Environment and Forests was published in the Gazette of India, Extraordinary, Part II
section !, subsection "ii# vide $o% &%'% ()* "E# dated +(h May, +,,, and corri-endum
published in the Gazette of India Extraordinary PartII section !, subsection "ii# vide $o%
&' .)! "E# dated +!d /une, +,,, under powers conferred by sections 0,1 and +. of the
Environment "Protection# 2ct, *)10 "+) of *)10#, invitin- ob3ections from persons li4ely
to be affected, within a period of sixty days from the date of publication of the said
notification with re-ard to the Government5s intention to notify the 6attery "Mana-ement
and 7andlin-# 8ules, +,,,%
2nd, whereas all ob3ections received have been duly considered by the 9entral
Government:
$ow, therefore, in exercise of the powers conferred by sections 0, 1 and +. of the
Environment "Protection# 2ct, *)10 "+) of *)10#, the 9entral Government hereby
notifies the 6atteries "Mana-ement and 7andlin-# 8ules, +,,*%
1. Sh#$t Title a%& C#''e%(e'e%t. "*# ;hese rules may be called the )atte$ie*
Ma%a+e'e%t a%& ,a%&li%+! R-le*, 2001.
"+# ;hey shall come into force on the date of their publication in the 'fficial Gazette%
2. A..li(ati#%. ;hese rules shall apply to every manufacturer, importer, reconditioner,
assembler, dealer, recycler, auctioneer, consumer and bul4 consumer involved in
manufacture, processin-, sale, purchase and use of batteries or components thereof%
3. De/i%iti#%*. In these rules, unless the context otherwise re<uires,
a% 0A(t0 means the Environment "Protection# 2ct, *)10 "+) of *)10#:
1! 0a**e'1le$0 means a person who manufactures lead acid batteries by assemblin-
various components:
(! 0a-(ti#%0 means bul4 sale of used lead acid batteries or component "s# thereof by
invitation of tenders or auction, contract or ne-otiation by individual"s#, companies or
Government =epartments:
&! 0a-(ti#%ee$0" means a person "s# who auctions used lead acid batteries or
components, thereof,
e! 01atte$y0" means lead acid battery which is a source of electrical ener-y and contains
lead metal:
/! 01-l2 (#%*-'e$0 means a consumer such as 9entral or &tate Government
=epartments of 8ailways, =efence, ;elecom, Posts > ;ele-raph, &tate 8oad ;ransport
?nderta4in-s, &tate Electricity 6oards and others who purchase batteries throu-h central
5rate5 or runnin- contract centrally placed on behalf of individual departments or user
units under their 3urisdiction%
+! 0(#'.#%e%t*0 means lead bearin- components of a lead acid battery:
h! 0(#%*-'e$0 means a person usin- lead acid batteries excludin- bul4 consumers:
i! 0&eale$0" means a person who sells and receives lead acid batteries or components
thereof to and from the consumers or other dealers or retailers on behalf of the
manufacturers, importers, assemblers and reconditioners or otherwise:
3! 0&e*i+%ate& (#lle(ti#% (e%t$e0 means a collection centre established, individually or
3ointly by one or more manufacturers or importers, assemblers and reconditioners in
pursuance of their responsibilities under rule ( of these rules%
2! 0i'.#$te$0 means a person who imports new lead acid batteries or components
containin- lead thereof for the purpose of sale:
1! 0'a%-/a(t-$e$0" in relation to any factory manufacturin- lead acid batteries or
components thereof means a person or 9hief Executive 'fficer "9E'# of the company
who has control over the affairs of the factory or the premises for sale and collection of
lead acid batteries or components thereof,
'! 0#$i+i%al e4-i.'e%t 'a%-/a(t-$e$5 means manufacturer of e<uipment or product
usin- lead acid batteries as a component:
%! 0$e(#%&iti#%e$0 means a person involved in repairin- of lead acid batteries for
sellin- the same in the mar4et:
#! 0$e(y(le$0means an occupier who processes used lead acid batteries or components
thereof for recoverin- lead
.! 0$e+i*te$e& $e(y(le$" means a recycler re-istered with the :5Ministry of Environment
and Forests or an a-ency desi-nated by it for reprocessin- used lead acid batteries or
components thereof:
4! 0State )#a$&0 means the concerned &tate Pollution 9ontrol 6oard or the Pollution
9ontrol 9ommittee as the case may be
$! 0-*e& 1atte$ie*0 means used, dama-ed and old lead acid batteries or components
thereof: and
*! the words not defined in these rules will have the same meanin- as defined in the
Environment "Protection#%2ct, *)10 and the rules framed thereunder%
4. Re*.#%*i1ilitie* #/ 'a%-/a(t-$e$, i'.#$te$, a**e'1le$ a%& $e"(#%&iti#%e$." It shall
be the responsibility of a manufacturer, importer, assembler and reconditioner to
"i# ensure that the used batteries are collected bac4 as per the &chedule
a-ainst new batteries sold excludin- those sold to ori-inal e<uipment
manufacturer and bul4 consumer"s#:
"ii# ensure that used batteries collected bac4 are of similar type and
specifications as that of the new batteries sold:
"iii# file a halfyearly return of their sales and buybac4 to the &tate 6oard
in Form I latest by !e /une and ! , =ecember of every year:
"iv# set up collection centres either individually or 3ointly at various
places for collection of used batteries from consumers or dealers:
v% ensure that used batteries collected are sent only to the re-istered recyclers,
"vi# ensure that necessary arran-ements are made with dealers for safe
transportation from collection centres to the premises of re-istered
recyclers :
"vii# ensure that no dama-e to the environment occurs durin-
transportation:
"viii# create public awareness throu-h advertisements, publications,
posters or by other means with re-ard to the followin-
"a# hazards of lead:
"b# responsibility of consumers to return their used batteries
only to the dealers or deliver at desi-nated collection
centres: and
"c# addresses of dealers and desi-nated collection centres%
"ix# use the international recyclin- si-n on the 6atteries:
"x# buy recycled lead only from re-istered recyclers: and
"xi# brin- to the notice of the &tate 6oard or the Ministry of Environment
and Forests any violation by the dealers%
6% Re+i*t$ati#% #/ I'.#$te$*. ;he importer shall -et himself re-istered with the
Ministry of Environment and Forests or an a-ency desi-nated by it by submittin- details
in Form**%
6. C-*t#'* (lea$a%(e #/ i'.#$t* #/ %ew lea& a(i& 1atte$ie*. 9ustoms clearance of
imports shall be contin-ent upon
i% valid re-istration with the 8eserve 6an4 of India "with Importer5s 9ode $umber#:
"i3#one time re-istration with the Ministry of Environment and Forests or an
a-ency desi-nated by it in Form**:
ii% underta4in- in Form***: and "iv#a copy of the latest halfyearly return in Form
I@
A% Re*.#%*i1ilitie* #/ &eale$. It shall be the responsibility of a dealer to
i% ensure that the used batteries are collected bac4 as per the &chedule a-ainst new
batteries sold:
ii% -ive appropriate discount for every used battery returned by the consumer:
"iii# ensure that used batteries collected bac4 are of similar type and
specifications as that of the new batteries sold:
"iv# file halfyearly returns of the sale of new batteries and buybac4 of old
batteries to the manufacturer in Form @ by !*st May and !,th $ovember
of every year,
"v# ensure safe transportation of collected batteries to the desi-nated
collection centres or to the re-istered recyclers : and
"vi# ensure that no dama-e is caused to the environment durin- stora-e and transportation
of used batteries%
7. Re*.#%*i1ilitie* #/ $e(y(le$. Each recycler shall
i% apply for re-istration to the Ministry of Environment and Forests or an a-ency
desi-nated by it if not applied already, by submittin- information in Form @I:
"ii# ensure strict compliance of the terms and conditions of re-istration:
however, those already re-istered with the Ministry of Environment and
Forests or all a-ency desi-nated by it for reprocessin- used batteries
would be bound by the terms and conditions of such re-istration:
"iii# submit annual returns as per Form @II to the &tate 6oard:
"iv# ma4e available all records to the &tate 6oard for inspection:
v% mar4 58ecycled5 on lead recovered by reprocessin-: and
"vi# create public awareness throu-h advertisements, publications, posters
or others with re-ard to the followin-
"a# hazards of lead: and
"b# obli-ation of consumers to return used batteries only to the re-istered
dealers or deliver at the desi-nated collection centres%
8. 9$#(e&-$e /#$ $e+i*t$ati#% : $e%ewal #/ $e+i*t$ati#% #/ $e(y(le$*. *# Every recycler
of used lead acid batteries shall ma4e an application in Form @I alon- with the followin-
documents to the /oint &ecretary, Ministry of Environment and Forests or any officer
desi-nated by the Ministry or an a-ency desi-nated by it for -rant of re-istration or
renewal:
"a# a copy of the valid consents under Water "Prevention and 9ontrol of Pollution# 2ct,
*)A(, as amended and 2ir "Prevention and 9ontrol of Pollution# 2ct, *)1 *, as amended:
"b# a copy of the valid authorisation under 7azardous Wastes "I Mana-ement and
7andlin-
8ules, *)1) as amended:
"c# a copy of valid certificate of re-istration with =istrict Industries 9entre : and
"d# a copy of the proof of installed capacity issued by either &tate Pollution 9ontrol
6oard
B=istrict Industries 9entre%
"+# ;he /oint &ecretary, Ministry of Environment and Forests or any
officer desi-nated by the Ministry or an a-ency desi-nated by it shall
ensure that the recyclers possess appropriate facilities, technical
capabilities, and e<uipment to recycle used batteries and dispose of
hazardous waste -enerated:
"!# ;he /oint &ecretary , Ministry of Environment and Forests or any
officer desi-nated by the Ministry or an a-ency desi-nated by it shall ta4e
decision on application for re-istration within *+, days of receipt of
application form with complete details:
"(# ;he re-istration -ranted under this rule shall be in force for a period of
two years from the date of issue or from the date of renewal unless
suspended or cancelled earlier:
".# 2n application for the renewal of re-istration shall be made in Form
@I atleast six months before its expiry% ;he /oint &ecretary, Ministry of
Environment and Forests or any officer desi-nated by the Ministry or an
a-ency desi-nated by it shall renew the re-istration of the recycler -ranted
under sub rule"(# of this rule, after examinin- each case on merit:
"0# ;he /oint &ecretary, Ministry of Environment and Forests or any
officer desi-nated by the Ministry or an a-ency desi-nated by it may, after
-ivin- reasonable opportunity to the applicant of bein- heard, refuse to
-rant re-istration:
"A# ;he /oint &ecretary, Ministry of Environment and Forests or any
officer desi-nated by the Ministry or an a-ency desi-nated by it may
cancel or suspend a re-istration issued under these rules, if in his B her
opinion, the re-istered recycler has failed to comply with any of the
conditions of re-istration, or with any provisions of the 2ct or rules made
thereunder after v n- film an opportunity to explain and after recordin- the
reasons therefor:
"1# It shall be the responsibility of the &tate 6oards to monitor the
compliance of conditions ibed while accordin- re-istration, and
)% 2n appeal shall lie a-ainst any order of suspension or cancellation or refusal of
re-istration passed by the /oint &ecretary to the Ministry of Environment and
Forests or any officer desi-nated by the Ministry or a-ency desi-nated by it% ;he
appeal shall be in writin- and shall be accompanied with a copy of the order
appealed a-ainst and shall be presented within !, days of passin- of the order%
*,% Re*.#%*i1ilitie* #/ (#-*-'e$ #$ 1-l2 (#%*-'e$." 1! It shall be the responsibility of
the consumer to ensure that used batteries are not disposed of in any manner other than
depositin- with the dealer, manufacturer, importer, assembler, re-istered recycler,
reconditioner or at the desi-nated collection centres%
"+# It shall be the responsibility of the bul4 consumer to
"i# ensure that used batteries are not disposed of in any manner other than
by depositin- with the dealerBmanufacturerBre-istered recyclerBimporterB
reconditioner or at the desi-nated collection centres, and
"ii# file halfyearly return in Form @III to the &tate 6oard %
"!# 6ul4 consumers to their user units may auction used batteries to re-istered recyclers
only%
11. Re*.#%*i1ilitie* #/ a-(ti#%ee$." ;he auctioneer shall
"i# ensure that used batteries are auctioned to the re-istered recyclers only,
"ii# file halfyearly returns of their auctions to the &tate 6oards in FormIC: and
"iii# maintain a record of such auctions and ma4e these records available to the &tate
6oard for inspection%
12. 9$e*($i1e& A-th#$ity. ;he prescribed authority for ensurin- compliance of the
provisions of these rules shall be the &tate 6oard% 2nd, it shall file an annual compliance
status report to the 9entral Pollution 9ontrol 6oard by !,

13. D-tie* #/ Ce%t$al 9#ll-ti#% C#%t$#l )#a$&. ;he 9entral Pollution 9ontrol 6oard
shall compile and publish the data received every year from the &tate 6oards% It shall
review the compliance of the rules periodically to improve the collection and recyclin- of
used% lead batteries and apprise the Ministry of Environment and Forests, Government of
India%
14. C#'.-te$i*ati#% #/ Re(#$&* a%& Ret-$%*. Ministry of Environment and Forests
or an a-ency desi-nated by it shall develop a system for computerised trac4in- of
"i# distribution and sale of batteries:
"ii# collection, auction, transport and reprocessin- of used batteries:
"iii# sale of reprocessed lead by re-istered recyclers: and
"iv# sale of lead from all domestic producers or importers%
