The Indian supreme court in a historic
judgment on 9

May 2014 has for the first
time adjudicated in favor of power not the
truth. The biggest question is whether
Indian Muslim minority still retain the right
to conserve their distinct language , script
or culture as provided to them under Article
29/30 of the Constitution of India or has the
BJP/Modi risen above the law to be able to
trample the sacred and desecrate the holy.
Far from the political recriminations , An Indian named Arshad Mohsin, an inventor, a
writer , a moral activist had filed a series of petitions from Silvassa collector to the Chief
Election Commissioner to the Supreme court of India demanding an immediate halt to
the controlled demolition of Islamic faith in India by the saffron party (BJP) and their
commander Mr.Narendra Modi.
Having mischievously printed and distributed in their election manifesto during their
election campaign on 24
th
April 2014 , the holy word Imaan which encompasses
Islamic faith in its entirety , the BJP and Narendra Modi had not only committed
electoral offense under section 123 (3-A) , 123 (4) and 125 of the Representation of
peoples Act 1951 but also misguided Muslim voters into believing that Narendra Modi
has Imaan ( a word used for the declaration of Islamic faith ) Heres the slogan as
published in the manifesto of BJP distributed in Dadra and Nagar Haveli region

To those who dont know the sanctity of this word Imaan may refer to the holy Quran
where it has been mentioned by Almighty Allah in context of Islamic faith at around 25

Imaan is the declaration of ones faith in Allah the Almighty, his angels, his books, his
prophets, the day of judgment and that all good and evil fate is from Allah.
Imaan is bearing witness and testifying with complete faith that every word revealed
to the holy prophet(PBUH) is true. Does Mr.Modi testify this ?
Imaan is an adjective describing the quality of a true Muslim which cant be usurped
by a non-Muslim.Mr.Modi to the best of my knowledge is not a Muslim, therefor he and
his party cant be said to have Imaan.
# Therefor publishing the word Imaan by BJP and Mr.Modi in their political manifesto
during elections is a misrepresentation of facts and its an electoral offense under
subsection4 of section 123 of the representation of peoples act 1951.
# That Imaan is a Quranic word which has the highest religious significance in Islam
,, usurpation and misuse of such a sacred word by the so called Hindu Nationalist ,
yes sir , thats what Mr.Modi calls himself, is an act of insulting Islam and promoting
enmity between classes on grounds of religion, the malicious misuse of a word from
the holy book of Muslims is aimed at driving a wedge between Hindus and Muslims
and this is an electoral offense under section 125 of Representation of peoples act
1951.
# Article 29 of the constitution of India specifically protects the minorities of
safeguarding a distinct language , script or culture of their own and a right to conserve
the same. By usurping the specific religious word Imaan in their election manifesto
whereby sowing a seed of confusion and deception in the minds of the Muslim minority
voters for political gains , the BJP and Mr.Modi have violated article 29 of the
Constitution of India. Further sir,
# The first rule of Model code of conduct , which obtained a statutory force, it is
prescribed that no candidate or party shall use any language which aggravates the
existing differences between different religions, cast and community.The BJP and
Mr.Modi by using the word Imaan a word of the highest religious significance and
connotation have offended the religious sentiment of Muslim minority and further
attempted polarization of voters on communal and religious lines. This is a clear
violation of the Model Code of conduct.
Therefor, What is incontrovertible in this case is That the word Imaan is a sacred
word from the holy Quran with the highest religious significance and connotation for
Muslims and that by maliciously misusing this word in a political manifesto the BJP and
its PM aspirant Mr.Modi have FLOUTED the election code and flagrantly violated the
constitution of India.
I brought this matter to the notice of the Collector of Silvassa where the violation was
first reported , then to the notice of the Election commission in New Delhi by personally
visiting and requesting them to take recourse to address the issue and put a check on
the violations of Model code of conduct. But to no avail. Having no alternative or
efficacious remedy except to approach this honble supreme court for justice. I finally
took this matter to the Supreme Court of India pleading the honble judges that India is
in danger of betraying its legacy of secularism and sarv dharm samman .Our religious
freedom is under attack, our holy book is being desecrated, religious sentiment of
Muslims is being hurt and doors of justice are closed.
The honble bench which included the honble chief justice of India Mr.RM.Lodha
himself without letting me complete my arguments concluded that the Quranic word
Imaan may mean a lot to Islamic world and Indian Muslims but for Narendra Modi it
means nothing which meant it can be used by Modi the enemy of Islam for cheap
politicking.
Its up to the commanders of the faithful now to conserve Quran from being desecrated
by the RSS stooge Modi and his fascist party BJP.
