*et the ,uddhists keeping their eyes and mouth shut& and their hands clasped is most
reprehensi+le and inhuman +y any standard irrespective of their piety& when they know a most
cruel rape was committed on a mentally retarded helpless hapless girl& and on top of that the
e0ually criminal Attorney General of the cursed 1a2apakse regime had deemed it fit to release
the most heartless +rutal culprits scott free.
3he crime of +eing silent and passive o+servers is worse than the crime of rape itself. 4t only
implies that the /L society is approving of these crimes and the lawless un2ust actions of an AG
. 4f not& this /L society of 5ponnayahs67effiminate cowards) must +e thinking & after all these do
not concern us and are e8pecting the mentally retarded victims to form an association and stage

9arlier on Narammala police conducted investigations into the rape committed on the mentally

4n the year #$$ charges were filed +ased on +rutal rape and assault committed on a mentally
retarded youth. @n the first occasion when the Narammala police reported this crime & apart
from the statement of the victim & the dress she was wearing and other articles that were there at
the scene of the crime when the police inspected were produced as court productions.
Among them were the victim6s frock & the petticoat& panty & a pair of torn ru++er slippers and
strands of hair . After they were sent to the government analyst & these were sealed and sent to
court as court productions. 3he statement of the victim was recorded +y a specially trained
individual who knows to deal with the mentally retarded persons.
4n the statements made +y the two accused & +oth have admitted to have committed the rape.
3he articles that were searched and found +ased on their statements & were produced as court
productions. 9ven in the 2udicial medical report& GA3 No ## ; #$$ the rape had +een
confirmed . ,ecause of the +estial force used when committing the rape & the victim6s organ had
+een severely +ruised and had +led.
/ome amount of +lood clot was also found within the victim6s organ clearly indicating how
much this helpless victim had suffered . Bollowing the tussle +etween the victim and the rapists
& the victim had sustained +ruises& and swellings had also resulted .3he C"@ report too had
made mention of these& and that the victim is a mentally retarded girl.
3he victim had given +irth to a child later & and the <NA report had confirmed that the father of
the child is the accused /usantha ?i2itha ,andara .
3herefore what is most rudely shocking is & despite there +eing such cogent and copious
evidence & on the D th when the >uliyapitiya magistrate called up the case & the AG had sent a
letter to the magistrate whose content is as follows :

What is most significant to note in this letter of the one and only AG 7Atta ney General)of the
country who is holding a most lofty and responsi+le position in the 2udicial hierarchy is : it does
not +ear the most date E a most vital re0uirement &or the reasons in support of why he took such
a decision . 4n other words this AG of "a1a is a Ao1a 7rogue) or a Ca1a 7illicit commission
agent) . No AG who respects dignity of his position and professional ethics would have acted
this irresponsi+ly or disgracefully.
3he magistrate ,andula Gunaratne who took up the case on the : th was dismayed to receive
such a most deplora+le letter from the AG . After showing it to everyone present& he read out its
contents & and e8pressed his deep regret openly. 3he magistrate who was disappointed and
thoroughly saddened however remained silent & making every+ody to understand that there is
nothing that any+ody could do including himself after the AG has given such an instruction .
3he magistrate said& he is therefore releasing the suspects on that day.
3he AG had also directed not to proceed with the case any further& e8onerated the suspects of
all charges and to release the suspects. 4t was very o+vious & the court and the police were
rudely shocked and disillusioned with the AG6s decision.
4t is very unfortunate that the ,uddhist e8tremists who set fire to a "uslim +usiness
esta+lishment making false allegations that a +oy was molested even while the ==3? cameras
proved otherwise& are asleep over this incident where an innocent helpless mentally retarded
girl was raped +rutally +y two heartless rapists . 4t is still worse +ecause these e8tremists are
even not going to set fire to the heartless AG who added fuel to the fire of the girl6s sufferings
+y instructing the magistrate to the latter6s consternation to release the rapists while also
e8onerating them of all charges .
4t is now ! days since this outrageous un2ust callous action was taken +y the AG 7 Atta ney

lawyers organiFations nor the media have raised their voice of protest. (erhaps this is +ecause it
is not the victim of this +rutal rape +ut the gentlemen and ladies who claim to +e so called
champions of the cause of 2ustice & who are suffering from mental retardation.
