Summer Housing Contract 14.doc Page 2 of 4 For good and valuable consideration, the Ames Alumni Board of Epsilon Chapter of Beta Sigma Psi Fraternity (hereafter referred to as the Board), and the resident named above (and the residents undersigned parent(s) or legal guardian(s) if said resident is less than 21 years of age), do hereby mutually agrees as follows: I) Terms of the Lease: It is mutually agreed this date by and between the Board and the undersigned, that the Board does hereby lease to the resident an agreed upon room on the premises of the Chapter House at 2132 Sunset Drive, Ames, Iowa (hereafter referred to as the Chapter House). This lease is in effect for the term stated above (see page 1). The resident understands that the agreed upon room will be assigned by the undergraduate membership of Epsilon Chapter of Beta Sigma Psi (hereafter referred to as the Active Chapter), or their designate. Furthermore, the agreed upon room assignment may be changed at any time during the term of this contract at the discretion of the Board, the Active Chapter; or their designate. 1) The resident shall pay to the Board, the entire contract amount specified above (see page 1) in no more than two installments. The initial installment shall be no less than one-half of the contract's amount and shall be due on the date specified (see page 1). Furthermore, the second installment shall be no less than the remaining balance due, and shall be due on the date specified (see page 1). 2) If the resident fails to pay the remaining balance on the date specified, the resident will not be allowed to maintain residency status effective immediately. It is at the discretion of the Board, as well as the Active Chapter, to enforce the eviction of the non-paying resident. Failure to receive a billing statement will not exempt residents from this action. a) Upon eviction, the resident (as well as the residents undersigned parent(s) or guardian(s) if said resident is less than 18 years of age), shall be held liable for any unpaid balance at the maximum lawful rate of interest, and all costs of collection, including reasonable attorneys fees, which the Board or the Active Chapter may incur in connection therewith. If the resident or the residents undersigned parent(s) a guardian(s) pays the delinquent portion of the unpaid balance, the resident may petition to the Board for admittance to the Chapter House. b) Upon eviction, a written itemized list of the damages, repairs, cleaning charges, or phone charges attributable to the resident will be given to the resident within (60) days of termination of the residents Tenancy. 3) The resident (and the residents undersigned parent(s) or guardian(s) if said resident is less than 18 years of age), shall be held jointly and severally liable for the residents full and faithful performance of the terms and conditions of this contract and for payment of the specified contract amount. 4) The resident may legally break this contract within (72) hours of signing and shall not be obligated to the Board or the Active Chapter in any way. Failure by the resident to meet the obligations of this contract does not in any way release the resident from the financial obligations of this contract. 5) The Board, reserves the right for itself and for the Active Chapter, to enter any room in the Chapter House during reasonable hours for the purpose of inspecting the room and making such repairs, alterations, additions, or improvements as the Board may deem necessary or desirable.
Summer Housing Contract 14.doc Page 3 of 4 6) The Board and its officers, directors, employees, and agents shall not be responsible for any injury, loss or damage to the resident or the residents property resulting from fire, theft, or any other cause. The resident shall insure any property bought onto the Chapter House premises against risk of loss or damage. 7) The Active Chapter or the Board may terminate this contract if the Chapter House becomes uninhabitable by reason including, bit not limited to, fire, windstorm, or other natural catastrophe. 8) The Active Chapter or the Board may terminate this contract and take possession of the residents accommodations at any time if the resident fails to comply with any of the terms and conditions of this contract. In such event, the resident shall be responsible for any loss of revenue sustained by the Chapter, and the Chapter at its option, shall be permitted to retain, as liquidated damages, all sums paid to it thereunder by the resident. II) Responsibilities of the Active Chapter and Board: 1) The Active Chapter and the Board shall provide to the resident such services as are customarily furnished by the Active Chapter to the residents of its Chapter House during semester breaks. III) Responsibilities of the Resident: 1) The resident shall not assign this lease or sublease the premises or any portion thereof. 2) The resident shall use the Chapter House only for residential purposes and shall not conduct any business or commercial enterprise therein. The resident shall comply with all local, state, and federal laws, ordinances, and regulations and with the rules and regulations of the Active Chapter, the Board, and Iowa State University. 3) The resident shall take good and reasonable care of the Chapter House and its furniture, furnishings and equipment. The resident shall keep them in a neat, clean, and orderly condition; shall suffer and permit no waste to be committed in or upon them and shall make no alterations or additions to the premises without prior written consent of the Active Chapter and the Board. 4) Upon the expiration or termination of this contract, the resident shall remove their personal property from the Chapter House and shall peaceably surrender possession of the premises and property in clean condition and good repair, ordinary wear and tear resulting from careful usage alone expected. After surrender of possession by the resident, the Active Chapter shall have the right to dispose of any personal property left by the resident in or on the Chapter House premises, and the Chapter shall not be responsible to the resident to account for the disposition of such property. 5) The resident shall not paint their room without the prior written consent of the Active Chapter and the Board. The resident shall not affix any items to the doors of the Chapter House. The resident shall not drive any nails or screws into the woodwork, walls, or ceilings of the Chapter House and shall be responsible for any damage caused by items affixed thereto. 6) Damage to a room or its furnishings beyond ordinary wear and tear will be charged to the resident(s) occupying the room. Any resident that intentionally causes damage to the Chapter House is responsible for the monetary cost of repair.
Summer Housing Contract 14.doc Page 4 of 4 7) Cooking is prohibited in individual rooms and respective sleeping rooms. The resident(s) occupying a room may, however, keep and use therein a small, bar-type refrigerator. No other major electrical appliance shall be kept or used in an individual room. 8) Lofts and other similar structures shall not be erected in a room without the prior written consent of the Active Chapter and the Board. Waterbeds shall not be kept or used in the Chapter House. 9) There are to be no pets within the Chapter House unless prior written approval by the Board is obtained. 10) It is forbidden for any resident to have in their possession within the boundaries of the Chapter House any type of firearm or weapon. Any resident not adhering to this rule will be evicted immediately. 11) It is forbidden for any resident to participate in activities that include illegal drug(s) or drug paraphernalia. Any resident not adhering to this rule will be evicted immediately. 12) It is forbidden for any resident to smoke tobacco products within the boundaries of the Chapter House. Any resident not adhering to this rule will be evicted immediately. 13) It is forbidden for any resident to burn candles or use halogen lamps within the Chapter House. Any resident not adhering to this rule will be evicted immediately. 14) It is forbidden for any resident to tamper with or destroy fire and smoke detection devices in the Chapter House. Any resident not adhering to this rule will be evicted immediately. This contract is made with reference to and shall be construed in accordance with the laws of the State of Iowa, in which state the parties shall perform it. Any action arising under the terms and conditions of the contract may be brought in any local, sate, or federal court located in the County of Story, State of Iowa, having jurisdiction of the subject, and the undersigned parties hereby consent that any such court shall have personal jurisdiction over them with respect to any such action.
