or regional airports compliance officer to: 1. 2. 3. 4. Evaluate the facts surrounding the Duebner Letter and identify possible City of Dallas violations; Clarify the rights and responsibilities of the City of Dallas and me; Offer assistance to resolve the dispute in a manner consistent with the City of Dallas federal obligations; and Provide the City of Dallas the opportunity to comply with its federal obligations voluntarily once the violations are confirmed.
