1. State what kind of civil case it is (intentional tort, unintentional tort, contract case, etc.) and
the present the plaintiffs case. (4 marks L1)

Expect a half page. Be very specific on the details of the case. Summarize with a clear
statement why the plaintiff is bringing this case to court (their thesis).



2. List the witnesses (at least 2) and questions for them (responses should be also filled in
since you are calling witnesses to give this side of the story). This could look like a court
transcript. (4 marks L1)

A half page minimum, more likely a page or more. Ask questions that lead the witness
to respond with information (evidence) you need to make your case. Do not ask for
information that doesn't help your case. It can help to summarize the witness
statements after they respond to clarify your claims.


3. Write possible cross-examination questions by the defendants lawyer of the plaintiffs
witnesses (consider the other side of the case). This also might take the form of a transcript.

Try to contradict the claims of the plaintiff's lawyer. You may need to lead the witness
since they were called by the other side and are unlikely to agree with your argument in
full.



4. Presentation of the defendants case (try to make this a strong case as well). (4 marks L1)

Same advice as for the plaintiff: Be very specific on the details of the case. Summarize
with a clear statement why the defendant is fighting this case to court (their anti-thesis).

interesting or difficult case? Are there elements or either side that are difficult to prove in
court? What witnesses provided the most telling testimony? Does sentiment or morality tip
the opinions of onlookers in one direction or the other? (4 marks L1)



8. Consider that you are now the judge. Define first of all the issue at stake in the case. State
what you think are the 2 or 3 most important details in your decision. How did you arrive at a
settlement (including the dollar figure)? Give your final judgement decision based on this
information and include the settlement. (4 marks L1)
