I picked him up about two hours later. We met with Detective Wesley Hagler and checked a residence. We went to Capps Road in McEwen to look at some land that used to belong to Lemuel Palk. I was told by Joshua Henry that large quantities of methamphetamine had been manufactured there by him and Michael Scott Palk. Wesley and I had seen evidence of meth being made there about two years before. The grass in the road had grown and it looked as if it had not been travelled until this summer. I had periodically driven by when I noticed the road started looking travelled again. It had been an unusually wet summer and it should have grown up. We drove up the road and found evidence of recent activity. There were trails beat down in the grass and leaves. The trail to the north lead to a clearing about ten feet by fifteen feet. I found double A battery ends, zippers from freezer bags, freezer bags, a plastic Igloo water cooler and fresh cigarette butts. The trail leading to the south looked very heavily travelled. We found camouflaged air tanks, liquids in freezer bags, plastic containers, acid spills, fresh cigarette butts, double A battery ends, and a bucket. We could smell camping fuel and ammonia. We did not disturb the area and left before we were seen. A search of the Tax Assessor's records showed Michael Scott Palk as the land owner for the driveway and area north. SVC LLC is the land owner of the area to the south. This was later verified with a GPS navigator. On September second 2009 Hagler, Sgt Dewayne Jackson, Officer Kinta Bell, and I went to conduct surveillance in the area. We made no contact and nothing looked different. It was a full moon but the tree cover overhead kept it very dark. This caused us to believe the individuals using these items to manufacture meth were coming during the day. The place was well kept which would be very difficult to do with a flashlight at night. We arrived at 6:30 PM and left at 11:00 PM. On September third 2009 Officer Shaun Wilson and I went to conduct surveillance in the area. We made no contact and nothing looked different. We arrived at 5:00 PM and left at 9:00 PM. On September fourth 2009 I drove past the area at 11:00 AM and saw nothing different. The area is about one hundred and fifty yards through the woods and past the crest of the ridge. I was looking for distinct sign of traffic on the driveway and smelling for chemicals. On September fifth 2009 I drove past the area at 6:30 PM and saw nothing different. On September sixth 2009 Hagler, SA Jimmy Turner,Detective Hagler, Officer Jeremy Brooks, and I went to conduct surveillance in the area. We found a trail leading from the south area heading south east. There was a substantial cook site with a strong odor of camping fuel and ammonia. This area had several fresh Marlboro cigarette butts scattered around it. It rained while we were there. We arrived at 4:00 PM and Hagler and Turner left at 8:00 PM. Brooks and I left at 12:00 AM. On September eighth 2009 Sgt Steve Thompson, Sgt Shane Sexton, and I went to conduct surveillance in the area. We took pictures and found new tire impressions at the top of the hill in the dirt. We also found a drink container and an empty bag of chips. We arrived at 12:00 PM and left at 1:00 PM. On September ninth 2009 at about 12:00 PM Thompson, Sexton and I went to conduct surveillance in the area. We checked the area and did not see any changes from the day before. We heard a vehicle driving on Capps. It stopped. We heard one door slam. We ran south for about fifty yards and laid down. I laid beside a small log. They knelt behind trees behind me. We were wearing camouflaged clothing. Sexton soon alerted me and pointed north. I saw Justin Estep walking east, wearing a white shirt and carrying a black tote bag. He walked within fifty feet from me. When I first saw him, I immediately recognized him. Sexton and Thompson were later shown Estep's driver's license photo and confirmed his identity. He did not see us so we kept still until he passed us. He was not following any trail. He walked straight for the large cook site and uncovered it. He moved several of the items and then made phone calls with his cell phone. We had gone to this area in the daylight several times before finding this cook site because it was so well camouflaged. We hid ourselves better and I called Hagler to update him on our situation. Estep was talking loudly and making a lot of noise but we could not see him anymore. Sexton crawled towards Estep to get a view. He saw Estep at the cook site. He could hear him talking about an object near an orange marker and asking the other person if they hid the car good enough. Estep walked towards Sexton and stared directly at him from twenty feet away. Sexton was behind a tree that only covered half his chest. Estep turned away and made another phone call but spoke quietly this time. We could hear Estep periodically. We saw him walking towards the driveway about forty five minutes after being there. He was carrying the same black tote bag. I followed him but lost sight of him when he crested the east side of the ridge. We moved to the north site to check the road. I walked through the brush towards the site and saw Estep walking towards the driveway. He did not have the tote bag this time. I called Hagler back. Turner and Hagler drove to the bottom of the driveway and Hagler walked up it to find Estep but missed him. Thirty to sixty seconds passed between the time I last saw him walking down the driveway and the time I heard Hagler shut his car door. Lieutenant Joe Maples and Sgt Jackson arrived to help search the area. I noticed that the tarp had been moved at the large cook site and a scanner had been left in the tree above it. It was programmed for the Humphreys County law enforcement frequency and turned on. It was not there before Estep arrived. No one was found in the woods during the search. Maples stopped a car at Capps Road and Gravelly Run belonging to Estep. Marvin Tabor was driving the vehicle. Tabor is Estep's step-father. Tabor told Maples that he was looking for a place to deer hunt. Maples asked about the car. Tabor told maples that he got the car from Estep the night before and he did not know where Estep was. Maples saw Estep driving that particular car on Hwy 70 near the National Guard Armory at 9:00 AM that morning. Sheriff Davis, Hagler and Turner also questioned Tabor. The search was ended and the lab clean up was organized. Detective Captain Larry Lescure, Detective Tracy Hearndon, Captain Russell Downing,Deputy Brian Baker and I conducted the clean up. Sgt Sexton and Sgt Thompson made digital images of the clean up. The following items were found at the main cook site, a scanner containing the Humphreys County law enforcement frequency ( left by Estep that day, turned on), 2 plastic pitchers holding freezer bags of camp fuel, 1 empty plastic pitcher, 1 gallon jug of water, a five gallon plastic bucket holding HCL gas generators and acid, a five gallon bucket of plumbing tools, hoses, an air tank converted to hold ammonia with some in it, a 5 gallon plastic container holding some camp fuel, a box of freezer bags, 1 box of hand towels, 2 rolls of paper towels, 1 set of bungee straps, 1 tarp, 1 camo net, assorted trash, 1 shovel, 1 pick, 1 canopy, two lithium batteries, and 2 freezer bags holding at least 1 pound of pill binder each. The secondary cook site, 1 pitcher holding a freezer bag of camp fuel, a 5 gallon plastic bucket holding a HCL gas generator and acid, 1 funnel, 1 quart of liquid fire acid, 1 bag of assorted trash. The main storage or burial site contained two air tanks converted to hold ammonia, a hose, and three large bags of trash. A four inch long mouse ran from under the trash bags when they were moved. The secondary storage or burial site contained on large bag of trash. A bag of trash was also found hidden under two old tires. A blue Igloo drink container was found near the north site on Palk's property. It contained two HCL gas generators. The trash was checked for liquids and solids that would create a hazard. All of it was moderately contaminated with acid, camp fuel or lithium. 5 empty acid containers, 21 empty camp fuel cans, 4 plastic bags of pill binder ( they weighed about six pounds), and a freezer bag full of stripped batteries were found. On September 11 2009 at about 2:15 PM Lescure pulled finger prints from the scanner and it's batteries. They had been fumed with super glue before being dusted. They will be sent of analysis. One day before communication resumes between Sheriff Davis' county issued cellphone and phone number registered to address Mr. Palk frequently resided. 09/09/2009 "mega-lab" shut down. Turner was notified by phone that someone had been dropped off at the bottom of the road at the target location. Turner drove toward target area and coming off of Capps Road turning onto Hargis Road Turner observed a white male driving a red camaro. No one else was observed in the vehicle. Turner was not aware that the vehicle was owned by Estep at this time. After being requested to come to the target location Turner drove Hagler to the area. Turner stayed at the bottom of the road observing for anyone that might exit woods in the area. A maroon colored vehicle was stopped driving down Capps Road from the east. A white male identified by Turner as Cody Tabor and a white female not identified was in the vehicle. The subjects said that they were getting back from getting some hamburgers. Turner observed a Mcdonolds in the back seat behind the driver. The vehicle had a Robertson County tag affixed to the back of the vehicle. Turner was unaware that Tabor was the step brother of Estep. While at the bottom of the road that lead up to the target location a red camaro drove by, Hagler noticed that it was a vehicle owned by Estep and Turner told Hagler that it was the same vehicle that had driven off Capps Road when he was notified that someone had just been dropped at target location. Hagler instructed Maples to stop the vehicle and vehicle was stopped on Gravely Run Road. Hagler and Turner spoke with driver of red camaro identified as Marvin Tabor. Tabor told Hagler that he was in the area scouting for a place to deer hunt. When asked about the owner of the vehicle Hagler was told that it belonged to Tabors step son Justin Estep. Consent was given to look in the vehicle. A receipt found by Hagler from the Pilot Station at Buffalo showed that fuel and cigarettes (Marlboro) were purchased earlier on the ninth. A disposable green propane container was also noticed in the car. When Marvin Tabor was asked about why Cody Tabor would be in the area Marvin Tabor told Hagler that Cody Tabor has called him earlier and that he was bringing Marvin Tabor a hamburger.
