ANSWER OF THIRD PARTY DEFENDANT
The third party defendant, Slippery Tile Company, Inc., by and through its counsel, Candice Corporate, responds to the Third Party Complaint as follows:
1. The third party defendant admits the allegations of paragraphs 1, 2 and 4 of the Third Party Complaint.
2. The third party defendant denies the allegations of paragraphs 7 and 8 of the Third Party Complaint.
3. The third party defendant is without sufficient information to admit or deny the allegations of paragraphs 3, 5 and 6 of the Third Party Complaint and, therefore denies these allegations.
4. The third party defendant denies all other allegations in the Third Party Complaint that are not specifically admitted.
AFFIRMATIVE DEFENSES
5. The third party defendant affirmatively alleges that the third party plaintiff has failed to state a cause of action upon which relief can be granted.
6. The third party defendant affirmatively alleges that the acts or omissions of third persons other than this responding third party defendant proximately caused or contributed to the events leading up to and the occurrence by which the plaintiff allegedly sustained injuries.
7. The third party defendant affirmatively alleges that the third party plaintiff's subsequent care and modification of the vinyl floor tiles were the proximate causes of the plaintiff's alleged injuries.
WHEREFORE, the third party defendant prays that the plaintiff recover nothing as a result of his Complaint, that the Complaint and the Third Party Complaint be dismissed, and that the third party defendant be awarded costs and fees incident to its defense of this action.
