9ent s&e!ified in 2aragra&h @* )enant sha"" &ay the e &ense of said insuran!e with the rent in e5ua" month"y insta""ments* A"" &ayments to $and"ord re5uired by this &aragra&h sha"" be made and de"i#ered in the manner &res!ribed for &ayment of renta" in 2aragra&h @ of this $ease* )he &ro#isions of this &aragra&h sha"" sur#i#e the e &iration or sooner termination of this $ease* 5. /se !, Premises. )enant sha"" use the 2remises for !on#enien!e store, the retai" sa"e of gaso"ine and other &etro"eum &rodu!ts* )enant sha"" not use the 2remises for any other &ur&ose un"ess $and"ord agrees in writing to su!h additiona" use* 2remises may not be used for any i""ega" &ur&ose, nor any manner so as to !reate any nuisan!e or tres&ass, or in any manner to #itiate the insuran!e or in!rease the rate of insuran!e on the 2remises* )enant sha"" not !ommit or a""ow any waste or nuisan!e u&on the "eased 2remises, and sha"" maintain the 2remises in a !"ean, neat, and order"y and attra!ti#e !ondition* Fai"ure by )enant to !om&"y with the terms of this &aragra&h sha"" !onstitute a defau"t under the terms of this $ease and $and"ord sha"" ha#e a"" rights and remedies a#ai"ab"e to it under this $ease or as otherwise &ermitted by "aw or in e5uity* )enant sha"" -ee& the 2remises free of a"" inse!ts, &ests and rodents and otherwise in a !"ean, safe and sanitary !ondition< !om&"y with and e e!ute a"" &resent and future ru"es, regu"ations and standards re!ommended by any nationa" or regiona" fire &rote!tion asso!iation (or any other body e er!ising simi"ar fun!tions), $and"ord?s insuran!e !arriers and organi6ations estab"ishing insuran!e rates !on!erning )enant?s use of the 2remises and )rade E5ui&ment (in!"uding )enant?s a"terations and additions, if any, thereto)< !om&"y with and obser#e a"" restri!ti#e !o#enants of re!ord whi!h affe!t or are a&&"i!ab"e to the 2ro&erty< &ro#ided, howe#er, the same do not &rohibit the use of the 2remises for the &ur&oses des!ribed abo#e in this &aragra&h* )enant may not, without first obtaining the written !onsent of $and"ord, ma-e any a"terations, additions, or im&ro#ements, in, to or about the 2remises* Any a"terations or other im&ro#ements made during the term of the $ease sha"" be!ome the &ro&erty of $and"ord at the e &iration of the term of the $ease, at $and"ord?s e"e!tion* )enant further agrees not to suffer, &ermit or !ommit any waste, nor to a""ow, suffer or &ermit any odors, #a&ors, steam, water, #ibrations, noises or undesirab"e effe!ts to emanate from the 2remises or any a&&aratus, e5ui&ment or insta""ation therein* B&on noti!e by $and"ord to )enant that any of the aforesaid is o!!urring, )enant agrees forthwith to &rom&t"y !ease and dis!ontinue the same and within ten (10) days thereafter to ma-e su!h !hanges in the 2remises and insta"" therein or remo#e therefrom su!h a&&aratus or e5ui&ment as may be re5uired by $and"ord for the &ur&ose of ob#iating any su!h !ondition, and if any su!h !ondition is not so remedied, then $and"ord may, at its o&tion, enter u&on the 2remises and !ure su!h !ondition in any manner $and"ord sha"" deem ne!essary and add the !ost and e &ense in!urred by $and"ord together with a"" damages, in!"uding reasonab"e attorney?s fees, sustained by $and"ord to the ne t insta""ment of rent due* 6. A44i#i!"$( /ses !, Premises. 8otwithstanding the foregoing, $and"ord sha"" a""ow )enant to insta"" A):s within the 2remises, and use the 2remises as a !he!- !ashing fa!i"ity, fast food fa!i"ities, and the sa"e of &re&ared food, in!"uding de"i foods and fried !hi!-en at its own e &ense subCe!t to any restri!tions of re!ord, and &ay a"" !osts to !onstru!t, insta"", maintain and o&erate same in!"uding but not "imited to !osts for additiona" !onduit and uti"ity !osts* )he insta""ation, !onstru!tion, maintenan!e, and o&eration of su!h im&ro#ements sha"" be in a!!ordan!e with a"" a&&"i!ab"e 6oning, &ermitting, go#ernmenta" ru"es, insuran!e re5uirements, en#ironmenta" re5uirements, and any and a"" other "aws, ru"es, regu"ations, statutes and ordinan!es of a go#ernmenta" agents, as may be a&&"i!ab"e or be!ome a&&"i!ab"e to the insta""ation, !onstru!tion, maintenan!e, and o&eration of the im&ro#ements* )enant sha"" be res&onsib"e for obtaining and &aying for any and a"" e &enses whatsoe#er to obtain !om&"ian!e and the fai"ure of )enant to obtain any su!h 6oning, &ermit, a&&ro#a", or !om&"ian!e hereunder wi"" not be an e#ent of defau"t or otherwise a"ter $and"ord?s right or )enant?s duties under the $ease* $and"ord?s so"e res&onsibi"ity with res&e!t to )enant?s a&&"i!ation or a&&ro#a" &ro!ess for any other fa!i"ities wi"" be to !oo&erate with )enant, without $and"ord in!urring any additiona" !ost or e &ense*

7. O&er$#i!" !, #-e Premises. )enant sha"" (1) -ee& the 2remises, bui"dings, e5ui&ment, fi tures, rest rooms, sidewa"-s, a&&roa!hes, and dri#eways in good !ondition, &ro&er"y "ighted (in!"uding the ob"igation to -ee& the 2remises ade5uate"y "ighted from dus- ti"" dawn during business hours), !"ean, safe, sanitary, and free of trash, rubbish, and other debris in!"uding &ressure washing the !ano&y area and &ar-ing area e#ery two wee-s< (2) -ee& a&&roa!hes, dri#eways, and ser#i!e areas un!"uttered and free of &ar-ed #ehi!"es, trai"ers, and other obstru!tions, in!"uding i!e, and snow, at a"" times< (@) not engage in or &ermit any im&ro&er a!t or !ondu!t on the 2remises detrimenta" to )enant, or $and"ord, or any member of the &ub"i!< (4) !om&"y with a"" "aws, ordinan!es, ru"es, or regu"ations of !onstituted &ub"i! authority a&&"i!ab"e to the use and o!!u&an!y of the 2remises, use of the e5ui&ment and the !ondu!t of the business< (5) -ee& the business ade5uate"y sto!-ed with the &etro"eum &rodu!ts and in#entory norma""y sto!-ed at a first3!"ass !on#enien!e store se""ing motor fue"< (D) -ee& the business o&en twenty four hours &er day, se#en days &er wee-, subCe!t to "imitations or restri!tions im&osed by a&&"i!ab"e "aws, ru"es regu"ations< (E) &rom&t"y a&&"y for and maintain "i!enses, ins&e!ts and &ermits re5uired by any a&&"i!ab"e go#ernmenta" agen!y for the o&eration of the store, in!"uding but not "imited to the sa"e of a"!oho"< and (F) !om&"y with a"" re5uests ne!essary to -ee& the then e isting brand in &"a!e (8G)E, $and"ord reser#es the right to !hange brands)* )enant understands that )enant is re5uired to !om&"y with !ertain a&&earan!es, !"ean"iness and !ustomer ser#i!e guide"ines of the e isting brand of motor fue" or other re&"a!ement brand* )enant sha"" !om&"y with these guide"ines and &ro#ide !ourteous ser#i!e to motor fue" !ustomers* Further )enant agrees to ta-e a"" a!tion reasonab"y ne!essary to maintain the a&&"i!ab"e &etro"eum brand at the "o!ation* 4n the e#ent )enant fai"s to !om&"y with its ob"igations under this &aragra&h, $and"ord may, in addition to any other rights and remedies a#ai"ab"e, ta-e su!h a!tion and0or e &end su!h monies as may be ne!essary to bring the 2remises into !om&"ian!e with su!h guide"ines, ob"igations and any re5uirements to maintain said brand in!"uding those regarding !"ean"iness* 4n the e#ent $and"ord e &ends money or resour!es in this regard, )enant sha"" &ay to $and"ord su!h money e &ended with the 9ent &ayment ne t due* $and"ord agrees to &ro#ide ten (10) days noti!e to )enant &rior to e &ending money hereunder* 8. A9$"4!"me"# !, Le $ s e 4 Premises. )enant agrees not to abandon or #a!ate the 2remises during the )erm, and agrees to use said 2remises on"y for &ur&oses herein "eased unti" the e &iration or termination hereof* 8one of the e5ui&ment sha"" be remo#ed from the 2remises* :. (a) $and"ord gi#es to )enant e !"usi#e !ontro" of 2remises and sha"" be under no ob"igation to ins&e!t said 2remises* )enant a!!e&ts the "eased 2remises in its &resent !ondition and as suited for the intended use by )enant* )enant sha"", throughout the )erm of this $ease, at )enant>s e &ense, maintain in good order and re&air the "eased 2remises and a"" other e5ui&ment, and a"" other im&ro#ements, fi tures and e5ui&ment "o!ated on the 2remises* )enant further agrees to !are for the grounds around the bui"ding, in!"uding the !are of shrubs, genera" "ands!a&ing* )enant agrees to return said 2remises and the E5ui&ment to $and"ord at the e &iration or &rior to termination of this $ease in as good !ondition and re&air as when first re!ei#ed, natura" wear and tear and a!ts of Hod e !e&ted* 4f )enant u&dates or re&"a!es any e5ui&ment or other fi tures "o!ated at the 2remises, su!h u&dates and re&"a!ements wi"" be!ome the &ro&erty of $and"ord at the e &iration of the term of this $ease, at $and"ord?s e"e!tion* 4t is a!-now"edged that the intent of this &aragra&h is for the $and"ord to ha#e no duty to re&air or maintain any &ortion of the 2remises, e !e&t as &ro#ided herein* 8otwithstanding the foregoing, $and"ord may e"e!t to maintain and re&air the &a#ed areas and maintain and !are for the grounds around the bui"ding, in!"uding the !are of shrubs, genera" "ands!a&ing, and $and"ord may !o""e!t additiona" funds during a $ease year in order to bui"d a reser#e for "arge &a#ing re&airs or re&a#ing* 4f $and"ord ma-es su!h e"e!tion, )enant sha"" be res&onsib"e for reimbursing $and"ord for the !osts and e &enses of su!h maintenan!e and re&air* 4f )enant fai"s to ma-e any re&airs or &erform any maintenan!e re5uired in this
